Dear Mr. Et Ms. Aceves:
Your architectural request to install a pool and spa has been approved by the
Architectural Committee under the following conditions:
1. The finish lot grading and drainage are constructed on this lot in accordance
with the requirements of the governmental agencies in this jurisdiction. For
your own protection, please be sure that landscaping, walls, patios and other
improvements installed provide for positive drainage away from the
foundation of your home (2% minimum). and away from ycur neighbor's
property. You will be responsible for damage to your home or lot or to your
neighbor's home or lot due to improper modification of the fin•sh lot grading
and/or drainage. Please also refer to Section 8.2.15 Utility Drainage
Easements and 8.2.18 Alteration of Slope. Improvements Proh. bited of your
Declaration of Covenants, Conditions and Restrictions entitled `Drainage" for
more details. NOTE: Extra precautions should be taken with planter areas
next to the foundation, where trapped water can lead to damage to the
foundation. Since the finished grade should be maintained 6 inches below the
house slab, any installed concrete work should not trap water against the
foundation. In addition, planters should not be allowed to fill above the
required grade.
2. Trees should be planted far enough from existing fences so , as to prevent
damage to the fences and existing foundations as they mature.
3. You must comply with all City ordinances.

4. You must furnish the Architectural Committee with a copy of your City
permits for our files before work commences on these structures.
5. It is understood that the pool equipment will be shielded from_view from the
common area. If noise from the pool equipment becomes an issue with the
neighbors, you must take the necessary steps to mitigate the noise.
-6. If a wall is removed to provide, access for construction, the wall must be put
back up as originally designed.
We trust that only licensed, insured contractors will be performing the work and
that any required permits will be obtained. Please be reminded that any damage
to the common. area due to the construction in.your rear yard should be repaired
in a timely manner.
Please review the enclosed excerpts from the Homeowner Maintenance Manual.
