WHEREAS, ALLIED Mutual Insurance Company hereinafter
referred to as "Surety ", is a corporation duly organized and
existing under the laws of the State of Iowa
and duly licensed for the purpose of making, guaranteeing or
becoming sole Surety upon or undertakings required or authorized

RE: BOND RELEASES (MODEL COMPLEXES)
I have reviewed the following cases to determine if the securities for the model complexes in the City
can be released. My conclusions are as follows:
Plot Plan 89 -426, Triad Pacific Development Co. (PO Box 7877, Stockton, CA 95207) -
The model complex for Tract 23269 (La Quinta Highlands) has been converted. Therefore,
the City can release the $3,200.00 guarantee (Certificate of Deposit) which was posted in
1989.
2. Plot Plan 89 -425, Deane Homes (15 Augusta Dr., Rancho Mirage, CA 92270) - In 1990,
the City approved a model complex and parking lot for Tract 23971. The parking lot
improvements were never removed. Therefore, the City should not release the cash deposit
of $3,000.00 at this time. Also, the model house at 44 -215 Via Del Sol has a two -car garage
instead of a three -car garage. The improvements at this site may be acceptable since the
Zoning Code in 1990 did not require three -car garages for single family houses. A building
permit for this property is unavailable at this time.
3. Plot Plan 90 -452, GWR Development (859 N. Mountain, #15B, Upland, CA 91786) - On
March 26, 1991, a Certificate of Deposit in the amount of $2,000.00 was posted permitting
a model home to be placed within 2 -feet of the property line (Lot 9; Tract 23935 -1). The
City's permit required the developer to remove all improvements in the setback area when the
house was no longer being used as a model. The house was finaled by the Building
Department on 3 -26 -91 (i.e., 45 -305 Desert Eagle Ct.).
In 1993, Santa Rosa Developers, on behalf of GWR, applied for a setback adjustment (SBA
93 -185) for this house to remain as it was built. This request was denied. Therefore, the City
cannot release the bond at this time. Mr. and Mrs. David Barnes are the current property
owners based on our Mapinfo data.

4. Plot Plan 90 -449 (formerly PP 90 -447), M.J. Brock and Sons Development Co. (Tract
25389) - A bond in the amount of $5,920 was posted in 1990 for Lots 26 -29 (Models/Parking

TENTATIVE TRACT 25389
Dear Mr. Ayers:
The Plot Plan 90 -447 is hereby approved with the following
conditions:
1. Plot Plan 90 -447 shall comply with Exhibit A (Site Plan)
and Exhibit B (landscaping Plan) as contained in the City
of La Quinta Planning Department project file except as
modified by the following conditions.
2. A bond for the amount of $4,000 is required to - guarantee
the ultimate reversion of the temporary sales office and
model home uses to approved residential uses.
3. The Applicant shall post security to ensure removal and
restoration of model home walkway and driveways. An
itemized list of quantities of the above shall be
prepared by the Applicant to assist the City Engineer in
determining the appropriate amount of security required.
4. All units shall meet the required setback standards in
the R -1 zone:
Structures (eg. residential units, swimming pool
equipment) front 20 -feet, side 5 -feet ( on street side of
a corner lot, 10- feet), rear 10 -feet.
Swimming Pools no closer than 5 -feet to property and
unit. Please note that swimming pools are to be fenced
as required by State law.
5. A minimum of one handicapped parking space shall be
provided, pursuant to the State Code, Title 24, Section
2 -7102. The handicapped space shall be located in close
proximity to the sales office.

6. The parking area shall be paved and striped in accordance
with the City Engineer's requirements.
7. The Applicant shall comply with the requirements of the
Fire Marshal as follows:
a. Schedule A fire protection approved Super fire
hydrants, (6" x 4" x 2 1/2" x 2 1/2 ") shall be
located at each street intersection spaced not more
than 330 feet apart in any direction with no
portion of any frontage more than 165 feet from a
fire hydrant. Minimum fire flow shall be 1500 gpm
for 2 hours duration at 20 psi.
b. The required water system including fire hydrants
shall be installed and accepted by the appropriate
water agency prior to any combustible building
material being placed on an individual lot.
C. All buildings shall be accessible by paved roads.
If "trap fencing" around the units or vehicle
access restricting devices are desired, plans shall
be submitted to the Fire Department for
review /approval prior to construction.
d. Certain designated areas will be required to be
maintained as fire lanes.
- All questions regarding the meaning of these conditions should
be referred to the Fire Department Planning & Engineering Staff
at (619) 342 -8886.
8. The Applicant must comply with the requirements of the
Sign Regulations, as set out in Chapter 9.212 of the
Municipal Code for all proposed signs.
9. Plot Plan 89 -425 is required to comply with the newly
approved outdoor light control ordinance (attached).
Please note that fluorescent lighting requires shielding
and filtering and incandescent lighting greater than 160
watts needs to be shielded.
10. Please replace the "Modesto Ash" with Fraxinus Uhdei,
Majestic Beauty (Shamel Ash).
11. The plant materials shown on the landscaping plans need
to be approved by the Agricultural Commissioner. Please
provide this Department with a letter from the
Agricultural Commissioner reflecting the above.

12. The landscaping plans need to be reviewed by the
Coachella Valley Water District for use of water
efficient landscape design and use of water conserving
irrigation systems. Please provide this Department with
a copy of the landscaping plans showing CVWD's approval
stamp.
13. This approval shall be used within one year of the
approval date; otherwise, it shall become null and void
and of no effect whatsoever. By "use" is meant
construction of the buildings and the operation of the
model complex and sales office.
14. This approval is effective from the date conditions
number 1 & 2 have been complied with and the Applicant
has 15 days after this date to appeal.
Conditions number 10, 11 and 12 shall be complied with as
soon as possible. Final inspections shall not be
scheduled on these units until these and all other
conditions have been implemented.
Please note that criteria for the landscaping of individual
front yards still need to be submitted for this tract.
Condition #19 for Tentative Tract 25389 is stated below:
"Prior to final map approval, the Subdivider shall submit
criteria to be used for landscaping of all individual lot
front yards. At a minimum, the criteria shall provide
for two trees and an irrigation system."
This condition should have been complied with prior to final
map approval. No building permits shall be issued on the
residential units until this condition has been fulfilled.
