Let me start by apologizing for any inconvenience or negative fiscal impact that you may have experienced as a result of the situation outlined -in your letter. I hope that the following explanation of events will assist you in determining a course of action to obtain adequate remedies. On 12/2/94 the walls of your house were inspected for the required R-13 insulation. The ceiling was not inspected at this time because it was determined by the developer that the insulation was to be blown -in. This process can not take place until the dwelling has been drywalled. Unlike batt insulation (such as in your walls) the blown in insulation has no markings once installed. The desired R value is obtained by shooting the loose fill insulation out of a hose until the desired uniform depth is achieved in the entire area requiring insulation. Once this process is completed the licensed insulation contractor is required by the state energy code to provide an "Insulation Certificate" to the building owner. The California Energy Code recognizes that the alternative to accepting the Insulation Certificate would be to provide full time inspection during the actual process of placing the loose fill insulation, or causing the inspector to crawl around in the attic in the insulation after it is placed and take random measurements of the depth of .the insulation. As you might,imagine neither of these alternatives is very reasonable. It is obvious that the Insulation Certificate for your house (. a copy of which was provided to the Building Department) was issued in error. There is no evidence to suggest that the document was produced in an attempt to defraud any party involved, however its issuance has resulted in negative impacts. Upon being informed by you that this- situation existed, the developer was immediately contacted by Bruce Pellitier of this department, and informed of the MAILING ADDRESS - P.O. Jim Snellenberger later informed Bruce that he had contacted the insulation contractor and that the missing insulation would be installed promptly and everything would be taken care of. Bruce also received a message from you on the 8th of September that there was no need to call as that the matter was being taken care of. This message was consistent with the conversation that Bruce had with Jim Snellenberger. Bruce was under the impression that because of the actions that he had initiated to remedy the situation that all parties concerned had been satisfied. As to the liability for your increased electric bills for those months prior to the installation of the insulation, I would suggest contacting the Snellenbergers. In the past I have found them to be very reasonable and more than willing to stand behind their product. If you like I would be happy to contact the Snellenbergers regarding this matter. Our home is in the Cactus Flower subdivision, a Roger Snellenberger project. We are very de- lighted with La Quinta and we look forward to giving to the community. We are not interested in living here in such a manner that we will always be concerned about what we are getting. Our focus will be on what we can contribute. We think this is the essence of being a good neighbor and we want to be good neighbors. As we look around us, we see there are more than enough opportunities for us, particularly with the youth. At this point, we are not feeling very, good about the City government. We want to feel good about it, so this letter is the first step. When we moved from Palm Desert (where we currently have a patio furniture business) we anticipated lower energy bills. We were told that this was the case for residents east of Washington. Unfortunately, this has not been our experience. I believe the reason for this is that we have had no insulation in our attic. Our home was approved for,occupancy by the City of La Quinta liecause the building department was given a certificate by the insulation company saying that the home was insulated. The home was never inspected. My comprehension of these kind of matters is admittedly inadequate. I cannot understand how this could have happened to us. Our bills have probably been 25- 30% higher than they should have been. I contacted the building department immediately upon finding out that the insulation was missing. This was on the 7th. of this month. I called again on the afternoon of the 8th. and informed someone in the department that there was no need to call me back because, by that time, I had set up an appointment for the insulation company to come out and take care of the unfinished business. Nobody from the City followed up to make sure the insulation was put in, Nobody from the City apologized for the increased bills. Nobody from the City offered to absorb the liability. I did speak with someone from the building department the day after the insulation was put in, but that was only because there were. a couple of guys inspecting the pool being dug .next door and I went over to them and initiated the conversation. The gentleman I spoke with informed me that my home .had NEVER BEEN INSPECTED BY THE CITY to see if it was insulated or not. He said, "We probably should do these inspections." Yeah,-1 agree. It would keep letters like this from being written. My understanding, like I said, is far from adequate. I .have tried to find someway to straighten it out in my mind, but I can't seem to feel good about any of this. 1 have even considered going to my attorney, but 1 thought I would try to get something accomplished outside of the legal arena. Perhaps we could come together and have a meeting of the minds on the liability here. Like.I said, we are not troublemakers. In fact, we hope to expand our business into La Quinta in the future. We will be around a Jong time and we want to feel good about the City government from the beginning. I don't know.if I should even be sending this letter to you, but I expect you will see that it gets passed to the appropriate person(s). Hope tohear from you soon.
