In order to properly determine and utilize the required applications and allowable exceptions for Alterations in various situations, a thorough and comprehensive understanding of the following sections in this chapter are paramount These sections are designed to walk you through all of the"necessary considerations and Information you will need to establish a basic understanding of the allowable applications. This understanding will allow you to provide for correct accessibility in the vast majority of the situations you will encounter. Alterations which consist only of heating, ventilation, cosmetic work etc., are exempted from accessibility obligations under California's present guidelines. The ADA however, does not exempt these such alterations when they "affect the usabil' of the building or facility". In some cases, the concept of "usability" will require a subjective determination. The ADA does not have a specific definition for this term. A specific example of how this concept could be applied is with an existing storage warehouse in which heating and air conditioning will be added; the building would not be occupiable unless the HVAC was added and therefore the "usability" of the structure would be altered. In this situation, the applicable accessibility requirements for path -of -travel, restrooms, drinking fountains and telephones would need to be addressed. This letter is to inform you that we will be operating a 'Restricted Food -Service Transient Occupancy Establishment" which will be very small and thus qualifies as a "Non -Permitted Facility". It is only one unit, and we expect no more than four to five couples as guests a month. The following conditions will be observed: 1. We have a swimming pool and a spa. However, these will not be heated during the season and will be posted as not available to guests. 2. We will serve a continental breakfast, but all juices, fruit and pastries will be purchased pre- packaged, and throw -away containers will be used for serving.
