Dear.Mr. Ramon:
The Community Development Department has reviewed and approved your revised request
to install twelve (12) neN Verizon panel antennas, located behind new FRP screening
mounted on existing building facades, twelve (12) new radio remote units (RRU), five (5)
new fiber demarcation boxes behind the existing roof parapet , and install/replace other
associated roof -mounted equipment within a new 7' 6' high screen wall enclosure, in
association with existing telecommunication equipment located at 47647 Caleo Bay Drive.
As part of this request, approval has also been granted for the following related
applications as concurrently filed:
Modification by Applicant 2015-0007
The proposed project requires modification to the existing north and south building
facades, to add fiber -reinforced polymer (FRP) screening. -t has been determined that the
modifications constitute minor changes that are eligible for consideration under LQMC
Section 9.200.090.C; speci ically, subsection C.S. These criteria were reviewed and were
determined to be applicabl= to the changes proposed.
Minor Adjustment 2015-0005
The proposed project requires an adjustment to the 40'_height limit of the Community
Commercial (CC) zoning d5strict, to allow the proposed 7' 6" screen wall enclosure to
exceed the height limit at on overall height of 40' 2", as shown on the approved plans for
the Minor Use Permit.
Approval of these applications is subject to the exhibits on fle for the Minor Use Permit, and
the following Findings and Conditions of Approval:
MODIFICATION BY APPLICANT APPLICATION:
The Community Development Director has determined that the proposed plan
modifications are minor, will not result in a significant chance in the project as approved by
the decision-making autho-ity, and complies with the spirit and intent of the original

approving action under Site Development Permit '2004-811. Therefore, the above
referenced design modification is approved pursuant to LQMC Section 9.200.090, subject to
the conditions of approval attached to MUP 2015-0003.
FINDINGS — MINOR ADJUSTMENT APPLICATION:
1. Consistency with General Plan. The project is corsistent with the general plan. The
proposed increase of 2" to the CC zoning limit cf 40 feet, will not affect land use
consistency, nor be incompatible with or otherwise measurably impact surrounding
land uses.
2. Consistency with Zoning Code. The project is consistent with the provisions of the La
Quinta zoning code. The proposed increase of 2" to the CC zoning height limit of 40
feet is permissible under provisions of 9.200.040 a the zoning code governing minor
adjustments, as it is well under the maximum allowable 10% adjustment (0.04%).
Compliance with CEQA. Processing and approval of the permit application are in
compliance with the requirements of the California Environmental Quality Act. The
adjustment requested falls under CEQA Guidelin--s Section 15305(a) as a "Minor
Alterations to Land" - Class 5 Categorical Exemptim.
4. Surrounding Uses. Approval of the application will not create conditions materially
detrimental to the public health, safety and general welfare or injurious to or
incompatible with other properties or land uses in the vicinity. The adjustment has
no impact on health or safety issues, and will not affect physical land use
characteristics in the vicinity.
FINDINGS — MINOR USE PERMIT APPLICATION:
1. Consistency with the General Plan: The proposed equipment and related
improvements are consistent with the goals, objectives and policies of the General
Plan, in that the proposed equipment is intended to enhance community access to
quality wireless communication services.
Public Welfare: Approval of the new equipment and related improvements will not
create conditions materially detrimental to the pi,blic health, safety and general
welfare. The equipment will be adequately screened, and is mounted on o
commercial roof structure which is inaccessible to the public.
3.. The proposed new equipment and improvementE; will minimize adverse visual
impacts as the proposed replacement antennas will be placed on an existing
rooftop and will be adequately screened from view a -id access.
4. The proposed equipment and improvements are designed to facilitate continued
function and augmentation of existing service capacities, without significantly
modifying pre-existing conditions to maintain the service provider's objectives for
coverage within this portion of the community.
5. The proposed new and replacement equipment and improvements are necessary to
improve community access to wireless services.

CONDITIONS
The applicant/property owner agrees to defend, indemnify, and hold harmless the
City of La Quinta (the "City"), its agents, officers and employees from any claim, or
litigation arising out of the City's approval of this project. This indemnification shall
include any award toward attorney's fees.
The City of La Quinta shall have the right to select its defense counsel in its sole
discretion. The City of La Quinta shall promptly notify the applicant of any claim,
action, or proceeding and shall cooperate fully in the defense.
2. The applicant shall comply with all provisions of La Quinta Municipal Code Section
9.170 "Wireless Telecommunication Facilities".
3. The applicant is permitted to install the equipment and related improvements, as
identified on the approved plans for MUP 2015-0003, as on file with the Community
Development Department and enclosed with this letter. The applicant shall obtain
all necessary building permits from the City's Building Division,'and is responsible for
meeting all applicable plan check submittal requirements.
4. The City may elect to add Conditions to this application request to mitigate any
problems that arise not previously addressed herein.
This decision may be appealed to the Planning Commission by any party who submits the
necessary paperwork and filing fee of $1,595.00 to this office within 15 days of the date of
approval of this permit.

were issued, both Fire and' Building are approved. Please note that this site only has 160 days for the,
,permit to be pulled since the city of San Jacinto counts the 180 days (6 months expiration start day)
from the day that it was submitted. This means that by July 28th we will need to have the permit in hand
if not earlier. PLEASE NOTE THAT YOU WILL NEED TO PULL THE FIRE PERMIT BEFORE THE BUILDING;
