On the basis of this initial evaluation;
I find the proposed project COULD NOT have. a significant
effect on the environment, and a NEGATIVE DECLARATION will
be prepared.
I find that although the proposed project could have a
significant effect on the environment, there will not be
a significant effect in this case because the mitigation
measures described on an attached sheet have been added
to the project. A NEGATIVE DECLARATION WILL BE PREPARED.
I find the proposed project MAY have a significant effect
on the environment, and an ENVIRONMENTAL IMPACT REPORT is
required.

DISCUSSION OF RESPONSES
1. EARTH
b. Disruption and compaction of the soil will occur
due to establishment of structures and the change
in vacant to developed land. These changes will be
regulated through adherence to compaction and other
requirements of the Building Division and /or the
Public Works Department.
e. There may be some incremental increase in
water - related erosion during the interim site
development period. Adherence to requirements of
the City Engineer during grading plan review and
implementation will adequately address this minor
incremental increase.
g. The site is in Groundshaking Zone III (R.C.G.P.,
Seismic Hazards Section), and is a normal -low risk
land use. The use is generally suitable in
alluvial soils with low liquefaction potential.
Adherence to seismic code requirements will insure
that no significant seismic impacts are encountered
due to seismic activity. No significant geologic
conditions exist in this area.
2. AIR
a. There is some potential for relatively substantial
air emissions due to blowing dust during
construction and increased vehicular traffic. The
VSP incorporates mitigation features including
improved circulation and public transportation
facilities. Energy efficient building design is
also encouraged. The MEA /EIR and Redevelopment
Project No. 1 EIR include recommended coordination
with regional air quality plans and programs.
These measures were identified in the environmental
assessment prepared for the VSP by Smith, Peroni
and Fox. Due to the scale of this project,
mitigation of the incremental air quality impact it
will create will be via compliance with large -scale
mitigation required of larger projects, as
identified in the above - referenced documents, from
which this project will benefit.
Applicant /Developer shall comply with approved dust
control techniques as part of grading plan approval.

3. WATER
b. Absorption and runoff rates will change
incrementally, as permeable area is converted to
non - pervious area. These changes involve a 1.57
acre site, part of a larger overall development
plan which has incorporated drainage and storm
water conveyance systems into its design.
6. NOISE
a. Existing noise levels will increase due to
construction activities (short -term impact). The
Applicant /Developer shall comply with the
prescribed work hours permitted by City ordinance.
b. Potential prolonged noise exposure may be from
entertainment and other outdoor activities. The
C -V -S zone allows limitations on operation of
certain uses with entertainment. A condition will
be proposed which will regulate hours of operation
and amplification of entertainment types, if
proposed.
7. LIGHT AND GLARE
New light and glare will probably occur due to
illumination of signage, parking areas, walkways, outdoor
dining areas, and increased interior lighting needs.
This is not seen as having any significant impact on
surrounding properties, provided that all lighting is
reviewed for appropriate scale and types prior to any
installations.
13. TRANSPORTATION /CIRCULATION
a. A significant amount of traffic will be infused
into this area when considered cumulatively with
the Cunard's restaurant project directly north.
The existing Village area circulation system is
laid out to standards which are now inadequate.
The environmental assessment prepared for the VSP
shows that major streets will be able to handle the
traffic volume anticipated from build -out of the
Village area, as well as the remainder of the
City. The street improvements and mitigation
measures proposed in the VSP will be incorporated
into project approval to mitigate impacts to an
insignificant level and improve parking and
circulation.

PLANNING COMMISSION DISCUSSION:
After having taken testimony from the Applicant, Mr. John Bund,
the Planning Commission discussion focused on the following
items:
1. Revising Conditions 6.a., 6.b., 12.a. and 12.b. to
permit the Applicant opportunity to bond for those
improvements identified. The rationale was that
the maturity of these improvement standards have
not been finalized by the City, i.e., the widths of
Bermudas and Barcelona, location of walkways
relative to development of surrounding properties,
etc.
2. Revising Condition No. 9 to allow for restriction
of parking at space No. 69 rather than relocation,
as this would affect the design of the parking area
and the Applicant has substantially complied with
the La Quinta Municipal Code standards and Planning
and Development Department requirements.
PLANNING COMMISSION ACTION:
The Planning Commission unanimously approved (Commissioner Bund
abstaining) Plot Plan 89 -411, subject to revisions to
Conditions 6.a., 6.b., 9, 12.a., and 12.b., as noted above.
The revised conditions are attached as Exhibit "A ".

GENERAL
1. The development of the site shall be in substantial
compliance with Exhibit "A" revised as contained in the
file for Plot Plan 89 -411, unless otherwise amended by
these conditions.
2. The approved Plot Plan shall be used within the time
period set forth in Section 9.180 of the La Quinta
Municipal Code.
3. Development of Plot Plan 89 -411 shall be consistent with
the development standards of the C -V -S Zoning District.
4. Prior to the issuance of a building permit for
construction of any building or use contemplated by this
approval, the Applicant shall obtain permits and /or
clearances from the following public agencies:
o City Fire Marshal
o City of La Quinta Public Works Department
o Planning and Development Department, Planning and
Building Divisions
o Coachella Valley Water District
o Desert Sands Unified School District
Evidence of said permits or clearances from the
above - mentioned agencies shall be presented to the
Building Division at the time of the application for a
building permit for the use contemplated herewith.

for review and approval by the Public Works
Department. These plans shall incorporate the
design of pedestrian walks as required by Condition
No. 12.
b. The Applicant shall construct street improvements
for one -half street width for Avenida Bermudas and
Calle Barcelona, including relocating median
island, if required, to the requirements of the
City Engineer and the La Quinta Municipal Code.
Bonding for these improvements shall be acceptable,
subject to approval of the Public Works Director as
to form and justification.
7. Drainage disposal facilities shall be provided, on site,
if required by the City Engineer. Applicant shall comply
with applicable provisions of the Master Plan of
Drainage, including any required fees.
8. A grading plan shall be submitted, to be prepared by a
registered civil engineer, for review and approval by the
Public Works Department. This requirement may be waived
at the discretion of the Public Works Director.
SITE DESIGN
9. A minimum of 92 parking spaces shall be provided. Space
No. 69, as shown on Exhibit "A" revised, shall be
restricted to prohibit parking in that space between the
hours when trash collection would occur. Design and
improvement of all parking and driveway areas shall be in
conformance with Chapter 9.160 of the La Quinta Municipal
Code and the requirements of the City Engineer.
10. Trash collection, loading, etc. shall be limited to
morning hours, as consistent with restaurant hours of
operation and the C -V -S sub -zone.
11. Trash enclosure shall be gated and enclosed by a
six - foot -high wall of the same construction and color as
the commercial building. Location and construction of
the enclosure shall conform to requirements of Palm
Desert Disposal Company and the Planning and Development
Department.
12. The Applicant shall comply with the following
requirements for pedestrian walkway easements:

a. A six - foot -wide pedestrian easement shall. be
located and constructed generally along the
perimeter property line, outside of the
right -of -way of Calle Barcelona, from property line
to property line. This easement shall be bonded
for in a surety format acceptable to the City
Engineer.
b. A six - foot -wide north /south pedestrian easement shall be
required, with the location to be determined upon
development occurring adjacent to the south of this
project. This easement shall be bonded for, in a surety
format acceptable to the City Engineer.
The above - described easements shall be constructed with
pavers or stamped concrete, red in color. The walkways
shall be illuminated with umbrella -type or similar
lighting so as to directly illuminate the pathway area.
Construction for Item a. and bonding for Item b. shall
also incorporate provisions for walkway shading, through
landscaping or other means, in compliance with the
standards of the Village Specific Plan (VSP) and the
C -V -S zone district. Design plans for these walkway
areas shall be submitted to the Planning and Development
and Public Works Departments for review and approval of
design and bond amount determination.
13. All on -site utilities shall be installed underground in
accordance with City standards.
14. Prior to issuance of any building permits, the Applicant
shall submit to the Planning Division for review and
approval a plan (or plans) showing the following:
a. Landscaping, including plant types, sizes, spacing,
locations, and irrigation system for all landscape
areas. Desert or native plant species and drought
resistant planting materials shall be incorporated
into the landscape plan. The plan shall also
indicate methods for shading of the parking and
pedestrian areas, including tall canopy trees.
b. Location and design detail of any proposed and /or
required walls.
C. Exterior lighting plan, emphasizing minimization of
light and glare impacts to surrounding properties.
Preparation of the detailed landscape and irrigation
plans shall be in substantial conformance with the
approved site plan (Exhibit "A" revised) on file with the
Planning and Development Department. The plans submitted
shall include the acceptance stamps /signatures from the

Riverside County Agricultural Commissioner's office and
CVWD. All plant materials to be used shall be consistent
with those species identified in the VSP.
15. The Applicant shall comply with the following
requirements of the City Fire Marshal:
a. A fire flow of 2250 gpm shall be available from a
Super hydrant (6" x 4" x 2 -1/2" x 2 -1/211) located
not less than 25 feet nor more than 165 feet from
the building as measured along approved vehicular
travelways.
b. Fire and Life Safety Systems and Appliances shall
be provided in accordance with the requirements of
the Uniform Fire Code and La Quinta Municipal Code
in effect at the time of construction.
C. Final conditions will be addressed when building
plans are reviewed. A plan check fee must be paid
to the Fire Department at the time building plans
are submitted.
16. Building height for any new structures or additions shall
be limited to one story, not to exceed 20' in height, as
measured from finished grade.
MISCELLANEOUS
17. Any outdoor entertainment (amplified or acoustical live
instruments, vocal, recordings, etc.) shall be limited to
occurring no later than 10:00 p.m.. Indoor entertainment
from 10:00 p.m. to 12:00 a.m. shall be limited to live
acoustical /vocal or recorded music. Amplified live
indoor or outdoor entertainment may be permitted to occur
during extended hours (after 10:00 p.m.) at the
discretion of the Planning and Development Director. A
written request shall be submitted to the Director
stipulating the type of entertainment in detail, and the
hours of occurrence requested. The Applicant shall
submit any additional information as may be required by
the Director in order to make a decision on the request.
18. Prior to the installation of any signage associated
with this proposal, the Applicant shall submit a sign
plan showing the location, type, size, colors, and type
of illumination (if any) of all proposed identification
and directional signs. All signs shall be installed in
accordance with the approved plan, and shall be
consistent with Chapter 9.212 of the La Quinta Municipal
Code. Approval of this Plot Plan does not constitute
approval for any signage shown on Exhibit A.

ADDITIONAL LANDSCAPING WILL BE PROVIDED TO

BE MOSTLY RETAINED.
ANALYSIS:
1. The zone change for this property, from
R -1 * ++ to C -V -S, will become effective on
June 15, 1989. Therefore, this approval may
not be utilized for this use until that date,
and will be conditioned to meet the
requirements of the C -V -S sub -zone.
2. Policy 3.6.11 of the La Quinta General Plan
requires noise studies for any
non - residential projects within 1,000 feet of
any residential uses. Due to the nature of
this proposal, it is not anticipated that
this requirement will be necessary. However,
as there may be live entertainment, some
restriction on that aspect of the proposal is
needed.
3. The plan does not consider street dedications
for Barcelona or Bermudas (30 feet half -width
and 44 feet half- width, respectively),
although the VSP calls for a de- emphasis of
these streets in the Village area, so as to
preserve the thematic aspects of the area.
It would be appropriate at this time to
require a bonded agreement for required
dedications /improvements, similar to that
method used for the Cunard's restaurant plot
plan.

4. The parking provided satisfies the
requirements of the C -V -S zone and Chapter
9.160 of the La Quinta Municipal Code,
relative to number of spaces. The C -V -S zone
requires that all parking areas must be 50%
shaded; no adequate provisions are shown on
the landscape plan. It does not appear that
the treulis areas shown in parking area "A"
will satisfy this requirement.
5. Pedestrian easements /walkways must be
provided and be 50 to 75% shaded. Figure 4 -7
(Attachment No. 2) shows the general location
requirements for these easements. A
condition to address this has been suggested
requiring the Applicant to bond for
improvement of the north /south pedestrian
easement pending future development to the
south. The locations shown on the revised
site plan are not specific and will be
subject to detailed reveiw during street
improvement plan checking.
6. The C -V -S zone limits servicing of trash
areas to certain A.M. and P.M. hours.
Because it appears that the trash area is a
"visible location," it is recommended that
loading, trash collection, etc., be limited
to 6:00 a.m.- 9:00 a.m. hours. Space No. 69
must also be relocated to allow access to the
trash area.
7. Landscaping is to be "intensely landscaped"
according to the ordinance. Other than some
additional tree stands, it does not appear
that the landscape plan provides any
"intensity." Site and landscape plans do not
show adequate detailing of additional
landscape materials, number and sizes, turf
areas, fencing /walls (if any), etc.. A
condition requiring a detailed landscape and
irrigation plan to be submitted for Staff
review has been incorporated. This plan will
also have to address parking area shading
requirements in greater detail than that
shown.
8. Signage for this proposal will be reviewed
separately, as no detailed information has
been submitted for review at this time as to
number, size, type, etc. of all proposed
signage.

FINDINGS:
1. Plot Plan No. 89 -411, as conditionally
approved, is consistent with the La Quinta
General Plan, the Village Specific Plan, and
the requirements of the C -V -S sub -zone
adopted to implement the VSP.
2. The subject site is physically suitable for
the proposed development, due to the fact
that the surrounding immediate area and the
site itself is considered urbanized.
3, Environmental Assessment No. 89 -117 has been
prepared and reviewed for this project in
accordance with the California Environmental
Quality Act, and it has been determined that
the project will not result in any
significant adverse impact on the
environment, and therefore, a Negative
Declaration shall be filed upon approval of
this project.
RECOMMENDATION:
By minute motion, approve Plot Plan No. 89 -411, subject to the
attached conditions.

ANALYSIS:
1. The zone change for this property, from
R -1 * ++ to C -V -S, will become effective on
June 15, 1989. Therefore, this approval may
not be utilized for this use until that date,
and will be conditioned to meet the
requirements of the C -V -S sub -zone.
2. Policy 3.6.11 of the La Quinta General Plan
requires noise studies for any
non - residential projects within 1,000 feet of
any residential uses. Due to the nature of
this proposal, it is not anticipated that
this requirement will be necessary. However,
as there may be live entertainment, some
restriction on that aspect of the proposal is
needed.
3. The plan does not consider street dedications
for Barcelona or Bermudas (30 feet half -width
and 44 feet half- width, respectively),
although the VSP calls for a de- emphasis of
these streets in the Village area, so as to
preserve the thematic aspects of the area.
It would be appropriate at this time to
require a bonded agreement for required
dedications /improvements, similar to that
method used for the Cunard's restaurant plot
plan.

4. The parking provided satisfies the
requirements of the C -V -S zone and Chapter
9.160 of the La Quinta Municipal Code,
relative to number of spaces. The C -V -S zone
requires that all parking areas must be 50%
shaded; no adequate provisions are shown on
the landscape plan. It does not appear that
the treulis areas shown in parking area "A"
will satisfy this requirement.
5. Pedestrian easements /walkways must be
provided and be 50 to 75% shaded. Figure 4 -7
(Attachment No. 2) shows the general location
requirements for these easements. A
condition to address this has been suggested
requiring the Applicant to bond for
improvement of the north /south pedestrian
easement pending future development to the
south. The locations shown on the revised
site plan are not specific and will be
subject to detailed reveiw during street
improvement plan checking.
6. The C -V -S zone limits servicing of trash
areas to certain A.M. and P.M. hours.
Because it appears that the trash area is a
"visible location," it is recommended that
loading, trash collection, etc., be limited
to 6:00 a.m.- 9:00 a.m. hours. Space No. 69
must also be relocated to allow access to the
trash area.
7. Landscaping is to be "intensely landscaped"
according to the ordinance. Other than some
additional tree stands, it does not appear
that the landscape plan provides any
"intensity." Site and landscape plans do not
show adequate detailing of additional
landscape materials, number and sizes, turf
areas, fencing /walls (if any), etc.. A
condition requiring a detailed landscape and
irrigation plan to be submitted for Staff
review has been incorporated. This plan will
also have to address parking area shading
requirements in greater detail than that
shown.
8. Signage for this proposal will be reviewed
separately, as no detailed information has
been submitted for review at this time as to
number, size, type, etc. of all proposed
signage.

FINDINGS:
1, Plot Plan No. 89 -411, as conditionally
approved, is consistent with the La Quinta
General Plan, the Village Specific Plan, and
the requirements of the C -V -S sub -zone

that the surrounding immediate area and the
site itself is considered urbanized.
3, Environmental Assessment No. 89 -117 has been
prepared and reviewed for this project in
accordance with the California Environmental
Quality Act, and it has been determined that
the project will not result in any
significant adverse impact on the
environment, and therefore, a Negative
Declaration shall be filed upon approval of
this project.

GENERAL
1. The development of the site shall be in substantial
compliance with Exhibit "A" revised as contained in the
file for Plot Plan 89 -411, unless otherwise amended by
these conditions.
2. The approved Plot Plan shall be used within the time
period set forth in Section 9.180 of the La Quinta
Municipal Code.
3. Development of PP 89 -411 shall be consisten with the
development standards of the C -V -S Zoning District.
4. Prior to the issuance of a building permit for
construction of any building or use contempleted by this
approval, the Applicant shall obtain permits and /or
clearances from the following public agencies:
o City Fire Marshal
o City of La Quinta Public Works Department
o Planning and Development Department, Planning and
Building Divisions
o Coachella Valley Water District
o Desert Sands Unified School District
Evidence of said permits or clearances from the
above - mentioned agencies shall be presented to the
Building Division at the time of the application for a
building permit for the use contemplated herewith.
5. Provisions shall be made to comply with the terms and
requirements of the City's adopted Infrastructure Fee
Program in effect at the time of issuance of building
permits.
TRAFFIC /CIRCULATION
6. The Applicant shall comply with the following street
improvement requirements:
a. The Applicant shall submit street improvement plans
that are prepared by a registered civil engineer

for review and approval by the Public Works
Department. These plans shall incorporate the
design of pedestrian walks as required by Condition
No. 12.
b. The Applicant shall construct street improvements
for one -half street width for Avenida Bermudas and

City Engineer and the La Quinta Municipal Code.
Bonding for these improvements may be acceptable,
subject to approval of the Public Works Director as
to form and justification.
7. Drainage disposal facilities shall be provided, on site,
if required by the City Engineer. Applicant shall comply
with applicable provisions of the Master Plan of
Drainage, including any required fees.
8. A grading plan shall be submitted, to be prepared by a
registered civil engineer, for review and approval by the
Public Works Department. This requirement may be waived
at the discretion of the Public Works Director.
SITE DESIGN
9. A minimum of 92 parking spaces shall be provided. Space
No. 69, as shown on Exhibit "A" revised, shall be deleted
and relocated within the parking area. Design and
improvement of all parking and driveway areas shall be in
conformance with Chapter 9.160 of the La Quinta Municipal
Code and the requirements of the City Engineer.
10. Trash collection, loading, etc. shall be limited to
morning hours, as consistent with restaurant hours of
operation and the C -V -S sub -zone.
11. Trash enclosure shall be gated and enclosed by a
six - foot -high wall of the same construction and color as
the commercial building. Location and construction of
the enclosure shall conform to requirements of Palm
Desert Disposal Company and the Planning and Development
Department.
12. The Applicant shall comply with the following
requirements for pedestrian walkway easements:
a. A 6 -foot wide pedestrian easement shall be located
and constructed generally along the perimeter
property line, outside of the right -of -way of Calle
Barcelona, from property line to property line.

b. A 6 -foot wide north /south pedestrian easement shall
be required, with the location to be determined
upon development occurring adjacent to the south of
this project. This easement shall be bonded for,
in a surety form acceptable to the City Engineer.
The above - described easements shall be constructed with
pavers or stamped concrete, red in color. The walkways
shall be illuminated with umbrella -type or similar
lighting so as to directly illuminate the pathway area.
Construction for Item a. and bonding for Item b. shall
also incorporate provisions for walkway shading, through
landscaping or other means, in compliance with the
standards of the Village Specific Plan (VSP) and the
C -V -S zone district. Design plans for the walkway areas
shall be submitted to the Planning and Development and
Public Works Departments for review and approval of
design and bond amount determination.
13. All on -site utilities shall be installed underground in
accordance with City standards.
14. Prior to issuance of any building permits, the Applicant
shall submit to the Planning Division for review and
approval a plan (or plans) showing the following:
a. Landscaping, including plant types, sizes, spacing,
locations, and irrigation system for all landscape
areas. Desert or native plant species and drought
resistant planting materials shall be incorporated
into the landscape plan. The plan shall also
indicate methods for shading of the parking and
pedestrian areas, including tall canopy trees.
b. Location and design detail of any proposed and /or
required walls.
C. Exterior lighting plan, emphasizing minimization of
light and glare impacts to surrounding properties.
Preparation of the detailed landscape and irrigation
plans shall be in substantial conformance with the
approved site plan (Exhibit "A" revised) on file with the
Planning and Development Department. The plans submitted
shall include the acceptance stamps/ signatures from the
Riverside County Agricultural Commissioner's office and
CVWD. All plant materials to be used shall be consistent
with those species identified in the VSP.

15. The Applicant shall comply with the following
requirements of the City Fire Marshal:
a. A fire flow of 2250 gpm shall be available from, a
Super hydrant (6" x 4" x 2 -1/2" x 2 -1/211) located
not less than 25 feet nor more than 165 feet from
the building as measured along approved vehicular
travelways.
b. Fire and Life Safety Systems and Appliances shall
be provided in accordance with the requirements of
the Uniform Fire Code and La Quinta Municipal Code
in effect at the time of construction.
C. Final conditions will be addressed when building
plans are reviewed. A plan check fee must be paid
to the Fire Department at the time building plans
are submitted.
16. Building height for any new structures or additions shall
be limited to one story, not to exceed 20' in height, as
measured from finished grade.
MISCELLANEOUS
17. Any outdoor entertainment (amplified or acoustical live
instruments, vocal, recordings, etc.) shall be limited to
occurring no later than 10:00 p.m.. Indoor entertainment
from 10:00 p.m. to 12:00 a.m. shall be limited to live

in a surety form acceptable to the City Engineer.
The above - described easements shall be constructed with
pavers or stamped concrete, red in color. The walkways
shall be illuminated with umbrella -type or similar
lighting so as to directly illuminate the pathway area.
Construction for Item a. and bonding for Item b. shall
also incorporate provisions for walkway shading, through
landscaping or other means, in compliance with the
standards of the Village Specific Plan (VSP) and the
C -V -S zone district. Design plans for the walkway areas
shall be submitted to the Planning and Development and
Public Works Departments for review and approval of
design and bond amount determination.
13. All on -site utilities shall be installed underground in
accordance with City standards.
14. Prior to issuance of any building permits, the Applicant
shall submit to the Planning Division for review and
approval a plan (or plans) showing the following:
a. Landscaping, including plant types, sizes, spacing,
locations, and irrigation system for all landscape
areas. Desert or native plant species and drought
resistant planting materials shall be incorporated
into the landscape plan. The plan shall also
indicate methods for shading of the parking and
pedestrian areas, including tall canopy trees.
b. Location and design detail of any proposed and /or
required walls.
C. Exterior lighting plan, emphasizing minimization of
light and glare impacts to surrounding properties.
Preparation of the detailed landscape and irrigation
plans shall be in substantial conformance with the
approved site plan (Exhibit A) on file with the Planning
and Development Department. The plans submitted shall
include the acceptance stamps /signatures from the
Riverside County Agricultural Commissioner's office and
CVWD. All plant materials to be used shall be consistent
with those species identified in the VSP.
15. The eucalyptus tree shown to be removed from the proposed
entry shall be relocated to replace the dead existing
eucalyptus.

16. The Applicant shall comply with the following
requirements of the City Fire Marshal:
a. A fire flow of 2250 gpm shall be available from a
Super hydrant (6" x 4" x 2 -1/2" x 2 -1/211) located
not less than 25 feet nor more than 165 feet from
the building as measured along approved vehicular
travelways.
b. Fire and Life Safety Systems and Appliances shall
be provided in accordance with the requirements of
the Uniform Fire Code and La Quinta Municipal Code
in effect at the time of construction.
C. Final conditions will be addressed when building
plans are reviewed. A plan check fee must be paid
to the Fire Department at the time building plans
are submitted.
MISCELLANEOUS
17. Any outdoor entertainment (amplified or acoustical live
instruments, vocal, recordings, etc.) shall be limited to
occurring no later than 10:00 p.m.. Indoor entertainment
from 10:00 p.m. to 12:00 a.m. shall be limited to live
acoustical /vocal or recorded music. Amplified live
indoor or outdoor entertainment may be permitted to occur
during extended hours (after 10:00 p.m.) at the
discretion of the Planning and Development Director. A
written request shall be submitted to the Director
stipulating the type of entertainment in detail, and the
hours of occurrence requested. The Applicant shall
submit any additional information as may be required by
the Director in order to make a decision on the request.
18. Prior to the installation of any signage associated
with this proposal, the Applicant shall submit a sign
plan showing the location, type, size, colors, and type
of illumination (if any) of all proposed identification
and directional signs. All signs shall be installed in
accordance with the approved plan, and shall be
consistent with Chapter 9.212 of the La Quinta Municipal
Code. Approval of this Plot Plan does not constitute
approval for any signage shown on Exhibit A.

The recently completed La Quinta Garden Cafe .(Mario's Restaurant) is proposing to
enclose part of their approved outdoor seating area for indoor seating. The addition
will match the existing architecture style and roofline. The addition is not visible
from the street. The number of parking spaces provided/ required still meets the
Parking Regulations of the Ordinance because they are changing an approved
outdoor area to an indoor area. No additional seating is planned.

A special inspection was conducted at the above address to
assist in determining the feasibility of converting a single
family dwelling into a restaurant. The following observations
were made:
1. Existing masonry walls and chimneys must be verified to
contain reinforcement steel in order to resist damage
from seismic activity.
2. Handicapped access to parking, dining, sanitary, and
outside facilities must be provided per the State
Building Code.
3. All exiting must be made to comply with the Uniform
Building Code.
4. An adequately sized sewage disposal system must be
installed to service the new use. Riverside County
Health Department will determine size and location.
5. Fire resistiveness of existing walls must be made to
comply for the new occupancy through construction or lot
line adjustments. This would appear to affect only the
existing pool house and not the main structure itself.
6. Light and ventilation shall be provided as outlined in
Section 605 of the Uniform Building Code.
The general items listed above should be addressed in the
design phase of the project. A complete plan check will be
done at plan submittal to verify compliance with the applicable
codes.

WHEREAS, Petitioner has filed an application for the issuance of the above- referred to license, for the
above- mentioned premises, and
WHEREAS, the proposed premises' and /or parking lot, operated in conjunction therewith, are located
within 100 feet of one (1) residences, and
WHEREAS, issuance of a license without the below- described conditions would interfere with the quiet
enjoyment of the property by the nearby residents and constitute grounds for the denial of the application
under the provisions of Rule 61.4, Chapter I, Title IV of the California Code of Regulations.
NOW, THEREFORE, the undersigned Petitioner does hereby petition for a Conditional License as
follows, to wit:
1. The subject alcoholic beverage license shall not be exchanged for a Public
Premises type license,.
2. The quarterly gross sales of alcoholic beverages shall not exceed the gross
sales of food during the same period.
3. Entertainment provided shall not be audible beyond the area under control
of the licensee.
4. No alcoholic beverages shall be consumed on any property adjacent to the
licensed premises under control of the licensee.
5. The Petitioners shall be responsible for maintaining free of litter the area
adjacent to the premises over which they have control.
6. Between the hours of 6:00 pm and closing, the petitioner will provide valet
parking for all patrons.
This petition for Conditional License is made pursuant to the provisions of Sections 23800 through 23805
of the Business and Professions Code and will be carried forward in any transfer at the applicant - premises.
Petitioner agrees to retain a copy of this Petition on the premises at all times and will be prepared to
produce it immediately upon the request of any peace officer.
The Petitioner understands that any violation of the foregoing conditions shall be grounds for the
suspension, or revocation of the license.

Engineering
1. Street improvement requirements need to be addressed.
Improvement plans and bonding proposal(s) need to be
submitted to City Engineer per Condition #6.a. & b.
2. Submit any necessary grading or drainage information to
the City Engineer.
Site Design
3. Submit design details on trash enclosure with location
and design approval from Palm Desert Disposal.
4. Stall #'s 1,5,6,14,15,21,22,30,59,64, & 78 must be
11 -feet wide per Zoning Code.
5. Pedestrian easement appears to be within the
right -of -way. Must be located outside right -of -way per
Condition #12.a. (NOTE: Zoning Ordinance allows some
flexibility here.) Also needs to extend south along
Bermudas to rear property line. Improvement and location
of easement needs to be shown on street plans. Bonding
for easement construction must be accomplished pursuant
to the requirements of the City Engineer.
6. Submit detailed landscape, irrigation, and lighting plans
for review /approval prior to any building permit issuance
(Condition #14), need to be approved by Coachella Valley
Water District and County Agricultural Commissioner.
7. Location of east walkway not approved. Location to be
determined upon development of southerly property.
8. Submit letter description on proposed entertainment, if
any. Include operation hours, type of sound equipment,
if any, etc. per Condition #17.
9. Any signage to be proposed must be approved pursuant to a
sign program, which is required for two or more signs on
a project. Sign program must be approved prior to any
signage installations other than strictly directional
signs.
10. Submit details on covered parking structure(s). Parking
area must be at least 50o shaded by structure and /or
landscaping.

1. The Fire Department is required to set a minimum fire flow for the remodel
or construction of all commercial buildings using the procedure established
by I.S.O. A fire flow of 2250 gpm shall be available from a Super hydrant
(6" x 4" x 2}" x 2j ") located not less than 25' nor more than 165' from
the building as measured along approved vehicular travelways.
2. Fire and Life Safety Systems and Appliances shall be provided in accordance
with the requirements of the Uniform Fire Code and La Quinta Municipal Code
in effect at the time of construction.
Final conditions will be addressed when building plans are reviewed. A plan check
fee must be paid to the Fire Department at the time building plans are submitted.

Area Three - the South End
The South End should contrast strongly with the
Core to the north. This should be an area of mixed
uses at lower densities -- restaurants, some commercial
offices, galleries, housing, and bed and breakfast
establishments.
The curvilinear streets should be maintained and not
widened, the existing trees and traffic islands
retained, and new plantings should be in a similar
vein. It should have a suburban ambience
emphasizing individual buildings set in lush
landscaping.
Area Four - The Park
The future of this area will depend on several
important. decisions to be made by the City and the
Park District.
First, there is the proposal to concentrate active
recreation facilities at the new sports complex on
Avenue 50.
Second, there is the issue of public facilities related
to the Park and the future of the existing community
building.
Third, there is the concern over the street
intersections, the circulation pattern around the
existing park, and vehicle parking. Recommen-
dations for the re- design of the five -way intersection
at Eisenhower and Montezuma and ' alternative
approaches to the circulation pattern are discussed
in Section 4.6. These changes will result in
modifications to the configuration of the Park.
4.6.3 The Parking System
Parking in the Village is planned according to the

Now turning to the block between Avenida La Fonda
and Calle Tampico, the developers are tentatively
proposing 127,600 gross square feet of building.
Deducting 20% for circulation and storage that leaves
a net square footage of 102,080, requiring 510
parking spaces. 132 spaces can be accommodated on
site leaving 378 spaces to be provided elsewhere.
Combining both figures provides a arand total of 576
spaces that would have to be provided through the
common parking approach. Assuming that 110 spaces
can be provided per acre, this means that 5.2 acres
are required for parking (see Table: 4 -2).
The City may, choose to count the parking that
would be created along Avenida La Fonda and Calle
`stado as contributing to the required parking..
B2sed upon the urban design plans for these two
streets, it is estimated that 127 parking spaces can
be created. This reduces the required parking from
576 to 449 and the required acreage to 4.1 acres.
Where is the best location for these additional
parking lots? Overall, it appears that the east side
of Desert Club Drive would be the most appropriate.
The land is easily accessible from an important
collector street and is already designated for
commercial use. It will, however, require that
pedestrians cross Desert Club Drive to enter the
Village. This is a drawback. But if one views this
parking as serving the long -term parking needs
(office workers and staff) then the crossing issue is
less critical. Another potential area for parking lots
is along the west side of Avenida Bermudas.
In Area Three, the South End, lots are larger,
anticipated densities lower. Dense development is
not desired. It should be more spacious and
suburban. As a consequence parking can be
accommodated on site. The streets are narrow and
they should remain that way. Therefore, no parking
`would be permitted on Calle Cadiz or Calle Barcelona
within the Village.
The parking issue in the Park area is two -fold.
First there is the question of how to provide
adequate, safe parking for users of the Park;
second there is the problem of providing parking for
developments adjacent to the Park. It was noted in
Section 3.8 that right angle parking along Montezuma
constitutes a potential hazard which will become more
serious as traffic volumes increase. Although right
angle or angle parking is sometimes used on wide
streets, it is not an ideal situation when through
traffic is involved. Therefore, this form of parking
on Avenida Montezuma cannot be recommended as a
permanent solution.
There are two options. The first is to provide
parking lots within the park. Although park space
is lost by doing this, some additional park space can
be gained around the perimeter by improving
Avenida Montezuma to a 64 -foot (rather than 88 -foot)
right -of -way. In any event, the street system
around the park requires substantial redesign, as
discussed earlier in this section.
The second option, which is recommended, is to
convert the southern loop of Avenida Montezuma into
parking. There are a couple of reasons why this
makes sense. First of all, the two parts of Avenida
Montezuma are not required in order to handle the
traffic. One street will be quite sufficient. Second,
using the southern part of Montezuma for parking
reduces the amount of Park area that will be lost.

and do not easily permit all parking to be contained
on- site. Also, from the urban design viewpoint, the
buildings should, as far as possible, form a contin-
uous line around the park rather than be a series of
freestanding objects. Any on -site parking for the
commercial buildings should be at the rear, and the
conversion of parts of Avenida Martinez and Avenida
Villa to alleys will free up some land that can be
used for parking.
No special parking requirements are proposed for the
residential uses in Area Five.
4.6.4 The Servicing Network
The provision for servicing commercial areas, parti-
cularly retail shops, is not always well planned. All
too frequently delivery trucks have to use the main
streets, thereby conflicting with cars and pedes-
trians. Fortunately, the original subdividers of the
Village provided alleys at the rear of Avenida La
Fonda and Calle Estado and also at the rear of the
properties fronting the park, see Figure: since
These alleys should be retained and upgraded
they form the basis for a good servicing system.
The following actions are recommended:
Alleys North and South of Calle Estado
• Pave the alleys to the full 20 -foot width.
• Designate the south alley one -way westbound.
Designate the north alley one -way eastbound.
• No loading should be permitted from the alley
itself. Developers should be required to
provide a bay off the alley for loading. (For
details ' on trash enclosures see standards
Section 6.0) .
Alley North of La Fonda

The existing streets (Avenida Martinez and Avenida
Villa) running behind the properties facing the park
are essentially redundant as streets. They will
actually tie up some street right -of -ways which can
be used for parking for the properties. The one
exception to this is Avenida Martinez north of the
park which serves .the existing housing and
restaurant, . this should remain - as an improved
street, but left turns Into Eisenhower Drive should
be prohibited.
• Alleys should be paved to the full 20 -foot
width.
• Alleys should have two -way traffic.
• Alleys must be screened - from adjoining
residential uses with walls and landscaping.

unnecessary obstructions. Newspaper stands
should be consolidated into single modular
newspaper dispensers. Sales merchandise
should not be placed in pedestrian corridors.
Bus shelters should be designed in conformance
with the Transit Facilities Standards Manual
published by Sunline Transit. Materials should
be in harmony with the architectural character
of the Village.
6.6.3 Utilities
- All utilities shall be underground.
- Signal controllers and power transformers
should have a design compatible with
the
Village's design character or be screened.
6.7 Village Parking
- The parking requirements of the City of
La
Quinta Zoning Ordinance shall apply within
the
Planning Area except where superseded by
the
design regulation of this Plan and as may
be
varied under the individual site development
review, based on the actual need generated
by
the use or potential use of the property,
and
availability of other usable parking for the site.
A parking district or other financing entity is
suggested for Area Two and Area Four. This
would permit developers to contribute a fee to a
parking fund rather than construct on -site
parking. The fee, to be levied for each
required parking space, would be determined
by the City. The funds generated would allow
the City to construct public parking facilities
within the Village.
- Parking areas should have a minimum number of
entrances and exits to minimize conflicts at
entries and reduce possible congestion at street
.intersections.
- . Parking areas should be landscaped (decorative
and shaded), receiving interior as well as
perimeter treatment (see landscape section) .
- Parking areas should be separated from
buildings by either a paved walkway or
landscaped strip, preferably both. Situations
where parking spaces directly abut the
buildings should be avoided.
Shared parking between adjacent businesses
and /or developments shall be encouraged and
required where practical. Parking provided
behind smaller stores can be consolidated into
larger facilities permitting joint access by
encouraging reciprocal easements.
Separate pedestrian walkways should be
provided, permitting direct access to major
streets, rear entry to shops, and connection to
street sidewalks and mid -block pedestrian links.
- Existing alleys and sideyards should be adapted
to serve as pedestrian access, where
appropriate.
- Access to parking areas should be made where
possible from side and rear streets. Direct
access from major streets is discouraged.
Where it is unavoidable to locate on -site parking
in front of buildings, special design treatment
(landscaping, street furniture, etc.) should be
given to the transition areas between the

6.8 Maintenance Considerations
- Continued good appearance depends upon the
extent and quality of maintenance. The choice
of materials and their use, together with the
types of finishes and other protective measures,
must be conducive to easy maintenance and
u pkeep .
- Materials and finishes shall be selected for their
durability and wear as well as for their beauty.
Proper measures and devices shall be
incorporated for protection against the
elements, neglect, damage, and abuse.
- Provision for washing and cleaning of buildings
and structures, and control of dirt and refuse,
shall be included in the design. Configurations
that tend to catch and accumulate debris,
to automobiles completely and used for outdoor
exhibitions on a temporary basis.
Permanent display of art work can be integrated with
buildings and outdoor spaces in a variety of ways.
Murals can be used both inside and outside a
building. Sculpture can be featured in niches in the
walls of buildings, or as a free standing object
forming a focal point in an outdoor space. Sculpture
can also be incorporated into a fountain. The City
should study the possibility of adopting an "art in
public places" ordinance. Several cities have
adopted such ordinances, which vary in detail but
are all based on the same basic principle. A certain
percentage of a project's cost (one percent or less)
is contributed by the developer for the purchase and
display of works of art. Developers could
alternatively donate the artwork in lieu of the fee.
Some cities have established an arts commission to
screen and select the works of art. In La Quinta's
case the City could use the services of the La
Quinta Arts Foundation to function as the arts
commission.
4.8 Landscaping and Streetscape Elements
4.8.1 Landscaping
The purpose of landscaping is not merely to create a
pleasing visual environment, but also to create a
more comfortable environment by providing shade.
An extensive use of canopy shade trees is
recommended throughout the Village to shade both
pedestrians and cars. The landscaping would also
include accent trees such as palms, and ground
cover, shrubs and vines. All existing trees should
be retained wherever possible; this is particularly
true for the south end along Calle Cadiz and Calle
Barcelona and also for the palm trees surrounding
the Park. A recommended tree list together with
landscaping standards is contained in Section 6.0.
The Landscape Concept is shown on Figure: 4 -14,
and summarized in Table: 4 -3.

The landscaping concept is intended to enhance the
differences between the Areas in the Village. Thus

4.8.2 Shade Features
Shade can be provided in a number of ways, all of
which can be part of the streetscape and building
design. One device is the free - standing trellis
which can be supported on a variety of posts or
columns. The use of climbing vines breaks up the
repetitious aspect of the trellis and adds color and a
denser shade. The trellis is a particularly
appropriate device for providing shade in front of
existing buildings:

4.8.3 Surfaces
The Core of the Village, Area Two will have the
most dense development, with streets and pedestrian
areas where hard surfaces wi II predominate.
Landscaping will soften some of the spaces, but the
hardscape must still be dealt with. In the hot
.desert climate hard surfaces both retain and radiate
heat, making these unpleasant as a pedestrian
environment; hence the emphasis being placed on
shade.

Entry identification signs should be placed at the

and for installing sewers have been prepared by the
Coachella Valley Water district.
4.9.1 Water Distribution System
The proposed water distribution system is shown , on
Figure: 4 -15. The 30 -inch mains in Avenida
Bermudas and Calle Tampico, 12 -inch main in Desert
Club Drive and the 18 -inch main in Eisenhower Drive
are all existing. The rest of the existing mains are
currently undersized and. it is expected they will be
replaced with the ultimate size over the next several
years.

6.0 DEVELOPMENT GUIDELINES
6.1 Site Planning
6.1.1 Pedestrian Orientation
These standards are applicable in those areas
(specifically Area Two) designated for pedestrian
oriented uses:
- Buildings should be located so as to encourage
pedestrian access from streets.
- Maximum use of street frontage area by
buildings should be encouraged.
- Buildings should be contiguous where possible;
if sideyards are provided they should provide
a pedestrian link or functional court.
- On -site parking areas in front of buildings
should be discouraged.

Existing or proposed setback areas should
receive special design treatment (landscaping,
e etc.) . Such areas should integrate landscape
theme to public landscaping.
- Attractive rear and side access to stores should
be encouraged. Side access should be limited
to one side of the building.
Landscaped courts visible from the public right-
of -way should be encouraged.
6.1.2 Automobile Orientation
These standards are applicable in those areas
designated for automobile oriented uses (primarily
Area One) .
Larger building setbacks from the street may be
necessary and therefore may require landscape
buffers provided to screen automobile parking
areas.

exterior spaces and interior yards.
6.1.5 Building Height and Scale
Without restricting the permissible limits of the
applicable zoning district, the height and scale
of each building shall be compatible with its site
and existing (or anticipated) adjoining
buildings.
6.1.6 Screening
- Screening from street and adjacent parcel views
shall be provided for parking areas, trash
containers, storage areas, service yards,
loading docks, ramps, utility boxes, valves,
and other unsightly objects.
- Particular attention must be paid to the
screening of parking areas from adjacent

6.3.1 Landscape
- Landscape treatment shall be provided to
enhance architectural features, strengthen
vistas and important axes, and provide shade.
Spectacular effects shall be reserved for special
locations only.
- Unity of design shall be achieved by repetition
of certain plant varieties and other materials
and by correlation with adjacent developments.
- Plant material shall be selected for interest in
its structure, texture, and color and for its
ultimate growth. Plants should be tolerant to
the desert climate. Other plants that will be
hardy, harmonious to the design, and of good
appearance shall be used. A recommended
plant list is included as Table: 6 -1.
- In locations where plants will be susceptible to
injury by pedestrian or motor traffic, they shall
be protected by appropriate curbs, tree guards
or other devices.
- Parking areas and traffic ways shall be
enhanced with landscaped spaces containing
trees or tree groupings.
- Where building sites limit planting, the
placement of trees in parkways or paved areas
is encouraged.
- Screening of service yards and other places
that tend to be unsightly shall be accomplished
by use of walls, fencing, planting, or
combinations of these. Screening shall be
equally effective in winter and summer.

Use of a variety of subdued colors should be
encouraged, ( for example, off whites, pastels,
browns, ocres, and rusts).
Muted colors are encouraged for large areas
such as building walls, brighter colors can be
used for details and highlighting.

Color treatment of a building's entire facade
and all visible sides should be compatible.

The color palette chosen for a building should
be compatible with the colors of adjacent
buildings. An exception is where the colors of
adjacent buildings strongly diverge from the
design guidelines of this Plan.
- Materials shall be of a durable quality. Stucco,
bricks, concrete block, tiles, and seasoned
woods treated with preservatives are
encouraged. Plastics, vinyl, untreated woods,
and metal siding are discouraged.
- False facade treatment (as used on store fronts
only) should be avoided, (e.g. false stone
work, plastic, aluminum, or fake wood
panelling). Facades should be an integral part
of the building's basic design (and materials) .
6.4.6 Lighting
- Exterior Lighting, when used, shall enhance the
building design and the adjoining landscape.
- Lighting standards and building' fixtures shall
be of a design and size compatible with the
building and adjacent areas.
- Wherever possible, minimize the number of _
colors appearing on the building exterior.
Small commercial buildings should use no more
than three colors. 6.5
- Architectural detailing should be painted to
complement the facade and tie in with adjacent
buildings.
Accent colors for trim should be used sparingly
and be limited in number for each building.
Accent colors on adjacent buildings should be

- Building materials should complement the
