ACCESSIBILITY FOR EXISTING BUILDINGS
Alterations
General - All existing buildings and facilities, when alterations, structural repairs or
additions are made to such buildings of facilities, shall comply with all provisions of
Division li New Buildings, except as modified. These requirements shall apply only to
the area of specific alteration, structural repair or addition and shall include those areas
listed below: 1134B.1 '
A primary entrance to the building or facility and the primary path of travel to the
specific area of alteration, structural repair or addition, and sanitary'facilities,
drinking fountains and public telephones serving the area. :41348.2-
NOTE:Projects which consist only of heating, ventilation, air conditioning, reroofing,.-•
electrical work not involving placement of switches and receptacles, cosmetic wort, that
does not affect items regulated by this code, such as painting, carpeting, wallpapering,
etc., are not considered alteration projects forrthe purposes of accessibility for.persons_
with disabilities and shall not be subject to this code unless they affect the.usability_of the
building .or_facility. 1134B.2.1.4-36.402—`
INTERPRETATION: Whenever an alteration to an existing building or
facility is undertaken; this alteration must be designed and constructed to
meet the requirements for new construction. There are also a number of
allowable modifications to the guidelines that may be utilized in specific
situations without requiring a determination of unreasonable hardship.
There are, however, a significant number of exceptions that are allowed
only with a determination of unreasonable hardship. In order to properly
determine and utilize the required applications and allowable exceptions
for Alterations in various situations, a thorough and comprehensive
understanding of the following sections in this chapter are paramount
These sections are designed to walk you through all of the"necessary
considerations and Information you will need to establish a basic
understanding of the allowable applications. This understanding will
allow you to provide for correct accessibility in the vast majority of the
situations you will encounter.
Alterations which consist only of heating, ventilation, cosmetic work etc.,
are exempted from accessibility obligations under California's present
guidelines. The ADA however, does not exempt these such alterations
when they "affect the usabil' of the building or facility". In some cases,
the concept of "usability" will require a subjective determination. The
ADA does not have a specific definition for this term. A specific example
of how this concept could be applied is with an existing storage
warehouse in which heating and air conditioning will be added; the
building would not be occupiable unless the HVAC was added and
therefore the "usability" of the structure would be altered. In this
situation, the applicable accessibility requirements for path -of -travel,
restrooms, drinking fountains and telephones would need to be
addressed.

You may recall that we talked with you a couple of times about operating a very small Bed &
Breakfast in the guest-house at our home. Subsequently, we talked with Donna Vilalta from
your office. We appreciate very much all the assistance and advice received from both of you.
This letter is to inform you that we will be operating a 'Restricted Food -Service Transient
Occupancy Establishment" which will be very small and thus qualifies as a "Non -Permitted
Facility". It is only one unit, and we expect no more than four to five couples as guests a month.
The following conditions will be observed:
1. We have a swimming pool and a spa. However, these will not be heated during the season
and will be posted as not available to guests.
2. We will serve a continental breakfast, but all juices, fruit and pastries will be purchased pre-
packaged, and throw -away containers will be used for serving.
Should we ever plan to expand our facilities, or offer other food -services we will notify ypur-
office and take all proper steps to comply with your regulations.
