PLANNING COMMISSION MINUTES 1 NOVEMBER 12, 2013 Chairperson Barrows noted for the record that staff had distributed a Memorandum to the Commission indicating that due to further collaboration with the applicant Condition of Approval No. 15 had been amended. Chairperson Barrows declared the PUBLIC HEARNG OPEN at 7:13 p.m. Mr. Jesus Uccles, Store Manager of Lowe's HIW, Inc., La Quinta, CA - introduced himself, explained the purpose and intent behind the proposal and the types of merchandise to be displayed, and answered the Commission's questions. Chairperson Barrows asked Mr. Uccles if he was in agreement with the amendment to Condition of Approval No. 15. Mr. Uccles replied he was. Permanent improvements shall be added to the trailer sales area in order to indicate to customers that the parking spaces utilized for trailer sales are not for customer parking. Improvements shall include, but are not limited to, painted stripes, permanent bollards, and additional landscaping for screening purposes within the existing landscape planter adjacent to the trailer sales area. Design specifications shall be reviewed and approved by the Community Development Director prior to trailers being located within the sales area. Motion passed unanimously. 2. Public Speaker: Mr. Steve Weiss, PGA West resident, La Quinta, CA - introduced himself, said the applicant has been extremely cooperative and responsive in addressing the residents' comments and concerned, and everyone was very pleased and excited to see this project being built. Public Speaker: Mr. Robert Thorn, CEO Partner of California West Communities, Carlsbad, CA - introduced himself as the project developer, thanked staff for their efforts in cooperation during the application review process, and answered the Commissions' questions. Chairperson Barrows declared the PUBLIC HEARNG OPEN at 8:00 p.m. Public Speaker: Mr. Hayward Pardue, Representative of the Applicant, La Quinta, CA - introduced himself and answered the Commissions' questions. Public Speaker: Mr. Roger Greenwald, Resident, La Quinta, CA - introduced himself and said he was not in favor of the project as he was concerned about possible light pollution and increased noise levels. He said the area is currently very quiet and suggested the proposed commercial center be built in other areas further to the west. He noted there were a lot of residents that were opposed to the proposed project and quoted Mr. Spock from Star Trek that "the needs of the many should outweigh the needs of the few." Public Speaker: Mr. Brett Pecano, Piazza Serena resident, La Quinta, CA - introduced himself and said even though, Commissioner Wilkinson recused himself, he found it unethical that Mr. Wilkinson was involved with the proposed project and at the same time served on the City's Planning Commission. He stated he never would have purchased a home within the area had he known that a gas station could be built in proximity to his residence in the future. He said the area has always been zoned residential and he was never made aware that it could be rezoned to commercial. Public Speaker: Mrs. Pixie Scott, Piazza Serena resident, La Quinta, CA - introduced herself, said her residence would be greatly impacted by the light pollution, noise levels, and increased traffic from the proposed future commercial center. She expressed a concern about possible increase in crime as well as the oil and gas from a gas station being mixed in with the dust and dirt, and that air would be carcinogenic. She noted the reasons she chose to purchase her home in Piazza Serena were mainly because of La Quinta's dark sky ordinance, the lack of street lights and the quietness of the area. Public Speaker: Mr. Curt Starweather, Piazza Serena resident, La Quinta, CA - introduced himself, said the proposed commercial center would have an adverse impact on the safety and serenity of the community and its property values due to the increase in traffic, noise levels, light pollution, and possible crime. He stated that the negative economic impact for the immediate community would be substantially greater than any possible benefit this project could offer. He PLANNING COMMISSION MINUTES 4 NOVEMBER 12, 2013 suggested the proposed project be located at either one of the two commercial sites, already zoned as such, located at the intersection of Avenue 58 and Madison Street. He requested that the Planning Commission deny the proposed project. Public Speaker: Mr. Justin Bert, Senior Vice President with Capstone Advisors, and representative of the owner of the 60 remaining undeveloped lots at Piazza Serena, Carlsbad, CA - introduced himself and said the proposed zoning and general plan designation were not compatible with the surrounding properties, as the area in question was surrounded by low density residential areas on all three sides. Mr. Bert noted that there has been no change in circumstance to warrant a zone change and a general plan amendment. He said during the recent General Plan Update there were no reasons identified to change the existing low density residential zoning for that property and there were plenty of already commercially zoned areas, approximately 70 acres, to the west that would be more appropriate for the proposed project. Chairperson Barrows noted for the record that a comment letter from Mr. Justin Bert, received on November 12, 2013, was distributed to the Commission. Public Speaker: Mr. Charles W. Clendening, Piazza Serena resident, La Quinta, CA - introduced himself as the President of the Board of Directors for the Piazza Serena community and said the entire community was in opposition of the proposed project. He said any commercial project in such proximity to a residential development would have an adverse economic impact on property values in an already troubled property market environment that is barely beginning to recover. He noted there already was a convenient store located on Monroe Street. He stated a possible commercial center would destroy the quietness and serenity of the residential community and would increase crime. Mr. Clandening said there was no need for a commercial project in the area and there was inadequate population to support it. He said that residents bordering Avenue 58 were not notified of the proposed zone change and requested that the Planning Commission deny the proposed project. Chairperson Barrows noted for the record that a comment letter from Mr. Clendening, received on November 12, 2013, was distributed to the Commission. Public Speaker: Mr. David V. Crouse, Piazza Serena resident, La Quinta, CA - introduced himself and said he retired to the Coachella Valley because he truly thought the City of La Quinta was the Gem of the Desert and he liked the quietness and serenity of the community. He expressed concerns regarding the potential increase in traffic and noise, and that the placement of a gas station PLANNING COMMISSION MINUTES 5 NOVEMBER 12, 2013 adjacent to an existing underground power line could be potentially hazardous. He stated that a commercial center at the proposed site was not warranted. Chairperson Barrows noted for the record that a comment letter from Mr. Crouse, received on November 12, 2013, was distributed to the Commission. Public Speaker: Mr. Joe Hammer, property owner and applicant, Indian Wells, CA - introduced himself, briefly described the history of the proposed site and the adjacent vacant land and their existing zoning designations. He said he was unaware the proposed project would be objected to. He noted he spent a lot of time speaking with homeowner from the Andalusia residential community and those residents expressed support for the project. Mr. Hammer explained the proposed commercial center would be very well architecturally designed and he would not build anything that would jeopardize the value of the 17.5 acres of vacant land to the south and additional 40 acres of vacant land to the east that his family has owned for many years. He stated the northeast and southeast corners on Avenue 58 and Madison Street, currently under the jurisdiction of the County of Riverside, would be developed as commercial centers in the future. He said the proposed commercial project would be beneficial to the surrounding community and encouraged the Commission to approve the zone change so he would have an opportunity to move forward with the project. Mr. Pardue noted there was a lot of interest from developers for a commercial project in the area. He said the zone change was only the first step of this process and the surrounding residents would have many more opportunities to give their input on the project should it go forward. Chairperson Barrows asked what community outreach was done for this project. Mr. Pardue said the major adjacent communities were contacted and made aware of the proposed project, including Trilogy and Andalusia. Public Speaker: Mrs. Silva Segrist, Piazza Serena resident, La Quinta, CA - introduced herself, said a future commercial development would not be beneficial to the existing residential community, but instead it would have an adverse impact on property values. She requested the Planning Commission deny the proposed zone change. Public Speaker: Mrs. Kim Hammer, property owner, Indian Wells, CA - introduced herself and said that for many years she resided behind a large commercial center and found it to be an asset and a convenience. She stated the proposed corner was a perfect location for a well thought out and aesthetically pleasing small commercial center and would very much benefit the community. PLANNING COMMISSION MINUTES 6 NOVEMBER 12, 2013 Public Speaker: Mrs. Pixie Scott, Piazza Serena resident, La Quinta, CA - reiterated her earlier statement that the surrounding residents were not in support of a commercial center in such close proximity to the existing residential community, and would like to keep the area dark, quiet, and serene as it currently exists. REQUEST: CONSIDERATION LANDSCAPING PLANS RANCH► PH 1 OF ARCHITECTURAL AND FOR TRACT 30834 (STONE CREEK LOCATION: NORTH SIDE OF AVENUE 58, ± 1 /2 MILE WEST OF MADISON STREET RECOMMENDED ACTION: Adopt Planning Commission Resolution 2013- approving Site Development Permit 2013-930, subject to the Findings and Conditions of Approval attached thereto. EXECUTIVE SUMMARY The construction of 70 homes is proposed in a previously -approved tract, where five homes currently exist (Attachment 1). The proposed architectural and landscaping plans conform to the development standards of the La Quinta General Plan and Municipal Code. Staff has worked with the applicant and existing homeowners within the tract to incorporate specific revisions that are agreeable to all parties. BACKGROUND Stone Creek Ranch (TR 30834) was approved in 2003. Architecture and landscaping plans were subsequently approved that same year, and again in 2005 for Toll Brothers after they purchased the tract from the original developer. The 29-acre tract consists of 76 single-family residential lots, five of which have existing homes built by the original developer (Attachment 2 and Attachment 3). One vacant residential lot is owned by an individual and is not a part of this request. Existing PGA West residential areas are located to the north and west of the project. P:\Reports - PC\2013\PC 11-26-13\PH 1_STONE CREEK SDP 2013-930\PH 1 (1 ) SCR PC REPORT -final draft.docx Page 1 of 4 PROPOSAL & ANALYSIS Architecture: Five floor plans are proposed, each having three different front elevation treatments referred to as Tuscan, Santa Barbara and Contemporary/Desert Contemporary architectural styles. The Contemporary and Desert Contemporary elevations differ only in that Desert Contemporary incorporates stone facade treatments. The floor plans range from approximately 2,779 square feet to 3,976 square feet. Architectural features vary based on style, but typically include shutters, decorative iron accents, and stone wall facades. Exterior materials consist of stucco walls, stone veneer accents, and various shades of concrete S-tile roofing. Exterior colors vary from light to medium earth tones, with darker trim colors. The proposed units provide less detail and architectural depth than the originally approved Stone Creek units as the five existing homes incorporate high quality design elements, such as mudded two-piece clay tile, exterior plaster finish, exposed rough - sawn roof beams, four-color split face cultured stone veneer, and decorative items such as carriage lantern fixtures, ornamental wrought iron, wooden window shutters and French doors. Based on staff and existing resident concerns with the level of architectural detail between certain models of the proposed units and the existing homes and improvements at Stone Creek Ranch, staff requested that Toll Brothers work with the residents to address the compatibility concerns, specifically related to two-story units and concerns with the Contemporary/Desert Contemporary architectural elevations. Staff requested Toll Brothers provide, in writing, evidence that the homeowners are in concurrence with their proposed plans. As a result, staff has received a letter from Toll Brothers which incorporates correspondence, signed by the homeowners, that sets forth their preferences regarding specific siting and building design parameters related to unit types that may be built (Attachment 4). These include items such as where additional two-story units and certain architectural styles may be sited, upgrades, and accents/finishes. To the extent they are appropriate and enforceable, these items have been incorporated with the recommended conditions of approval and agreed upon by the applicant. The Tuscan and Santa Barbara styles, and color/material schemes will blend with the existing units at Stone Creek as they are consistent in massing, size and basic appearance. The applicant made revisions to the Contemporary/Desert Contemporary style based on resident comments, which are acceptable to the residents and staff, and have been incorporated into the plan review set. The architectural styles and layout of the proposed units are well designed, compatible with the existing surrounding residential communities, and are generally consistent with the development standards in the La Quinta Municipal Code. Because there are five existing one-story units at Stone Creek Ranch, new two-story units will be restricted on lots that border these units. Conditions on Toll Brothers prior SDP approval have been incorporated into their preliminary siting plan (Attachment 5; Site Plan Sheet 1). All siting related conditions from the prior approval are being retained, along with additional siting conditions as a result of Toll Brothers' agreement with the existing homeowners. Landscaping: The project infrastructure, common area landscaping and other permanent improvements have all been completed and accepted by the City; the applicant only proposes landscaping plans for the individual unit front yards (Attachment 5; Sheets L-CS through LD-1). These plans incorporate a mix of Tipuana and California Pepper trees (24" box), and Fan Palms as their major elements. Shrubs and groundcover consist of a mix of several commonly used materials such as Lantanas, Red Yucca and Texas Ranger. Desert Gold decomposed granite is the primary inert cover. Two of the five plans allow for small sod areas as an accent. The proposed landscape plans are acceptable, with exception of the use of California Peppers. The ALRB and Planning Commission have previously expressed concern with this tree, as it is prone to wind damage and increased maintenance. Consequently, a condition has been recommended to replace the Pepper tree with an alternative tree type. Staff also recommends tree sizes be increased to 36' box, with a minimum caliper of 2.5", which is consistent with current requirements. Otherwise, the assorted species of plants are functional and low water users, as many are southwest desert species. The landscape palettes complement the architecture and layout of the residential units. COMMISSIONS/BOARD/COMMITTEE RECOMMENDATIONS: On November 6, 2013, the Architectural and Landscaping Review Board reviewed these plans and recommended approval of the site development permit as proposed and subject to the staff recommended conditions of approval (Attachment 4). The Committee discussed color scheme, enhanced walkway location, and suggested addition of windows in garages and pedestrian doors in stand-alone third car garages. However none of these items were incorporated into the recommended approval. AGENCY & PUBLIC REVIEW: Public Agency Review: This request was sent to all applicable City departments and affected public agencies on September 17, 2013. All written comments received are on file and available for review with the Community Development Department. All applicable comments have been adequately addressed and/or incorporated in the recommended Conditions of Approval. No changed circumstances or conditions are proposed which would trigger the preparation of subsequent environmental analysis pursuant to Public Resources Code Section 21166. WHEREAS, the Planning Commission of the City of La Quinta, California did, on the 261" day of November, 2013, hold a duly noticed Public Hearing to consider a request by Toll Brothers, Inc. for approval of architectural and landscaping plans for Tract 30834, generally located on the north side of Avenue 58, '/2 mile west of Madison Street, more particularly described as: LOTS 1 THROUGH 38, 40, 42 THROUGH 62, 64, AND 68 THROUGH 76 OF TR 30834 WHEREAS, the City Council of the City of La Quinta, California, after holding the required duly -noticed public hearing on the 51" day of November, 2002, did adopt Resolution 2002-148, certifying a Mitigated Negative Declaration and approving Tentative Tract Map 30834; and, WHEREAS, per requirements of the La Quinta Municipal Code, notice of the hearing was posted at three public places (Stater Brothers Market, La Quinta Post Office, and La Quinta City Hall) along with the project site, said notice also having been mailed to all property owners within 500 feet of the site; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did make the following mandatory findings pursuant to Section 9.210.010 of the Municipal Code to justify approval of said Site Development Permit: Consistency with the General Plan The proposed Site Development Permit is consistent with the La Quinta General Plan, as it proposes single-family residential homes within an existing partially -developed residential tract, which is General Plan -designated for Low Density Residential development. Consistency with the Zoning Code The proposed units, as conditioned, are consistent with the development standards of the Low Density Residential (RL) district in terms of architectural style, building height and mass, landscaping, setbacks and other development standards. The developer proposes single-family detached residential unit consistent with the existing site approvals. The site development permit as approved will ensure compliance with the zoning standards of the Low Density Residential zoning district, and other supplemental residential standards as established in Title 9 of the La Quinta Municipal Code. 3. Compliance with the California Environmental Quality Act (CEQA) The Community Development Department has determined that this request is an action to implement the development plan and overall project approval for Tentative Tract 30834, which was previously assessed in conjunction with Environmental Assessment 2002-457, prepared for Tentative Tract Map 30834 and which was certified in accordance with CEQA by the La Quinta City Council on November 5, 2002. No changed circumstances or conditions are proposed which would trigger the preparation of subsequent environmental analysis pursuant to Public Resources Code Section 21166. 4. Architectural Design The architecture and layout of the units are compatible with, and not detrimental to, the existing surrounding residential land uses, and is consistent with the development standards in the Municipal Code. The units were reviewed by the City's Architecture and Landscaping Review Board (ALRB) and found to be appropriate, in context with the five existing units within the tract, in terms of their architectural style and character, supplemental design elements (stone veneer accents, S-tile roofing, etc.) and compatible unit siting of one and two-story. 5. Landscape Design The proposed project is consistent with and implements the standards for landscaping and aesthetics established in the General Plan and Zoning Code. The proposed individual lot landscaping plans will unify and enhance visual continuity of the existing overall project landscaping for the community. The assorted species of plants are functional and low water users, as many are southwest desert species. The applicant shall comply with applicable provisions of the City's NPDES stormwater discharge permit, LQMC Sections 8.70.010 et seq. (Stormwater Management and Discharge Controls), and 13.24.170 (Clean Air/Clean Water); Riverside County Ordinance No. 457; the California Regional Water Quality Control Board — Colorado River Basin Region Board Order No. R7-201 3-0011 and the State Water Resources Control Board's Order No. 2009-0009-DWQ and Order No. 2010- 0014-DWQ. A. For construction activities including clearing, grading or excavation of land that disturbs one (1) acre or more of land, or that disturbs less than one (1) acre of land, but which is a part of a construction project that encompasses more than one (1) acre of land, the Permitee shall be required to submit a Storm Water Pollution Protection Plan ("SWPPP") to the State Water Resources Control Board. The applicant or design professional can obtain the California Stormwater Quality Association SWPPP template at www.cabmphandbooks.com for use in their SWPPP preparation. B. The applicant shall ensure that the required SWPPP is available for inspection at the project site at all times through and including acceptance of all improvements by the City. C. Approval of this Site Development Permit shall not be construed as approval for any horizontal dimensions implied by any site plans or exhibits unless specifically identified in the following conditions of approval. 9. Developer shall reimburse the City, within thirty (30) days of presentment of the invoice, all costs and actual attorney's fees incurred by the City Attorney to review, negotiate and/or modify any documents or instruments required by these conditions, if Developer requests that the City modify or revise any documents or instruments prepared initially by the City to effect these conditions. This obligation shall be paid in the time noted above without deduction or offset and Developer's failure to make such payment shall be a material breach of the Conditions of Approval. 10. Developer shall reimburse the City, within thirty (30) days of presentment of the invoice, all costs and actual consultant's fees incurred by the City for engineering and/or surveying consultants to review and/or modify any documents or instruments required by this project. This obligation shall be paid in the time noted above without deduction or offset and Developer's failure to make such payment shall be a material breach of the Conditions of Approval. Conferred rights shall include irrevocable offers to dedicate or grant access easements to the City for emergency services and for maintenance, construction and reconstruction of essential improvements. STREET AND TRAFFIC IMPROVEMENTS 12. Streets shall have vertical curbs or other approved curb configurations that will convey water without ponding, and provide lateral containment of dust and residue during street sweeping operations. Unused curb cuts on any lot shall be restored to standard curb height prior to final inspection of permanent building(s) on the lot. IMPROVEMENT PLANS As used throughout these Conditions of Approval, professional titles such as "engineer," "surveyor," and "architect," refer to persons currently certified or licensed to practice their respective professions in the State of California. 13. Improvement plans shall be prepared by or under the direct supervision of qualified engineers and/or architects, as appropriate, and shall comply with the provisions of LQMC Section 13.24.040 (Improvement Plans). 14. The following improvement plans shall be prepared and submitted for review and approval by the Public Works Department. A separate set of plans for each line item specified below shall be prepared. The plans shall utilize the minimum scale specified, unless otherwise authorized by the City Engineer in writing. Plans may be prepared at a larger scale if additional detail or plan clarity is desired. Note, the applicant may be required to prepare other improvement plans not listed here pursuant to improvements required by other agencies and utility purveyors. A. All Off -Site Plan & Profile Street Plans and Signing & Striping Plans shall show all existing improvements for a distance of at least 200-feet beyond the project limits, or a distance sufficient to show any required design transitions. All On -Site Signing & Striping Plans shall show, at a minimum; Stop Signs, Limit Lines and Legends, No Parking Signs, Raised Pavement Markers (including Blue RPMs at fire hydrants) and Street Name Signs per Public Works Standard Plans and/or as approved by the Engineering Department. On -Site Precise Grading Plans are required to be submitted for approval by the Building Official, Community Development Director and the City Engineer. On -Site Precise Grading Plans shall normally include all on -site surface improvements including but not limited to finish grades for curbs & gutters, pad elevations, building floor elevations, wall elevations, parking lot improvements and ADA requirements. 15. The applicant shall furnish a complete set of all approved improvement plans on a storage media acceptable to the City Engineer (currently mylars). 16. Upon completion of construction, and prior to final acceptance of the improvements by the City, the applicant shall furnish the City with reproducible record drawings of all improvement plans which were approved by the City. Each sheet shall be clearly marked "Record Drawing" and shall be stamped and signed by the engineer or surveyor certifying to the accuracy and completeness of the drawings. The applicant shall have all approved mylars previously submitted to the City, revised to reflect the as -built conditions. However, if subsequent approved revisions have been approved by the City Engineer and reflect said "Record Drawing" conditions, the Engineer Of Record may submit a letter attesting to said fact to the City Engineer in lieu of mylar submittal. GRADING 17. The applicant shall comply with the provisions of LQMC Section 13.24.050 (Grading Improvements). 18. Prior to occupancy of the project site for any construction, or other purposes, the applicant shall obtain a grading permit approved by the City Engineer. 19. To obtain an approved grading permit, the applicant shall submit and obtain approval of all of the following: A. A grading plan prepared by a civil engineer registered in the State of California, B. A preliminary geotechnical ("soils") report prepared by a professional registered in the State of California, C. A Fugitive Dust Control Plan prepared in accordance with LQMC Chapter 6.16, (Fugitive Dust Control), D. A Best Management Practices report prepared in accordance with LQMC Sections 8.70.010 and 13.24.170 (NPDES Stormwater Discharge Permit and Storm Management and Discharge Controls). E. A Final WQMP prepared by an authorized professional registered in the State of California. All grading shall conform with the recommendations contained in the Preliminary Soils Report, and shall be certified as being adequate by soils engineer, or engineering geologist registered in the State of California. The applicant shall furnish security, in a form acceptable to the City, and in an amount sufficient to guarantee compliance with the approved Fugitive Dust Control Plan provisions. Additionally, the applicant shall replenish said security if expended by the City of La Quinta to comply with the Plan as required by the City Engineer. 20. The applicant shall maintain all open graded, undeveloped land in order to prevent wind and/or water erosion of such land. Grading within the perimeter setback and parkway areas shall have undulating terrain and shall conform with the requirements of LQMC Section 9.60.240(F) except as otherwise modified by this condition. The maximum slope shall not exceed 3:1 anywhere in the landscape setback area, except for the backslope (i.e. the slope at the back of the landscape lot) which shall not exceed 2:1 if fully planted with ground cover. The maximum slope in the first six (6) feet adjacent to the curb shall not exceed 4:1 when the nearest edge of sidewalk is within six feet (6') of the curb, otherwise the maximum slope within the right of way shall not exceed 3:1 . All unpaved parkway areas adjacent to the curb shall be depressed one and one-half inches (1.5") in the first eighteen inches (18") behind the curb. 22. Building pad elevations of perimeter lots shall not differ by more than one foot higher from the building pads in adjacent developments. 23. The applicant shall minimize the differences in elevation between the adjoining properties and the lots within this development. 24. Prior to the issuance of a building permit for any building lot, the applicant shall provide a lot pad certification stamped and signed by a qualified engineer or surveyor with applicable compaction tests and over excavation documentation. Each pad certification shall list the pad elevation as shown on the approved grading plan, the actual pad elevation and the difference between the two, if any. Such pad certification shall also list the relative compaction of the pad soil. The data shall be organized by lot number, and listed cumulatively if submitted at different times. DRAINAGE 25. Stormwater handling shall conform to the approved hydrology and drainage report for Tract Map No. 30834. Nuisance water shall be disposed of in an approved manner. 26. The applicant shall comply with the provisions of LQMC Section 13.24.120 (Drainage), Retention Basin Design Criteria, Engineering Bulletin No. 06-16 — Hydrology Report with Preliminary Hydraulic Report Criteria for Storm Drain Systems and Engineering Bulletin No. 06-015 - Underground Retention Basin Design Requirements. More specifically, stormwater falling on site during the 100 year storm shall be retained within the development, unless otherwise approved by the City Engineer. The design storm shall be either the 1 hour, 3 hour, 6 hour or 24 hour event producing the greatest total run off. Nuisance water shall be disposed of per approved methods contained in Engineering Bulletin No. 06-16 — Hydrology Report with Preliminary Hydraulic Report Criteria for Storm Drain Systems and Engineering Bulletin No. 06-015 - Underground Retention Basin Design Requirements. 28. In design of retention facilities, the maximum percolation rate shall be two inches per hour. The percolation rate will be considered to be zero unless the applicant provides site specific data indicating otherwise and as approved by the City Engineer. 29. The project shall be designed to accommodate purging and blowoff water (through underground piping and/or retention facilities) from any on -site or adjacent well sites granted or dedicated to the local water utility authority as a requirement for development of this property. 30. No fence or wall shall be constructed around any retention basin unless approved by the Community Development Director and the City Engineer. 31. For on -site above ground common retention basins, retention depth shall be according to Engineering Bulletin No. 06-16 — Hydrology Report with Preliminary Hydraulic Report Criteria for Storm Drain Systems. Side slopes shall not exceed 3:1 and shall be planted with maintenance free ground cover. Additionally, retention basin widths shall be not less than 20 feet at the bottom of the basin. 32. Stormwater may not be retained in landscaped parkways or landscaped setback lots. Only incidental storm water (precipitation which directly falls onto the setback) will be permitted to be retained in the landscape setback areas. The perimeter setback and parkway areas in the street right-of-way shall be shaped with berms and mounds, pursuant to LQMC Section 9.100.040(B)(7). 33. The design of the development shall not cause any increase in flood boundaries and levels in any area outside the development. 34. The development shall be graded to permit storm flow in excess of retention capacity to flow out of the development through a designated overflow and into the historic drainage relief route. 35. Storm drainage historically received from adjoining property shall be received and retained or passed through into the historic downstream drainage relief route. 36. The applicant shall comply with applicable provisions for post construction runoff per the City's NPDES stormwater discharge permit, LQMC Sections 8.70.010 et seq. A. For post -construction urban runoff from New Development and Redevelopments Projects, the applicant shall implement requirements of the NPDES permit for the design, construction and perpetual operation and maintenance of BMPs per the approved Water Quality Management Plan (WQMP) for the project as required by the California Regional Water Quality Control Board - Colorado River Basin (CRWQCB-CRB) Region Board Order No. R7-2013-001 1. B. The applicant shall implement the WQMP Design Standards per (CRWQCB- CRB) Region Board Order No. R7-201 3-0011 utilizing BMPs approved by the City Engineer. A project specific WQMP shall be provided which incorporates Site Design and Treatment BMPs utilizing first flush infiltration as a preferred method of NPDES Permit Compliance for Whitewater River receiving water, as applicable. C. The developer shall execute and record a Stormwater Management/BMP Facilities Agreement that provides for the perpetual maintenance and operation of stormwater BMPs. 11T11 ITIFS 37. The applicant shall comply with the provisions of LQMC Section 13.24.110 (Utilities). 38. The applicant shall obtain the approval of the City Engineer for the location of all utility lines within any right-of-way, and all above -ground utility structures including, but not limited to, traffic signal cabinets, electric vaults, water valves, and telephone stands, to ensure optimum placement for practical and aesthetic purposes. 39. Existing overhead utility lines within, or adjacent to the proposed development, and all proposed utilities shall be installed underground. All existing utility lines attached to joint use 92 KV transmission power poles are exempt from the requirement to be placed underground. 40. Underground utilities shall be installed prior to overlying hardscape. For installation of utilities in existing improved streets, the applicant shall comply with trench restoration requirements maintained, or required by the City Engineer. The City will conduct final inspections of habitable buildings only when the buildings have improved street and (if required) sidewalk access to publicly -maintained streets. The improvements shall include required traffic control devices, pavement markings and street name signs. If on -site streets in residential developments are initially constructed with partial pavement thickness, the applicant shall complete the pavement prior to final inspections of the last ten percent of homes within the development or when directed by the City, whichever comes first LANDSCAPE AND IRRIGATION 42. The applicant shall comply with LQMC Sections 13.24.130 (Landscaping Setbacks) & 13.24.140 (Landscaping Plans). 43. Landscape and irrigation plans for landscaped lots and setbacks, medians, retention basins, and parks shall be signed and stamped by a licensed landscape architect. 44. Front yard landscaping for each dwelling shall consist of, at minimum, 36" box trees (i.e., a minimum 2.5 inch caliper measured three feet up from grade level after planting), 5-gallon shrubs, and groundcover. Permits issued under this approval shall be subject to the provisions of the Development Impact Fee and Transportation Uniform Mitigation Fee programs in effect at the time of issuance of building permit(s). 51. A fee of $50.00, payable to Riverside County, is due to this office within 24 hours of any City Council approval. This is required by the County to post the Notice of Exemption and offset costs associated with AB 3158 (Fish and Game Code 71 1 .4). For residential areas, approved standard fire hydrants, located at each intersection, with no portion of any lot frontage more than a maximum of 500 feet from a hydrant. November 25, 2013 City of La Quinta Planning Commission Re: November 26, 2013 meeting I would like to be able to briefly speak at this meeting as this project is directly adjacent to my house. I am very happy that the project will be completed. Hopefully it will eventually cut down on the dirt from the vacant lots that we have been enjoying for the last seven years. Plus I am just happy that La Quinta is growing again. We have no major reservations regarding this project. Most of the 76 lots would not affect us at all. But there are approximately 5 to 6 lots that will directly affect us. They run along Coral Mountain Court and those homes would look down into our back yard. Unless they are regraded, those lots have been substantially built up with dirt, effectively reducing the size of the privacy wall on the Stonecreek Ranch side. I would ask for some consideration regarding the setback of those homes, the location of windows for privacy, and the elevation. We had an agreement with the project manager on the original Stonecreek Ranch. We allowed them a fire gate with access through our property, so that they would not have to find a second exit somewhere else. We were told that regarding these few lots that directly abut our property that the homes would be one story and that when built our privacy would be considered. This was a verbal agreement. We are just asking for the same consideration at this time. EXECUTIVE SUMMARY In September 2013, the Community Development Department issued a holiday reminder letter to all major retail tenants referencing the permit process necessary to utilize cargo containers for temporary holiday storage. To date, only Wal-Mart has applied for a Conditional Use Permit (CUP) for this purpose, and proposes five (5) bins at the rear portion of the store site, southwest of the loading docks. BACKGROUND The La Quinta Wal-Mart has historically needed excess inventory storage capacity during peak sales periods and has requested temporary facilities for that purpose in the past. The last request was for a one-year CUP to allow four storage bins, which was granted on October 23, 2012 by Planning Commission. Wal-Mart has requested an approval term of 5 years for this CUP to mitigate the annual cost of filing fees (See Attachment 1 and 2 - Project Information Sheet and Site Photographs). CUP 201 3-1 54 Planning Commission Staff Report 11 /26/1 3 Page 1 of 3 PRPOSAL & ANALYSIS With exception of the number of containers requested, the application replicates CUP 2012-145, approved by Planning Commission on October 23, 2012, for four (4) containers. Each container is 8' feet wide, by 48' feet long, by 8.5' feet high (Attachment 3). The containers will be located within a paved area at the southwest corner of Wal-Mart's property and will be screened by a 9' foot high chain -linked fence with an attached 9' foot high green privacy screen. The five storage containers are located approximately 84 feet from the edge of the loading docks. The applicant has stated that the use of the containers will commence upon approval of the CUP and will be removed by January 15, 2014. Public view of the temporary storage containers is limited by the surrounding built environment and the height of the proposed screening. The property to the west is vacant, while trees and an existing 8' foot high block wall limits views from the adjacent Aventine Apartment complex to the south. The location of the containers complies with the sixty (60') foot building setback clearing area for type-V non -rated structures, as per the Building Code. Adequate space exists between the storage containers and the loading docks so as not to affect the traffic pattern or truck turnaround space in the general area. The Applicant has requested a 5 year approval term. The Municipal Code does not specify an expiration period for a CUP; however, the PC may impose a time limitation on establishment of the use, and/or may establish an expiration date on the use permit itself. Staff recommends an approval term to allow for two holiday periods, as the current CUP process for these types of temporary storage uses is under review. AGENCY & PUBLIC REVIEW: Public Agency Review: All comments and conditions from last year's request remain applicable, and have been incorporated in the recommended Conditions of Approval. Public Notice: Notice of the hearing was posted at three public places along with the project site, and notice was also mailed to all property owners within 500 feet of the site. To date, no comments have been received from adjacent property owners. Any written comments received will be provided at the Planning Commission hearing.
