ALLOW A 1,280 SQUARE FOOT HOME, AND TO ALLOW A CERTAIN PERCENTAGE OF SMALLER HOMES TO BE BUILT. ISSUES: An Acacia homeowner, Mrs. Patty Stutz, has filed an appeal of a Planning Commission decision that pertains to perimeter fences, a 1,280 square foot size home, and the number of smaller homes that will be allowed to be built on Lots 24 through 33, and 130 through 139 of Tract 23268 (Attachment #1). Staff recommended, in the Planning Commission staff report, masonry block walls for all fencing including perimeter walls that would match the existing walls (Attachment #2). The appeal requests that block walls be built along the north and east perimeters. The appeal also objects to the approval of the smallest single family unit - Plan A, which features .1,280 square feet of livable space (Attachment #3). Finally, the appeal objects to the fact that there is no condition to ensure an equal percentage of larger homes. will be constructed as are found in the existing phases of the Acacia tract. BACKGROUND: General On September 17, 1993,. La Quinta Real Estate Development Partners, Limited Partnership, made application to the City for architectural approval of five new single family plans on twenty lots within the Acacia project - Tract 23268. On October 6, 1993, the Design Review Board considered the architectural merits of the new plans and forwarded a recommendation of approval to the Planning Commission with the request that the applicant provide a minimum of 18 -inch roof overhangs on all units and that the garage doors match those in the existing units. The Board found that the architecture was compatible as the proposed elevations incorporated several architectural elements found in the existing Acacia homes. 0 On October 7, 1993, staff mailed a letter to the current property owners within the Acacia tract that advised them of the applicant's request and that the Planning Commission would be considering the matter at its meeting of October 26th. The letter generated two telephone inquiries and two office visits by property owners to review the plans. This letter is found as Attachment A. On October 26, 1993, staff presented the Planning Commission with the applicant's request and the recommendations of the Design Review Board. A number of residents attended the meeting and voiced their opinions on the perimeter fencing, small home size, and percentage of smaller homes that should be allowed to be built. The majority.of opinions expressed were in opposition to the applicant's request. After some discussion, the Planning Commission approved the architectural design with the added conditions that the north and east perimeter wooden fences would be allowed to remain (with repair to the eastern fence located adjacent to an existing trailer park), that the maximum number of 1,280 square foot homes that could be built shall be 20% of the 751ots that Acacia recently purchased in the tract and that one of the two required trees in the front yards be a 24 -inch box specimen tree. This motion passed with a 3 -2 vote, with Commissioners Marrs, Abels, and Chairwoman Barrows voting "yes" and Commissioners Adolph and Ellson voting "no ". Request On October 28, 1993, the Planning and Development Department received an appeal of the conditions from Patty Stutz, an Acacia homeowner (Attachment #5). The appeal states that there is a discrepancy in the information given to the Planning Commission by staff at the October 26th meeting. Mrs. Stutz states that 49% of the existing homes in the Acacia project are over 2,000 square feet in livable space, and that the proposed housing size mix should be the same percentage. The appellant is objecting to the approval of the smallest unit, 1,280 square feet, approved by the Planning Commission. The approval of allowing the existing wooden fencing along the northern and eastern perimeter of the project is also being appealed. To comply with Section 9.180.060 -Plot Plan Appeal, of the Zoning Ordinance, staff requested that a public hearing before the City Council, be scheduled within 30 -days of the filing of the appeal. The current Acacia property owners have been mailed a notice of the hearing and a newspaper advertisement was published in the Desert Sun on November 6, 1993. ANALYSIS: Perimeter Fencing Issue The first issue of the appeal is the objection to Condition #19 (Attachment #6) which was modified during the Planning Commission meeting of October 26, 1993, to state that the existing wooden fences along the northern and eastern tract perimeter property lines are allowed to remain with repairs to be made to the eastern fence. Staff had originally drafted Condition 19 to read as follows: "The perimeter shall provide masonry block wall rear and side yard fencing and metal gates to match that existing in the first phase of Tract 23268." 018' 3 0 The condition was modified to read: 41 "The permittee shall provide masonry block wall rear and side yard fencing and metal gates to match that existing in the first phase of Tract 23268, except that the existing north perimeter wooden fence may remain and the east perimeter wooden fence shall be repaired by the applicant." The applicant maintained that the expense of providing masonry block perimeter walls would add to the price of the homes for which current marketing information and trends would not support. The applicant stated during the Planning Commission meeting that the sales prices of the proposed new units would range from the high '$120,000's to $175,000. Chapter 9.204 - Walls. Fences. and LandKQing (as amended by Ordinance 212, effective October 13, 1992), states in the General Requirements that property fencing shall be optional. The exception to this provision will be for private, completely gated communities which are to have perimeter fencing but are not required to have rear or sideyard fencing inside the project unless required. by an adopted specific plan, approved tract map conditions, or by the applicant's CC & R's. Acacia is not a gated community nor is it governed by CC & R's. Tract Condition of Approval #18 calls for submission of a plan for review and approval of the "location and design detail of any proposed and /or required walls" for Tract 23268. There is no tract map condition calling for fencing of any type for Tract 23268. The ordinance calls for specific fence materials that are permitted to be used. These materials consist of wood fencing, ornamental iron tubular steel, solid masonry fencing, or walls, combination of above materials with the bottom portion being masonry block. The ordinance further states the following concerning wooden fencing: "Wooden fencing is permitted in the rear or interior sideyard only when not visible from the street. All wood fencing shall be constructed of #1 Cedar- or Redwood, stained or painted to match or complement the adjacent wall or structure, may as an alternative be water treated and left in the natural color. The fence boards may be erected horizontal or vertical and the minimum wood thickness shall be one inch. Support posts and the bottom fence rail shall be a minimum of 4" X 4" Redwood or pressure treated lumber, or steel /tubular steel or block placed five feet on center and imbedded in concrete or having a concrete footing. The posts shall be installed on the interior side of said lot with fencing material on the outside edge of posts. Exception: split rail Cedar or Redwood fencing is permitted within the front and street sideyards." By ordinance, wooden fencing is permitted in the Acacia tract along rear and interior sideyards. However, the first phase of the Acacia project features masonry block walls for all fencing. Staff s recommendation was to require matching masonry block perimeter walls as well. • Of the five new single family homes proposed by La Quints Real Estate Development Partners, Limited Partnership, to be built by Acacia Construction, Inc., the smallest unit is 1,280 square . feet of livable space not including the two car garage. The other proposed units are 1,591, 1,596, 1,835,and 2,358 square feet in livable space. Building permit information notes that the existing Acacia homes were built in four sizes: 1,362, 1,721, 1,927, and 2,162 square feet in size. There have been a few room additions and partial garage conversions since original construction of the existing homes; however, this added space cannot be counted when assessing the issue of home size. The question of small proposed home size as compared to the existing home sizes was visited in the Forecast Homes /Quinterra project, where it is currently under study. This project. is slightly different in that the architectural design of the proposed new homes is not being questioned, just the size of the smallest unit. The applicant in this appeal, .Mrs. Stutz, is a resident of one of the existing Acacia homes, and is representing a group of Acacia homeowners. On November 8, 1993, Mrs. Stutz submitted a petition from homeowners who support her appeal request (Attachment #7). The appeal contends that the proposed Plan A which is a 1,280 square foot unit is too small for the Acacia tract, and that it should not have been. approved based upon that issue. The appeal also states that the new homes should be "consistent in size (at least 49% be over 2,000 square feet) ". The appeal application states that "47 out of the 96 homes are either 2,032 or 2,162 square feet, which is 49% of the homes in Phase I ". This information is inconsistent with the building permit information. Permits ' issued . show that no more than 17% of the existing homes are above 2,000 square feet and that there is only one plan over 2,000 square feet which is,2,162 square feet in livable space. Local ordinance requires a minimum size of 750 square feet of livable space for a single family home in the R -1 Zone. All of the proposed units will exceed that standard. The following table, based on City records, gives the number of building permits issued for each of the four plans constructed in the three phases of the existing homes. PLAN SIZE (SQ. FT.) Approximately twenty -three point nine percent (23.9%) of the permits were for the smallest unit at 1,362 square feet. The applicant is proposing to construct 20. homes consisting of four. of each of the five plans. This would be an equally balanced mix of 20% of each plan. On November 9, 1993, the appellant submitted copies of the Acacia Homes sales brochures (Attachment #8) which lists the square footage of the four existing plans available. The square footage numbers coincide with the building permit information except for Plan C. In Phase I, Plan C is listed as being 2,032 square feet, while in Phase III it is listed as 2,108. Permits do not reflect these two.sizes, but rather 1,927 square feet. Staff consulted the Building Official who reviewed the construction plans submitted for plan check and permitting. The Building Official measured the plans and determined the livable spaces were off by an average of 50 square feet from the area indicated on the .plans. In light of Ordinance 236 - Interim Zoning Ordinance, the Acacia proposal falls within the 10% rule and. may proceed. The smallest proposed home (1,280 square feet) is 82 square feet smaller than the smallest existing home (1,362 square feet). The largest proposed home (2,358 square feet) is 195 square feet larger than the existing largest home of 2,162 square feet. The range permitted under the Interim Ordinance for this tract is 1,226 square feet to 2,378 square feet. All of the proposed plans fall within this range. There are 96 existing homes that comprise Phase I of Acacia. These homes range in size from 1,362 to 2,162 square feet. PROPOSAL: The applicant, La Quinta Real Estate Development Partnership, LP (Acacia) recently purchased 75 lots within the Acacia'Tract. On Lots 24 to 33 and 130 through 139, Acacia is proposing to construct 20-new homes featuring five new plans. Each of the five plans will have two front elevation options. Four of each plan are proposed to be built in this second phase of Acacia.. The builder anticipates subsequent construction of the majority of the remaining lots within the PCST.152 1 tract. The builder is Acacia Construction, Inc., the same builder of the existing homes within the tract. The square footage of these new units range .from 1,280 to 2.358 square feet of liveable area. excluding garage area. Four of the plans feature three car garages. The largest .unit is a two - story home. .acacia proposes to use the same exterior colors and materials as were used in the existing Acacia homes. The same concrete roof tile will be used. The applicant does want. to introduce two new roof tile colors, one a sand color and the other a washed neutral color. These two new colors will blend in with the other tile colors. The applicant requested these,two new colors after the Design Review Board meeting. There is a difference in the roof tile of the proposed units. The new homes will feature a dominate gable with accent eyebrows and tall entry porticos. Roof overhangs range from 12 to 18 inches. A model complex is planned for Lots 29 through 33, where one of each type of unit will be featured. On- street parking is requested on West Harland Drive for the model complex. The applicant will be applying for approval of the model complex in a separate request. In light of the controversial new units proposed for the Quinterra project, staff felt it appropriate to send a letter to all property owners of Acacia lots to notify them of the applicant's request. As of October 21st, staff received only two telephone inquires as a result of the letter, and two property owners came to the Planning Department to view the plans and exhibits. Generally, comments were positive after viewing the plans and learning of the proposed range in unit size. DESIGN REVIEW BOARD 'CONSIDERATION: This request for architectural review was considered by the Design Review Board on October 6. 1993. The Board viewed a videotape prepared by staff of the existing homes in order to assess compatibility with the proposed units. The Board did not recommend any modifications to the design except that all units. are to have at least 18 -inch roof overhangs, and the garage doors are to match those in the existing Acacia homes. The applicant agreed to these conditions and the Board unanimously approved a motion to recommend approval of the architectural design of the new units. CONCLUSION: Staff has reviewed the proposed units and has determined that they are compatible in design with the existing homes. The proposed equal housing mix is acceptable. The new roof tile colors are also acceptable to.staff. Conditions of Approval have been drafted which include the Design Review Board's recommendations to have a minimum 18 -inch roof overhang. and to require that all garage doors match existing garage doors.. The proposed homes will have a similar range, with the addition of a fifth plan with 2,358 square feet. Garage sizes range from 2 car, 450 square feet in Plan A, up to a 3 car; 703 square feet garage in Plan B. Four of the five plans feature a 3 car garage. Garage doors are wood overhead doors with plant -ons. The same colors and materials used on the existing homes will be used on the proposed homes. The.-color and materials board is 'available for review. There is a difference in roof style, however the same concrete roof tile that was used on the existing homes is proposed for the new units. Proposed roof lines of the new units feature a dominant gable with 12 -inch overhangs. A model complex is planned for lots 29 through 33, where one of each plan type will be built. On- street parking is requested on West Harland Drive. ANALYSIS: The smallest plan that the applicant is proposing is approximately 82 square feet smaller than the smallest existing home built in the Acacia tract. The largest plan is 196 square feet larger than the largest existing home. The mix of new homes provides a balanced configuration similar to that found in the mix of existing homes. Heights of the homes range from 16 feet to 24'6 ", which is well within the R -1 requirement of 28 feet maximum. Staff visited the tract and videotaped the existing homes for comparative purposes. The architectural compatibility of the proposed units is debatable. RECO.%fN1ENDED CONDITIONS: 1. The front yard of all lots, and in addition the street side yard of corner lots, shall be landscaped to property line, edge of curb, sidewalk, or edge of street pavement, which ever is furthest from the residence. 2.. The landscaping shall include trees (minimum two 15- gallon trees on interior lots and five 15- gallon trees on corner lots), shrubs, and groundcover and /or hardscape of sufficient size, spacing and variety -to create an attractive and unifying appearance.
