In October; . Natural Energy tried to apply for a permit to for the installation of a solar energy system at the residence of Judy Rowley, 79886 Dandelion Drive, La Quinta, CA 92253. Your counter person told my client that he would not even accept the application for the permit because the city will not permit installation of "any equipment on a sloped roof" Natural Energy has since been unsuccessful at getting any resolution with the building department. As you may know, city codes that unreasonably restrict installation of solar energy systems are invalid. Government Code § 65850.5 and California Health & Safety Code § 17959.1 were amended this year to make that point clear: "The implementation of consistent statewide standards to achieve the timely and cost-effective installation of solar energy systems is not a municipal affair, as that term is used in Section 5 of Article XI of the California Constitution, but is instead a matter of statewide concern." Government Code § 65850.5. That section further provides: (a) .... It is the intent of the Legislature that local agencies not adop ordinances that create unreasonable barriers to the installation of solar enerQy system s, including, but not limited to, design review for aesthetic purposes, and not unreasonably restrict the ability of homeowners and agricultural and business City of La Quinta December 8, 2004 Page 2 concerns to install solar energy systems. It is the policy of the state to promote and encourage the use of solar energy systems and to limit obstacles to their use. (b) A city or county shall administratively approve applications to install solar energy systems through the issuance of a building permit or similar nondiscretionary permit... . (c) A city or county may not deny an application for a use permit to install a solar energy system unless it makes written fmdings based upon substantial evidence in the record that the proposed installation would have a specific, adverse impact upon the public health or safety, and there is no feasible method to satisfactorily mitigate or avoid the specific, adverse impact. The findings shall include the basis for the rejection of potential feasible alternatives of preventing the adverse impact. Your refusal to issue accept an application for a permit because you do not allow solar systems on the roof is an unreasonable barrier under the statute and in direct contravention to the policy of the state to promote and encourage the use of solar energy systems and to limit obstacles to their use. The method by which your counter people are denying applications is also in violation of the code. If you disagree with the application of the foregoing statutes, please let us know.
