Dear Ron,
On behalf of the Watercolors Board of Directors of the Watercolors Homeowners Association (HOA) and
the Architectural Review Committee, we have reconsidered your request for installing an air conditioning
unit on the exterior of your home.
Our approval is based upon the fact that the unit will be placed in an area that is between two garages and
thus the noise heard by neighbors should be minimized, however this approval, and the continued
existence of the air conditioner to be installed, is conditioned on the fact that if any neighbor has a
problem with the noise created by the unit, the unit will have to be removed. Additionally we will require
that you screen the condensing unit from view by providing plantings, and any required irrigation, in and
around the area containing the gas meter and electrical transformer.
The HOA has approved your request to install an additional air conditioning unit with the following
conditions and requirements you must comply to:
1. Install concrete or fiberglass pad under unit.
2. Grade area so that the unit does not interfere with the normal drainage.
3. Install plants with irrigation, shielding the condensing unit from being seen from the
courtyard/driveway side (west side).
4. You agree to execute a document releasing the Home Owners Association from any and
all liability with respect to 1) the installation or continued operation and/or maintenance
of the unit to be installed and 2) any and all liability with respect to water flow and
drainage around the to be installed unit. The HOA will have no responsibility of any
kind with the installation or maintenance of the unit and will not be responsible for any
damage from water, theft, or vandalism., or any other causes.
5. The unit will be removed within 30 days of any written notice provided to the HOA from
a homeowner complaining that the unit creates too much noise and is negatively
impacting the quiet enjoyment of their home.
