PLANNING COMMISSION AGENDA 3 JANUARY 14, 2014 PLANNING COMMISSION MINUTES TUESDAY, NOVEMBER 26, 2013 CALL TO ORDER A regular meeting of the La Quinta Planning Commission was called to order at 7:01 p.m. by Chairperson Barrows. PRESENT: Commissioners Blum, Wilkinson, Vice Chair Wright, and Chairperson Barrows ABSENT: Commissioner Weber STAFF PRESENT: Planning Manager David Sawyer, Principal Planner Wally Nesbit, and Secretary Monika Radeva Chairperson Barrows led the Commission in the Pledge of Allegiance. PUBLIC COMMENT - None CONFIRMATION OF AGENDA - Confirmed APPROVAL OF MINUTES Motion - A motion was made and seconded by Commissioners Blum/Wright to approve the Planning Commission Minutes of November 12, 2013, as submitted. AYES: Commissioners Blum, Wilkinson, Vice Chair Wright, and Chairperson Barrows. NOES: None. ABSENT: Commissioner Weber. ABSTAIN: None. PUBLIC HEARINGS 1. Site Development Permit 2013-930, as previously reviewed under Environmental Assessment 2002-457, submitted by Toll Brothers Inc., proposing the construction of 70 single family dwellings within Stone Creek Ranch, a 29-acre tract with 76 single-family residential lots and five existing homes. Location: north side of Avenue 58, ± 1 /2 mile west of Madison Street. Principal Planner Wally Nesbit presented the staff report, a copy of which is on file in the Community Development Department. PLANNING COMMISSION MINUTES 1 NOVEMBER 26, 2013 Chairperson Barrows noted for the record that staff had distributed a Memorandum to the Commission with e-mail correspondence from Ms. Janiffer Baumann, a Stone Creek Ranch resident, La Quinta, CA. General discussion followed regarding the one and two-story proposed plans and their locations within the development. Chairperson Barrows declared the PUBLIC HEARNG OPEN at 7:15 p.m. Mr. Allen Janisch, Senior Project Manager with Toll Brothers Inc., Rancho Mirage, CA - introduced himself, gave a brief description of the proposed development, and answered the Commission's questions. Public Speaker: Mrs. Janiffer Baumann, Stone Creek Ranch resident, La Quinta, CA - introduced herself, spoke favorably of the project, but expressed concerns regarding the five or six proposed two-story homes facing her back yard. She requested the Commission reconsider the setbacks of the proposed homes, the location of windows for privacy, the elevations, and possibly reducing the two- story to single story homes to avoid the loss of privacy. Public Speaker: Ms. Jenny Hwang, owner of Lot No. 41 within the Stone Creek Ranch development, Henderson, CA - introduced herself, spoke favorably of the project, and asked what conditions and approval processes she would be subject to if she were to build out her lot. Staff explained the established approval processes in general and encouraged Ms. Hwang to contact the City and schedule an appointment during which staff could address her questions and concerns in more detail and explain what would be required for her particular property. Mr. Janisch directed the Commission to the submitted Site Development Booklet and the proposed two-story floor plans indicating that the two-story component was very limited in space, consisting only of a bedroom and a bathroom, and located to the front, over a portion of the home, therefore substantially reducing the potential for loss of privacy to the adjacent properties. Chairperson Barrows declared the PUBLIC HEARING CLOSED at 7:43 p.m. Motion - A motion was made and seconded by Commissioners Wright/Wilkinson to adopt Resolution 2013-028 approving of Site Development Permit 2013-930, as submitted with staff's recommendations and amending Condition of Approval No. 61 to read as follow: PLANNING COMMISSION MINUTES 2 NOVEMBER 26, 2013 61. Two story units shall not be permitted on Lots 4 -18, 22, 23, 36-38, 40, 61, 62, 64 and 68. AYES: Commissioners Blum, Wilkinson, and Vice Chair Wright. NOES: Chairperson Barrows. Conditional Use Permit 2013-154 and a determination of exemption from the California Environmental Quality Act pursuant to CEQA Guideline 15304.4(e), submitted by Tait & Associates, Inc. proposing to allow the temporary placement and use of five temporary metal storage containers during the 2013 Holiday season for the La Quinta Wal-Mart store. Location: The Centre at La Quinta commercial center, south of Highway 111 between La Quinta Centre Drive and Dune Palms Road, 79295 Highway 1 1 1 . Principal Planner Wally Nesbit presented the staff report, a copy of which is on file in the Community Development Department. Chairperson Barrows declared the PUBLIC HEARNG OPEN at 8:00 p.m. Mr. Greg Fick, Project Manager with Tait and Associates, Inc., Santa Ana, CA - introduced himself, asked the Commission to consider amending Condition of Approval No. 2 to allow for the temporary storage containers to be placed on October 15 instead of the 31, as the store was expecting to receive deliveries before October 31, 2013. He said the site was adequately lighted and there was 24 hour security on site, further there was a locked chain link fence around the storage containers. Mr. Fick answered the Commissions' questions. Chairperson Barrows declared the PUBLIC HEARING CLOSED at 8:02 p.m. Motion - A motion was made and seconded by Commissioners Wright/Blum to adopt Resolution 2013-029 approving Conditional Use Permit 2013-154 as submitted with staff's recommendations and amending Condition of Approval No. 2 to read as follows: 2. This Conditional Use Permit allows a total of five (5) temporary metal storage containers to be located at the southwest corner of the property at 79295 Highway 111, to be used for the storage of holiday merchandise for the following periods of time • November 27, 2013 through January 15, 2014 • October 15, 2014 through January 15, 2015 Conditional Use Permit 2013-154 shall expire on January 16, 2015. PROPERTY OWNER: POINTE LARSEN, LLC. REQUEST: REPORT OF FINDING UNDER CALIFORNIA GOVERNMENT CODE SECTION 65402, THAT THE PROPOSED PUBLIC UTLITY EASEMENT VACATION OF AN 85,072 SQ. FT. PORTION OF A 60 FOOT WIDE STRIP EAST OF PGA BOULEVARD IS CONSISTENT WITH THE GENERAL PLAN. LOCATION: AN 85,072 SQ. FT. PORTION OF A 60 FOOT WIDE STRIP EAST OF PGA BOULEVARD RECOMMENDED ACTION: Adopt Planning Commission Resolution No. 2014- finding that Public Utility Easement Vacation is consistent with the La Quinta General Plan. EXECUTIVE SUMMARY: A 60 foot wide public utility easement (PUE) currently runs through the PGA West "Signature" Project. The developer has requested that this PUE be vacated so that homes can be built. No utilities exist within the PUE and no utility agencies have objected to the PUE vacation request. BACKGROUND Pursuant to California Government Code Section 65402, the "Planning Agency" (City of La Quinta Planning Commission) shall make a finding that the proposed vacation is consistent with the City's General Plan and Circulation Element for any public easement being vacated by the City Council. The PUE was dedicated per corporation grant deed recorded April 19, 1985. The portion of PUE in question is shown in Attachments 1 and 2. This portion of right Page 1 of 2 of way is not needed by other property owners for access or improved accessibility. PROPOSAL & ANALYSIS: All utility agencies have been notified of this request. No utility agencies have identified facilities within the easement. All utility agencies have written letters to the City and none of them have objected to the PUE vacation. The City staff will recommend vacating this portion of the PUE as it is no longer needed by the utility agencies nor for public right of way. AGENCY & PUBLIC REVIEW: Public Agency Review: This request was sent to all applicable City departments and affected public agencies. All written comments received are on file and available for review with the Public Works Department. Public Notice: This project was advertised in The Desert Sun newspaper on January 3, 2014, and mailed to all property owners within 500 feet of the site. To date, no comments have been received from adjacent property owners. Any written comments received will be handed out at the Planning Commission hearing. ENVIRONMENTAL REVIEW The proposed vacation is exempt under Section 15060 of the California Environmental Quality Act (CEQA) in that vacation of the subject easement will not result in a direct or reasonably foreseeable indirect physical change in the environment. WHEREAS, State Government Code Section 65402 requires that prior to streets being vacated by the City Council, the Planning Commission make a finding that the proposed right-of-way vacation is consistent with the City's General Plan; and, WHEREAS, said Planning Commission did make the following Mandatory Finding confirming that the proposed public utility easement vacation is consistent with the City's General Plan: 1. The proposed right-of-way vacation will have no environmental effects that adversely impact the human population, either directly or indirectly, because the segment is currently unused by the public and inaccessible to vehicles; and secondly, the act of vacating the right-of-way will have no physical environmental effect. 2. The right-of-way vacation will not impact public utility agencies, provided easements are retained for the continued maintenance and operation of existing public utilities. 3. EXECUTIVE SUMMARY: The developer recorded Final Parcel Map 29052 in 1999 and entered into subdivision improvement agreements for the construction of on and off -site infrastructure. The time extensions for the agreements have lapsed and the developer is not ready to move forward with the full development of the project. The developer has requested that the parcel map be reverted to acreage such that the infrastructure construction obligations will be nullified. BACKGROUND On August 24, 1999, the developer entered into subdivision improvement agreements which expired on September 20, 2012. The developer had planned the property for a major supermarket anchored retail shopping center. The major supermarket has abandoned these plans in their entirety and sold that parcel back to the original developer. No replacement project has been determined. The developer is not in a position to construct the on and off site infrastructure that is an obligation of his final map, nor to pay the bond premiums associated with these obligations and therefore requests a reversion to acreage at this time. Staff recommends that the dedications of right of way for Jefferson Street and Avenue 50 be accepted by the City with the final map. The construction of all public and private improvements will be conditioned with the future map. AGENCY & PUBLIC REVIEW: Public Agency Review: This request was sent to all applicable City departments and affected public agencies. All applicable comments have been incorporated in the recommended Conditions of Approval. WHEREAS, The Planning Commission of the City of La Quinta, California, did on the 141" day of January, 2014, hold a duly noticed Public Hearing to consider the request of BLP Desert, LP, a Reversion to Acreage to consolidate the land within Parcel Map 29052 by means of Tentative Tract 36058-R, generally located at the northwest corner of Jefferson Street and Avenue 50, more particularly described as: PARCEL MAP 29052 WHEREAS, said Reversion to Acreage has complied with the requirements of the "Rules to Implement the California Environmental Quality Act of 1970" as amended (Resolution 83-63), in that the Community Development Department has determined that the proposed Reversion to Acreage is exempt from CEQA review under Guidelines Section 15305 (Minor Alterations in Land Use Limitations); and, WHEREAS, the Community Development Department published the public hearing notice in the Desert Sun newspaper on the 3rd day of January, 2014, as prescribed by the Municipal Code. Public hearing notices were also mailed to all property owners within 500 feet of the site; and WHEREAS, at said public hearing, upon hearing and considering the staff report, staff presentation, all project exhibits, and testimony and arguments, if any, of all interested persons wanting to be heard, said Planning Commission did make the following mandatory findings recommending approval of said Reversion to Acreage: Finding A — All owners of an interest in the real property within the subdivision have consented to reversion. The property owner, BLP Desert, LP and BL2, LP are the sole owners of the real property in question and has requested this reversion to acreage. Finding C - No lots shown on the final or parcel map have been sold within five years from the date such map was filed for record. None of the properties identified on Parcel Map 29052 have been sold or transferred to another property owner since the recordation of the map. BLP Desert, LP and BL2, LP are the sole owners of the property and have been since the recordation of Parcel Map 290525. 4. Finding D - The dedications or offers of dedication to be vacated or abandoned by the reversion to acreage are unnecessary for present or prospective public purposes. The property owner has offered to dedicate right-of-way for public street and public utility purposes along Jefferson Street and Avenue 50. The applicant shall offer for dedication on the Final Map all public street rights -of - way in conformance with the City's General Plan, Municipal Code, applicable specific plans, and/or as required by the City Engineer. 7. The public street right-of-way offers for dedication required for this development include: A. PUBLIC STREETS 1) Jefferson Street (Major Arterial) — Sufficient dedication is required for the standard 60 foot half width (60 feet from the centerline of Jefferson Street for a total 120-foot ultimate developed right of way). FINAL PARCEL MAP 1 1 . Prior to the City's approval of a Final Map, the applicant shall furnish accurate mylars of the Final Map that were approved by the City's map checker on a storage media acceptable to the City Engineer. IMPROVEMENT PLANS As used throughout these Conditions of Approval, professional titles such as "engineer," "surveyor," and "architect," refers to persons currently certified or licensed to practice their respective professions in the State of California. 12. Improvement plans shall be prepared by or under the direct supervision of qualified engineers and/or architects, as appropriate, and shall comply with the provisions of Section 13.24.040 (Improvement Plans), LQMC. 13. The following improvement plans shall be prepared and submitted for review and approval by the Public Works Department. A separate set of plans for each line item specified below shall be prepared. The plans shall utilize the minimum scale specified, unless otherwise authorized by the City Engineer in writing. Prior to the granting of any permits for mass grading, the applicant shall furnish full security entered into by and between the applicant and the City of La Quinta, for the purpose of guaranteeing the completion of any improvements related to this Reversion to Acreage and associated Tentative Parcel Map to comply with the provisions of Chapter 13.28 (Improvement Security), LQMC. 17. Improvements to be made, or agreed to be made, shall include the removal of any existing structures or other obstructions which are not a part of the proposed improvements. In the event the applicant fails to construct the improvements for the development, or fails to satisfy its obligations for the development in a timely manner, pursuant to the approved phasing plan, the City shall have the right to halt issuance of all permits, and/or final inspections, withhold other approvals related to the development of the project, or call upon the surety to complete the improvements. At the time the applicant submits its detailed construction cost estimates for conditional approval of the Final Map by the City Council, the applicant shall also submit one copy each of an 8-1 /2" x 11 " reduction of each page of the Final Map, along with a copy of an 8-1 /2" x 11 " Vicinity Map. Estimates for improvements under the jurisdiction of other agencies shall be approved by those agencies and submitted to the City along with the applicant's detailed cost estimates. EXECUTIVE SUMMARY: Hobby Lobby is proposing permanent business identification signs (Attachment 1). Staff recommends a reduction in size to the proposed primary sign in order to maintain consistency with previously -approved signs for major retail tenants along Highway 111. As conditioned, the proposed signage complies with the development requirements of the One Eleven La Quinta Sign Program. BACKGROUND In August 2013, the Planning Commission approved plans for Hobby Lobby, a commercial retail building located within the One Eleven La Quinta commercial center (Attachment 2). The center's Planned Sign Program requires "Major Tenants" to obtain Planning Commission approval of their business identification signs. With a total floor area of 55,445 square feet, Hobby Lobby is considered a major tenant. PROPOSAL & ANALYSIS: The applicant has applied for a total of five signs (Attachment 3). "Hobby Lobby" is the primary business identification sign, with "Crafts", "Seasonal", "Floral", and "Home Accents" as four secondary signs. The design and layout of the proposed signs are consistent with the signs approved and installed at Hobby Lobby stores nationwide. The proposed sign consists of individual internally -illuminated channel letters (Attachment 3, Page 4). At its highest and widest dimensions, the sign is proposed to be approximately 4'-9" in height and 48'- 9" wide, totaling approximately 223 square feet. The sign faces are Orange, with semi -gloss black returns. The four secondary signs are proposed to be placed on the southern building elevation adjacent to the primary sign. The proposed signs consist of individual non -illuminated channel letters (Attachment 3, Page 5). The total square footage of the proposed secondary signage is approximately 103 square feet. The total square footage of the five signs is approximately 326 square feet. Major retail tenants along Highway 111 have historically applied for large business identification signs, and have traditionally deviated from the Municipal Code maximum of 50 square feet. Approvals were granted based on sign size, location, proportionality to the building, as well as compliance with any applicable sign program. This discrepancy can be alleviated by reducing the size of the main business identification sign from 223 to 180 square feet, which would be appropriate for this location, as it could remain proportionate to the building elevation, and is complementary in size to other signs and frontages of other major retail tenants along Highway 111 . Staff also concludes that the sizes of the secondary signs are appropriate for the subject locations as they are proportionate to the building elevation. Furthermore, other major retail tenants, most recently Walmart, have had secondary signage approved with similar purposes. Walmart's secondary signage totals approximately 200 square feet, which is comparable given the building size (200,000 square feet) and frontage (577 feet) of the building. ENVIRONMENTAL REVIEW The Community Development Department has determined that this project is categorically exempt from environmental review pursuant to Section 15311 (Accessory Structures) of the California Environmental Quality Act as it consists of the construction of on -premise signs. The total square footage for the main business identification signs shall be no greater than 180 square feet. The total square footage for the four supplementary signs shall be no greater than 103 square feet. The applicant shall install the approved signs on the southern building elevation at the approved locations. 2. Final plans shall be reviewed by the Community Development Department prior to obtaining a building permit. 3. A building permit shall be obtained prior to any work on the sign being started.
