Nesbit, Planning Assistant DATE: November 24, 1986 SUBJECT: PRECISE -PLAN ORDINANCE; INTERPRETATION OF FIVE (5) APPROVAL LIMIT On November 19, 1986, the above subject was briefly discussed at our Staff meeting on project status. It was determined that the intent of the limit on approvals was not -aimed at specific developers, but to insure that landowners do*not develop more property than the market can absorb, thereby creating a "glut" of new, vacant units. The approval limit should, therefore, be tied to ownership of the property as submitted, with the developer and property owner listed in the log book. In this manner, we can maintain status of a property owner relative to the number of approvals (5) and the developer in requiring them to submit master design guidelines (20). Pine Creek's previous approvals under the SR Zoning were in the name of James Laier (3), and he would be limited to the number of approvals as specified in the ordinance. Pine Creek has developed or applied for eight (8) approvals under the ordinance; they would be governed under the master guideline requirement (20 approvals). Although there seems to be ways of circumventing these requirements, this interpretation is in conformance with the intent of the ordinance requirements on approval limitations, in my opinion. It may be appropriate to take this matter before the Planning Commission in order to obtain specific policy direction. In the meantime, should we proceed with approvals based on the above interpretations or hold pending a possible Planning Commission policy?
