The plans are now approved subject to the conditions listed below and the attached compliance sheet.
1. You may not use option 2 floor coverings (VCT tile) or black vinyl cove bases in any food service area. Use
Quarry tile and base or the tile and base used in the customer service area. (See redline Subway sheet 1 of 2)
2. Vinyl wall coverings must be covered with a protective water proof finish behind any sink, soda fountain or
light steam generating appliance such as a hoodless bread oven. Typically Lexan and Plexiglas are used to a
height of 18" above the appliance. All floor, wall and ceiling finishes in food service areas must be smooth and
easily cleanable including waitress and self service stations such as drink dispensers. Used Vinyl faced ceiling
tiles over the soda fountain
3. Add a hand sink to the prep area. (See redline Subway sheet 1 of 2)
4. All food and utensil sinks must be plumbed to floor sinks through approved air gaps. The mop sink must be
of the floor basin style. Behind all three sinks in the splash zone the finish must be water proof to a height of 8'
(e.g. FRP/tile)
5. The trash enclosure must be finished so that the interior floor and walls are smooth and easily cleanable.
Seal these interior surfaces with an approved two part epoxy.
6. All exterior and restroom doors must be self closing. Exterior doors must also be sealed against entry by
vermin. Install a customer service air curtain over the entry door. (See redline Subway sheet 1 of 2)
7 The number of lockers provided shall be equal, or greater than the number of workers assigned to a peak
shift
8. The hot water heater must be a commercial model, have a 30 gallon capacity and a 60,000 Btu or 13kW
rating.
9. Approval of this plan does not include approval by local land use, water or sewer agencies. Prior to
commencing construction or undertaking improvements, submit these plans to the Riverside County Land Use
Agency located at 82675 Hwy 111, Room 201 Indio CA 92201, phone (760) 863-7000. A facility may not
receive an Environmental Health Permit without this approval, which will be verified prior to the final inspection.
CONSTRUCTION INSPECTIONS: Contact the Plan Checker for a Preliminary Inspection when construction is approximately
80% complete, with plumbing, rough ventilation, and rough equipment installed. Request for inspection should be made at least five (5)
working days in advance. A compliance guide is attached to this plan correction sheet. All construction not otherwise addressed on the
plan correction must be performed in accordance with the guidelines set forth therein. A FINAL INSPECTION MUST be made upon
completion of ALL work including finished details. APPROVAL to operate shall not be granted, or remodeled areas approved to
operate, until the facility has passed the FINAL INSPECTION, and "APPLICATION TO OPERATE" has been completed and
PERMIT FEES have been paid.

Thank you for your application of April 26, 2004, for a review of the TurboChef Model
NGC Rapid Cook Oven for exemption from the mechanical exhaust ventilation
requirements of Section 114140 of the Califorbia'Uniform Retail. Food Facilities Law
(CURFFL). Specifically, you. have requested an exemption to allow unventilated NGC
Rapid Cook Ovens to be installed and operated at various Subway locations throughout
California. r
You have provided documentation and I havee-verifiied that the TurboChef Model NGC
Rapid Cook Oven has been evaluated and listed by'UL for conformance with ANSI/NSF
Standard 4.
Under the provisions of CURFFL Section -114140., the Department may exempt heating
and cooking equipment that does not produce toxic gases, grease, smoke, or heat
when properly. installed and operated as recommended by the manufacturer. Based on
the information and documentation you have provided, the TurboChef Model NGC
Rapid Cook Oven is granted'LIMITED exemption from mechanical exhaust ventilation
under the following conditions:
1. Unless approval is•granted by the local enforcement'agency, there shall be'no
more than one unventilated oven in operation at each Subway location.
2. No other heating or cooking appliances subject to mechanical ventilation
requirements may be operated without mechanical ventilation in the food
facility, unless permission to operate more than one unventilated appliance is
granted by the local enforcement agency. t

3. The oven shall not be used for cooking meats, poultry, fish, or other foods
that may produce grease laden vapors. Such use will require that mechanical
ventilation be installed over the unit.
4. .The oven must be operated and installed in a well -ventilated area approved '
for food preparation.
5. The oven must be installed, maintained, operated, and serviced according to
the specifications of the manufacturer and local codes.
6. This exemption shall not be deemed to supersede any local fire or building
code requirements.
This exemption shall be in effect until revoked. However, should any local enforcement
agent find that the operation of the.TurboChef Model NGC Rapid Cools Oven without
mechanical ventilation creates a sanitation or safety problem, the local enforcement
agent may require the unit to.be used only with mechanical ventilation. These problems
may include, but are not limited to, problems of installation, use, maintenance, cleaning
or other site specific consideration's which exceed the above limitations or pose a
discernable health or.safety hazard.
This letter may be used -as evidence of the evaluation of the TurboChef Model NGC
Rapid Cook Oven. However; it is not to be construed as. an endorsement of the subject
item and may not. be used for advertising or -promotional purposes:

Dear Greg,
During the. course of acquiring tenants and leasing spaces for the new building,
it.became. apparent:,th%at.the, so called "patio" at the east end of the building
Would never -be used as it was originally intended. When that "patio" became
something less than what was its' original purpose. and, further, was forced into a
rectangular shape and decreased in size due to the placement of 1113's. electrical
transformer, we opted to omit the colored concrete. We had no control, as you
well know, over the location of the transformer, .in fact, tried, without success,. to
have it moved. Getting to talk to anyone at IID is difficult but moving a trans-
former after it is located on their, drawings is akin to moving the Rock'of
Gibraltar.
Omitting the color was done.because of the lessened impact on the building and
site, and because it is more consistent with the building across the parking lot.
Our drawings, as well as those of TKC, still call for colored concrete and show
the half -round plan shape of the "patio", however, we will correct those, as well
as all the other construction changes on the "As -built Drawings" (or electronic.
