Mirage, CA 92270 Re: Exiting, Issues at Omri .& Boni Restaurant, 47-474 Washington Street Dear Mr. Hall, The purpose of this letter is to address three separate exiting issues at Omri & Boni Restaurant at 47-474 Washington Street. This project is currently under construction, nearing completion.. The issues are (1) an unauthorized revision at the main Entry on the east side of the building, (2) an unauthorized revision.at the second required exit on the east side of the building, near the Kitchen, and , (3) proposed patio seating and exiting on -the west side of the building. 1) On Thursday, April 3, 2003; it was brought to my attention that an exit door other than what appears on your approved Plans had been installed at the above project. On Friday, April 4, 2003; 1 visited the site with Kirk Kirkland, Senior Building Inspector. At the main Entry, where the approved Plans show a pair of exterior glass doors, a vestibule, and a pair of interior glass doors, there now exists a pivoted exterior "door" (more like a pivoting wall section), and an interior framed wall which redirects pedestrian flow into.and out of the building. This deviation from the approved.Plans has been made without involvement of the Building Department.: This new door configuration is not approvable for the following reasons: (a) "A single leaf of an exit door serving an occupant load of 10 or more shall not exceed -4 feet." (CBC §1003.3.1.4); (b) "Exit doors shall swing in the direction of the path of exit travel where the area served has an occupant load of 50 or more." (CBC §1003.3.1.5); (c) "The bottom 10 inches of all doors except automatic and sliding shall have a smooth, uninterrupted surface to allow the door to be opened by a -wheelchair footrest without creating a trap or hazardous condition." (CBC §113313.2.6) Since construction is notyet complete, I am unable to determine at this time whether additional issues exist with regard to door hardware, opening force, threshold, and floor. levels. This deviation'may also impact fire sprinkler and ,exit sign locations, and will ultimately require review and approval by the Riverside County Fire Department. In addition, it may be difficult to meet the California Energy Code requirements for Weatherstripping of all exterior doors'. If the Building Department had been invited to'participate in this revision at an earlier date, all of these issues would have been brought to your attention prior to them having a negative impact on your construction costs and timeframe. I urge,you to contact'me at your earliest opportunity to propose an approvable solution. 2) -While on the site to investigate the Entry door, I took the opportunity to look at the second required exit near the Kitchen. Once again, a deviation from the approved Plans has been made without involvement of the Building Department.. As you may recall, in an effort to help you begin construction, the Building, Department issued a permit for this project prior to final approval of all required elements. Plans were approved with .a specific exclusion to the southeast portion of the building, where an additional required exit door was proposed to be installed in a masonry wall at the south end of the Dining Room. More than five months after permit issuance, adequate information was received and reviewed by the Building Department, and the second required exit was approved. This exit occurred through a short hallway between the Kitchen and'the Employee Restroom. To comply with the Building Code prohibition to exiting through a kitchen (CBC §1004.2.2), a door was shown on the Plans, separating the Kitchen from the exit access. The field condition observed on .Friday, April 4, 2003, revealed that the door isolating the Kitchen from the exit access, and the wall. containing that door, had been eliminated during construction. This has created an exit condition through a kitchen. This condition will not be. approved. 3) In February 2003, 1 notified you that stones placed around the Patio on the west side of the building were not on the approved Plans. At that time I -also advised you that the installation of those stones required Community. Development Department approval,. as well as Building Department review and approval. In addition, I alerted you to a couple of required modifications to the existing installation, so that you could avoid some unnecessary corrections during plan review. On March 28, 2003, drawings were submitted to the Building Department for review. Those drawings were reviewed today. The associated corrections follow: 1. Provide approval for this alteration from La Quinta Public Works Department. This approval will be adequately demonstrated by submitting . ,1 to the Building Department.two photocopies of a revised Precise Grading Plan for this site, as approved by the: Public Works Department for this reconfiguration. This Plan should show the path of travel from the proposed gate to the parking lot and demonstrate compliance with all. applicable accessibility requirements (i.e., width, slope, cross -slope, curb cut, etc.). 2. Provide details of the proposed gate, demonstrating compliance with all applicable provisions of CBC §1003.3.1 and, CBC Chapter 11 B, particularly with respect to net opening width, floor levels and slopes at each side of gate., landing dimensions and maneuvering space, type of hardware (including mounting height [CBC §1133B.2.5.2]), and ,smooth surface at bottom 10 inches. A comprehensive review will .be performed after the requested.information is provided. 3. Provide:an analysis of the impact this alteration has on the overall' occupant load and restroom facility requirements. Calculate the area of. the patio to derive the occupant load of that space"based upon CBC Table 10-A. Refer to the original approved drawings for existing, areas -to calculate existing occupant load. (Remember that occupant load is not based upon the number of.chairs, except when accomplished with fixed seating.) Calculate the total required.sanitary facilities requirements for men, women and employees based upon CBC Appendix Chapter 29. A. comprehensive review will be performed after the requested information is provided. 4.: Provide at outdoor seating -and exit aisles not less than 44 inches in width (CBC §1133B.6.2).~ 5. Provide at, least one wheelchair seating space for each 20.seats in the outdoor dining area (CBC §1104B:5.4). Show the accessible seating space on Plans and demonstrate a minimum 3.0"x48" clear floor space at that location (CBC §11226.3). 6. All Plans and details submitted for this review and approval shall be bound into two complete Plan .sets. Each page of both sets shall contain the name and complete address of the project; and the name, telephone number and wet -signature of the plan preparer. As further information is provided and reviewed, additional corrections may be required.
