Thank you for giving me the opportunity.to be of service to.you,to-
inspect your house for a possible earthquake damage. I walked!
around the whole house and noticed some small cracks in the.
exterior stucco and in the front garage slab. According to my
judgement, these are not of any structural related cracks, but•-
possibly due to temperature and shrinkage stresses in the concrete..
I noticed a large crack in front, on the right side parapet, I
should feel concern. This crack may be in the stucco only or may be
due to structural failure of any.kind. If possible I would like to
look at the as built structural detail plans for the parapet, then: `
I maybe able to give my professional opinion. Please arrange for,
these plan and bring them to our office.

Dear Mr. MacGuigan:

It has taken me this long to overcome my sense of outrage upon
reading your letter of June second past.
In answer to your false allegations:
There were never any eighteen visits to my home within the past
twelve-week.peri.od. My neighbors who are home during the day
can and will attest to this.
Also, there never were any scheduled repairs for which I was not
home. On the -,ontrary, every appointment I made with your trouble-
shooter, Mike, was ever kept. Not by Mike! Not by anybody on
,your staff! And again, no calls, no messages. My neighbors will
attest to this also.
While John Castro was installing a new supporting post, he was
appalled to learn that the masking of cracks that was started in
my living room and master bedroom is still not completed. Two
months have passed! I am still living with exposed, unpainted
tapings in both these areas.
Mr. Castro will also attest that my home is defaced by blotches
and "stripes" appl1ed in unmatched paint' by ,your workmen.
The following are still to be completed in order to fulfill war-
ranty requirements:
Completion of all needed masking needed in living room and bedroom.
Filling in of the four inch hole over the front portico.
Repairing of the large holes in Mexican pavers in bathroom and the
kitchen.

According to Mr. Lonny Day of the La Quinta Building and. Safety
Department, the fence between my house and Mr. Dennis Klenenow•s
is constructed incorrectly. He will be issuing a completion order.
Although in a joint discussion with you it was agreed that the
cracks in the concrete in the front walkway -and driveway were to
be repaired, to date it is still not d.one.
Staining of the new support post to match color of existing post.
No, Mr. MacGuigan, all warranty work is not completed by your
Synercon Development Corporation. And my warranty is in effect.
until September 10, 1993-
I would appreciate your advising me by phone or mail, no later
than a week from today,. when all the required work is to be com-
pleted.

Dear Mr. Kanow:
This letter is being copied to the La Quinta Building Department so all parties henceforth are
aware of the current circumstances.
According to our logs, you have called us over two dozen times to complain about items in your
house. We have made 18 visits to your home in the last 12 weeks. For whatever reason, you
have refused us entry on scheduled repair calls on 13 of those visits. For most of those refusals
of entry, it was apparent that you were home but would not come to the door. We have now
completed all warranty work on your home to the full agreement of Synercon Development
Corporation's management. Even the pilar pole supporting your patio has been replaced, although
it only bore a superficial drying crack.
Your complaints have an obsessive quality that belie some deeper problems. We are not
psychiatrists: We are a construction company, and our work is finished. We have treated you
with respect and completed to the best of our efforts a quality home for you to enjoy.
If you want any further changes completed for your home, please consult your yellow pages.
