ART LOPEZ Sunair Pool o �g� P. b Pa& Q,CYA c'19 9aa Dear Mr. Lopez, RE: 45-395 Desert Air Street, La Quinta, CA 92253 This letter is regarding the swimming pool that you had constructed in my back yard. To this date, you have yet to come by to pick up the report of the final inspection by the City of La Quinta. There are certain items in the report that need: your attention .and that need correction prior to obtaining a passing mark for;the final, inspection.. ; Also; the decking of the -entire pool and.spa needs to be re -donee. I have.waited, based on your recommendation that -2 weeks is needed for the cement to cure, a total of 6 weeks but the texture of the decking is far from satisfactory. Friends, neighbors and including my daughter had suffered scrapes from the rough texture of the decking. I do not understand the logic behind your insistence to pour one-half of the decking first and the other half of the decking was poured about three weeks later. I am requiring that a new decking be done for the entire length of the pool and spa. I am allowing you ten (10) working days from the date of receipt of this letter to start and complete the restoration on the decking of the pool and spa. I will also require you,to reimburse me for the grass, flowers and landscaping that will be damaged when you come to perform your duties as a contractor for swimming pools. Also, you'have yet to come and instruct me on the proper cleaning of the filtration system. In the.event of a breakdown due to improper handling resulting from improper or no instructions provided, you will be held responsible for the replacement of an equal or better filtration system. There.was not,even-a start-up service or instructions in the initial proper care of my,brand new swimming pool and spa. Furthermore, .the stucco. repair. on the retaining wall between my residence and neighbor .was .!poorly � done. The color does not match the stucco on either houses and -needs ;to be, re -done. In the event that you still fail to redeem yourself, I will be forced to seek second and third opinions on the manner in which the problem(s) could be rectified. I will have different pool contractors present me with bids to properly restore my entire pool and spa and landscaping contractors to restore my yard and you will be responsible for the charges incurred.
