The Community Development Department has determined that: 1. This adjustment is not consistent with the intent and purpose of the Zoning Ordinance in that locating the spa and/or mechanical equipment within the five-foot side yard will affect pedestrian and/or emergency personnel access from the front yard to the back yard: 2. There are no special circumstances applicable to the property, including such factors as size, shape, topography, location or surroundings that justify approval of the adjustment. The rear area of the lot is irregularly shaped, however, the accessory improvements can be located in the rear yard to comply with Chapter 9.32 (114) of the Municipal Code which requires a five- foot side yard for mechanical equipment and spas. No special circumstances exist to permit the encroachment. 3.
