Box 1504 78-495 CALLE TAMPICO LA QUINTA, CALIFORNIA 92253 January 11, 2005 BUILDING & SAFETY DEPARTMENT Special Inspection Report RE: 54-640 Avenida Diaz, Permit #06-0085 (760)777-7012 FAX (760) 777-7011 APN: 774-217-007 On January 11, 2005 at approximately 3:00 PM the following field observations were noted while accompanying Code Compliance Officer Jackie Misuraca investigating an un -permitted garage conversion. The garage was converted into two (2) living spaces including a kitchen, bath and utility closet. I met with Mr. Enrique Guzman with his son present to interpret when necessary to assess the existing conditions and facilitate assisting Mr. Guzman in complying with minimum garage interior dimensions. Additionally, an un -permitted covered patio was assessed in the back yard. Per the City of La Quinta Municipal Code Section 9.150.060 the garage conversion is not permitted. Mr. Guzman shall be required to demolish the interior wall construction to obtain a minimum 20' x 20' garage interior. Mr. Guzman shall be required to submit a demolition permit application (CBC 106.1 Permits Required) with plans demonstrating; 1) existing conversion conditions and 2) a garage plan demonstrating minimum parking compliance. (CBC 106.3.3 Information on plans and specifications) The garage plan shall include firewall & fire door notation, electrical, mechanical and plumbing information as applicable to the structure. The plan will facilitate a clear understanding between Mr. Guzman and the City for the scope of work required to obtain final compliance. approval. Per the 2001 California Building Code, Section 106. 1, the covered patio is not exempt of requiring a building permit. The owner was advised to submit an application, plans and specifications to scale with sufficient clarity to indicate the location, nature and extent of the work proposed to the City Building Department for review and approval to acquire a patio permit. Mr. Guzman was informed of a City of La Quinta patio structure handout that may facilitate his application with the knowledge that the as -built structure may not comply with the City's prescriptive patio requirements requiring Mr. Guzman to hire the services of an architect or engineer. An option available to Mr. Guzman is to include the covered patio demolition scope of work to his garage demolition permit for compliance. In summary, Building Permit's are required for the demolition of the garage conversion to obtain minimum 20' x 20' clear net interior garage compliance and the covered patio construction. After the submittal of plans, comprehensive review and approval of these projects the owner should be aware that work for which a permit is required shall be subject to inspection and shall remain accessible and exposed for inspection until approved.
