The Community Development Department has reviewed your inquiry regarding release of the
securities that were posted for various model complexes in the City in 1989 thru 1991. Deposits that
can be released are:
1. Plot Plan 89 -426, Triad Pacific Development Co.
2. Plot Plan 89 -425, Deane Homes
We are still researching Plot Plan 90452 (GWR Development) and should have an answer this week.
We have also given a copy of the M. J. Brock and Sons Development bond to Greg Butler for the
model complex at Tract 25389. The reason you did not have a copy of this security was that it was
posted with the City Clerk's Office in 1990 (i.e., Plot Plan 90 -449).

RE: BOND RELEASES (MODEL COMPLEXES)
I have reviewed the following cases to determine if the securities for the model complexes in the City
can be released. My conclusions are as follows:
Plot Plan 89 -426, Triad Pacific Development Co. (PO Box 7877, Stockton, CA 95207) -
The model complex for Tract 23269 (La Quinta Highlands) has been converted. Therefore,
the City can release the $3,200.00 guarantee (Certificate of Deposit) which was posted in
1989.
2. Plot Plan 89 -425, Deane Homes (15 Augusta Dr., Rancho Mirage, CA 92270) - In 1990,
the City approved a model complex and parking lot for Tract 23971. The parking lot
improvements were never removed. Therefore, the City should not release the cash deposit
of $3,000.00 at this time. Also, the model house at 44 -215 Via Del Sol has a two -car garage
instead of a three -car garage. The improvements at this site may be acceptable since the
Zoning Code in 1990 did not require three -car garages for single family houses. A building
permit for this property is unavailable at this time.
Plot Plan 90 -452, GWR Development (859 N. Mountain, #1513, Upland, CA 91786) - On
March 26, 1991, a Certificate of Deposit in the amount of $2,000.00 was posted permitting
a model home to be placed within.2 -feet of the property line (Lot 9, Tract 23935 =1). The
City's permit required the developer to remove all improvements in the setback area when the
house was no longer being used as a model. The house was finaled by the Building
Department on 3 -26 -91 (i.e., 45 -305 Desert Eagle Ct.).
In 1993, Santa Rosa Developers, on behalf of GWR, applied for a setback adjustment (SBA
93 -185) for this house to remain as it was built. This request was denied. Therefore, the City
cannot release the bond at this time. Mr. and Mrs. David Barnes are the current property
owners based on our MapInfo data.

4. Plot Plan 90 -449 (formerly PP 90 -447), M.J. Brock and Sons Development Co. (Tract
25389) - A bond in the amount of $5,920 was posted in 1990 for Lots 26 -29 (Models/Parking
Lot Improvements). The model complex improvements have been removed. Therefore, the
bond money can be released. .
Conclusion - Stan may remember some of these cases because he was here during their processing,
and the Building Department may also want to comment on these projects. The files are attached.

TENTATIVE TRACT #23971
Dear Mr. Taylor:
This Department hereby approves the model home complex for
Tentative Tract 23971 with the following findings and.
conditions:
FINDINGS
1. This Department is in receipt of the - following:
a. A letter from the Agricultural Commissioner
approving the plant material used for Plot
Plan 89 -425.
b. Stamp stating that the plans have been
reviewed by the Coachella Valley dater
District for use of water efficient landscape
design and use of water conserving irrigation
systems.
CONDITIONS
1. The pool located alongside Unit #2600 (Sheet C2)
needs to be set 5 -feet back from the lot boundary.
Please make the necessary correction.
2. The parking area shall be paved and striped in
accordance with the City Engineer's requirements.
In addition a. minimum of one handicapped parking
space shall be provide, pursuant to State Code,
Title 24, Section 2 -7102. The handicapped space
shall be located in close proximity to the sales
office.

3. The Applicant must comply with the requirements of
the Sign Regulations, as set out in Chapter 9.212
of the Municipal Cade fur all proposed signs.
4. A bond will be required from the Applicant to
guarahtee Lhe ultimate reversion of the temporary
sales office and model home uses to approved
residential uses.
5. Please comply with the following conditions
required by the Fire Marshall:
a. Two access gates have been provided along the
fence across the cul-de -sac with a minimum
unobstructed opening width of 12 feet. These
gates are located on opposite sides of the
street at the edge of the pavement adjacent
to the curbs. Locking devices, if desired,
shall be limited to breakaway padlocks.
b. Landscaping in the cul -de -sac area shall be
limited to sidewalks and grass in the areas
surrounding the above mentioned gates. The
gates must be able to function unobstructed
by vegetation.
C. Curb face of the center median of the entry
roadway shall have a minimum twenty feet
setback from the curb face of intersecting
streets.
d. The following areas shall be designated and
marked as fire lanes:
(1) Along fence across cul -de -sac and at both
gates.
(2) All curbing or pavement edge of parking
area not adjacent to parking spaces.
e. Schedule A fire protection approved Super
hydrants (6" x 4" x 2 1/2" x 2 1/2 ") shall be
located one at each street intersection
spaced not more than 330 feet apart in any
direction with no lot frontage more than 165
feet from a hydrant. Minimum fire flow shall
be 1000 gallons per minute for 2 hours
duration at 20 psi residual.

f. The required water system including fire
hydrants shall be installed and accepted by
the Coachella Valley Water District prior to
the delivery of any combustible material to
the site.
All questions regarding the meaning of these conditions
should be referred to the Fire Department Planning
Engineering Staff at (619) 342 -8886.
6. Please comply with the following conditions
required by the City Engineer's Department:
a. On Washington Street, the Applicant shall
install a meandering 8 -foot wide combination
sidewalk /bikeway in accordance with
"Alternative Plan 3" (attached) as shown in
the Washington Street Specific Plan.
b. The Applicant shall use standard Class B
concrete with no color additive for all
public sidewalks. The surface finish shall
be a standard light - broom finish. Applicant
may install special sidewalk in the public
right of way, provided the homeowner's
association enters into a license agreement
with the City and accepts responsibility for -
maintaining the -functional adequacy and
aesthetic appearance of the sidewalk as
determiried by the City Engineer.
C. The Applicant shall post security to ensure
removal of all nonconforming improvements
installed in the right of way in the model
home complex area. An itemized list of
quantities of the nonconforming improvements
shall be prepared by the Applicant- to assist
the City Engineer in determining the
appropriate amount of security required.
d. The Applicant is required to reconsider
planting camphor trees in the upper most
planters at the tract entrance Camphor
trees have a very large and aggressive root_
system and experience has revealed they are
troublesome when planted in close proximity
with other fixed improvements.
7. Plot Plan 89 -428 is required to comply with the
newly approved outdoor light control ordinance
(attached). Please note that fluorescent lighting
requires shielding and filtering and incandescent
lighting greater than 160 watts needs to be
shielded.

8. All bouganvillia plants shown in the landscape
perimeter area should be replaced. The Department
of Public Works does not approve of bougenvillia
plants in the public right of way for maintenance
reasons.
Please submit two revised copies of the model home complex
plans showing the above revisions. In addition, the bonds
noted in condition #4 and be need to be posted. Once this has
been done the building permits for these units can be released.
Please note that landscaping plans for the perimeter landscape
lot, retention basins and proposed park have not yet been
submitted for this Tentative Tract 23971. In addition,
criteria for the landscaping of individual front yards needs to
be submitted. The applicable conditions of approval for
Tentative Tract 23971 are stated below:
126 Prior to final map approval, the Applicant shall
submit to the Planning Division for review and
approval a plan (or plans) showing the following:
a. Landscaping, including plant types, sizes,
spacing, locations, and irrigation system for
all landscape buffer areas. Desert _or native
plant species and drought resistant planting
materials shall be incorporated into the
landscape plan.
b. Location and design detail of any proposed
acid /or required walls.
C. Exterior lighting plan, emphasizing
minimization of light and glare impacts to
surrounding properties.
#27 Prior to final map approval, the subdivider shall
submit criteria to be used for landscaping of all
individual lot front yards. At a minimum, the
criteria shall provide for two trees and an
irrigation system.
These conditions should have been complied with prior to final
iitap approval. No building permits shall be issued until these
conditions have been fulfilled.

Dear Mr. Hardesty:
This Department has the following comments regarding the above
mentioned plot plan
1. The landscaping /irrigation plans require a stamp or letter
of approval from both the Agricultural Commissioner and
the Coachella Valley Water District.
2. The City Engineer's Department has a number of comments on
the model home complex; these are attached.
3. All spas and pools must be located at least 5 -feet from
the property line. All spa and pool equipment must be
located outside the front, side, and rear setbacks of the
property.
4. No dwelling units within 150 -feet of the ultimate
right -of -way of Washington Street shall be higher than one
story.
5. The parking area shall be paved and striped in accordance
with the City Engineer's requirements.
In addition a minimum of one handicapped parking space
shall be provided, pursuant to the State Code, Title 24,
Section 2- 7102. The handicapped space shall be located in
close proximity to the sales office.
6. Please confirm that your intention is to remove the
temporary sales trailer once the model units have been
constructed and that the new sales unit will be in the
unit closest to Washington Street.

7. The Applicant still needs to submit detailed architectural
elevations and examples of exterior materials to the
Planning Department. The Planning Commission will review
and approve these as a business item.
8. Attached are comments from the Fire Marshal.
9. The Applicant must comply with the requirements of the
Sign Regulations, as set out in Chapter 9.212 of the
Municipal Code for all proposed signs. A copy of the
Sign Regulations are attached. A sign application can be
made in conjunction with the model home complex plot plan
application or at a later date.
10. A bond will be required from the Applicant to guarantee
the ultimate reversion of the temporary sales office and
model home uses to approved residential uses.
Please submit revised drawings complying with the above
comments. Items that can only be complied with once the model
homes are constructed will be made Conditions of Approval for
Plot Plan No. 89 -425.
Please note Item No. 7 needs to be complied with prior to
approval of the model home complex. It is suggested that you
submit the following as soon as possible.
1. Six folded copies of floor plans, and elevations of all
sides of the units.
2. One set of reductions (8 -1/2" X 11 ") of the above plans.
3. one set of rendered drawings for the Planning Commission
meeting and a color and materials board.
4. A plan showing the front elevations of the units as they
would appear in a streetscape scene with the required side
yard setbacks. This can be a cut and paste type drawing.
