CONDITIONS OF APPROVAL

1. Establishment of the model home complex and sales office shall be in conformance with
the following:
A. Exhibit "A" (plot plan), and Exhibit "B" (sales office plan) as contained in the
Planning and Development Department's file.
B. Color samples and material descriptions, as contained in the Planning and
Development Department's file on Tentative Tract 24890.
2. The applicant shall comply with the requirements of the Fire Marshal (see attachment).
3. The parking area shall be paved and striped in accordance with the City Engineer's
requirements and the City's Zoning Ordinance.
4. A minimum of one handicapped parking space shall be provided pursuant to the State
Code, Title 24, Section 2 -7102. The handicapped space shall be located in close
proximity to the sales office.
5. This approval shall be used within one year of the approval date; otherwise, it shall
become null and void and of no effect whatsoever. By "use" is meant construction of
the buildings and the operation of the model complex and sales office.
6. This approval is effective from the above date, and the applicant has 15 days after this
date to appeal.
7. The landscape plan (Exhibit "C ") is not approved at this time. The submitted landscape
plan does not contain sufficient information to approve and may be in violation of City
ordinances. Please note the following:
A. The plan appears to ignore property lines and has improvements such as trellis',
fountains, pools, walks constructed on two lots that are not permitted.
B. Pools, spas, and pool equipment appear to encroach into the required 5 -foot
setbacks.
C. Prior to installation of any landscaping, pools, spas, fountains, hardscape, fences,
etc., detailed landscaping (including the parking lot) plans shall be approved by
the Planning and Development Department.

8. On Lot 28, the fireplace in the sideyard shall be revised so that the encroachment into
the required five foot sideyard does not exceed one foot (required for all subsequent same
units built on 65 foot wide lots).
9. On Lot 30, the covered entry gate shall maintain a minimum of four feet from the side
property line (required for all subsequent same units).
10. A minimum 20 foot front yard setback shall be provided for B/a duplex units.
11. Prior to issuance of a building permit for single family models, a unit siting plan showing
revised setbacks for Lots 28 and 30, as noted above, shall be submitted to the Planning
and Development Department for approval.
12. A bond for $5,000.00 shall be deposited with the City to guarantee the ultimate revision
of the temporary sales trailer and model homes to approve residential uses.
13. All requirements of the Engineering Department shall be met.

Dear Mr. Martin:
Your application for a model home complex and sales office,
located on Tract No. 24890 is hereby approved, subject to the

With respect to the condition of approval regarding the above referenced Plot
Plan, the Fire Department requires the following fire protection measures be
provided in accordance with La Quinta Municipal Code and /or recognized fire
protection standards:
1. Provide or show there exists a water system capable of delivering 2500 gpm
for a 2 hour duration at 20 psi residual operating pressure which must be
available before any combustible material is placed on the job site. A
Temporary water supply for fire protection may be allowed for the construction
of model units only. Plans for a temporary water system must be submitted
to the Fire Department for review prior to issuance of building permits.
2. The required fire flow shall be available from a Super hydrant(s) (6" x 4"
x 211" x 211") located not more than 165' from any portion of the building(s)
as measured along approved vehicular travelways.
3. Install portable fire extinguishers per NFPA, Pamphlet #10, but not less
than 2AIOBC in rating. Contact certified extinguisher company for proper
placement of equipment.
4. Certain designated areas will be required to be maintained as fire lanes.
5. Gates installed to restrict vehicle access shall provide a minimum unobstructed
opening width of 24 feet. Gates shall be capable of being opened by human
hands without special force or knowledge. Locking devices, if desire,
shall be submitted to the Fire Department for approval prior to installation.
All questions regarding the meaning of these conditions should be referred to the
Fire Department Planning & Engineering Staff at (619) 342 -8886.
