The Community Development Department approves your request to install a temporary construction trailer (8' by 20') on the southwest comer of Corporate Center Drive and Dune Palms Road for SDP 2002-756, pursuant to Section 9.100.170 of the Zoning Ordinance, based on the following findings: A. Adequate. on -street parking exists to accommodate guests and employees. No problems are anticipated, which would be detrimental to the community based on the recommended conditions. The following Conditions of Approval shall be met at all times during use of the trailer: 1. This permit is not valid until a building permit is acquired. Please apply to the Building and Safety Department for a permit (760-777-7012). 2. The trailer can remain on-site until November 20, 2004, unless an extension is applied for and granted by this Department. 3. Install .one 2A1 OBC fire .extinguisher inside the building by the exit door, and provide a "Door to remain open during business hours" sign above the exit door.. 4. A sign permit is required for any on-site advertising. 5. Unpaved on-site parking areas shall be watered daily to prevent dust. 6. Mounted_ close to the front door shall be a written notice informing emergency personnel of your 24-hour emergency phone number that they can call in case problems arise that need your prompt attention (i.e., minimum 1" high letters). The Municipal Code can be accessed on the City's Web site by logging onto la- quinta.org. 8., If the trailer is elevated off the ground by support jacks and wheels, a wooden or metal screen . shall encase the undercarriage areas to -eliminate viewing opportunities from adjacent businesses. 9. Use of'the office trailer shall be limited to the hours of construction as listed in the La Quinta Municipal Code (Chapter 6.08, Nuisances). A copy of this time schedule can be obtained at the Building and Safety Department. 10. The applicant agrees to indemnify, defend and hold harmless the City of La Quinta in the event of 'any legal claim or litigation arising out of the City's approval of this project. The City of La Quinta shall have the right to select its defense counsel in its sole discretion. The City may electto add Conditions'to this application request to mitigate any problems that arise not -previously addressed herein. A copy of the conditions. shall be placed inside the trailer during its usage for access by City personnel. This decision may be appealed to the Planning Commission provided the written appeal and filing fee of'$175.00 are submitted to this Department within 15 calendar days.
