South Coast Air Quality/Settlement Agree. 13SETTLEMENT AGREEMENT
BETWEEN SOUTH COAST AIR QUALITY MANAGEMENT DISTRICT
AND THE CITY OF LA QUINTA, CALIFORNIA
1. City of La Quinta shall pay to the District $6,000 by November 21,
2013.
2. City of La Quinta shall be released from any and all claims or penalties
arising from the incident(s) referred to in Notice of Violations ( "NOVs ")
P58046, P58047, P61158, and P61159.
3. The settlement shall be allocated as follows: $3,000 in full settlement
of the violations described in NOVs P58046 and P611 58 and $3,000 in
full settlement of" the violations described in NOVs P58047 and -
P61159.
4. The District reserves the right to rely upon the alleged violation and may
offer proof thereof in connection with any future administrative or
judicial proceeding.
5. If timely payment is not made, the District may seek to enforce this
Agreement or, alternatively, may declare the Agreement void and
proceed on the underlying violations by seeking the maximum penalties
authorized by the Health and Safety Code.
6. This is a settlement of civil penalties assessed pursuant to California
Health and Safety Code Sections 42402, et seq.
7. The Parties may execute and deliver this Agreement by transmitting an
authorized signature by fax or pdf, and copies of this Agreement signed
and delivered by means of faxed signatures or signatures in a pdf
document shall have the same effect as copies executed and delivered
with original signatures.
