OF A CONCRETE WALL ALONG THE SOUTHERLY PROPERTY LINE
Dear Greg:
You may recall that some time ago you very kindly came out to inspect the property
line where I was proposing to put up a new concrete block wall at the south property
line to replace our fall -down wooden fence, at our home at the. Southeast Corner of
Eisenhower & Fernando.
I decided that I wanted to try to get a survey on this property line, since
unfortunately, all of the old monuments and markers appeared to be gone, and we
tried to find somebody for months who was willing to do this little job, to no avail.
We finally spoke with David Weddle, the surveyor who was employed by La Quinta
Golf Estates to survey the new Gate House which has gone up at the Coachella
Entrance off of Eisenhower, and without any charge he dropped by a survey -type
presentation to our home, which he felt was, quite accurate, and I forwarded this to
our next door neighbor whose approval I wanted to get, and he signed off on it.
I was still concerned, however,, and I told David Weddle that I really wanted to
formalize this thing and get him to formally survey that line, and he finally came out
with his instruments and did .so with one of his assistants, and 1 observed him doing
the job, which took a good part of a day.
He was even able to locate the old metal monument marker which was still firmly in
place, although under a small pile of sand, located at the southeast corner of our
lot, and he put a stake to show where it's located.
He also placed a new metal marker in the street, as well as marking a point on our
property at the southwest corner of the property. We paid him $1,000 to do this.

I then called my neighbor, Gerald Osborne, to advise him that we had decided to go
ahead and do a formal type survey and that very visible markers were now in place.
He said that he approved of the wall going in with one half being on his property and
the other half being on our side and to go ahead and pull the Permit. He wondered
whether it would be designed to account for the earthquake factor, and I assured
him that the City would be sure before they issued us a permit that our wall would
meet',the present Code Requirements of the City as to the construction of' such
walls.
I'm writing you to mention the fact that Mr. Edward Strzelczyk of Edward Strzelczyk
Construction Company in Indio, (Business: (760) 347-0399; Cell (760) 578-0201),
the contractor that will be doing the Job for us, will be coming'in to request a
Building Permit to "proceed with the construction of the wall.
I am attaching to this letter copies of what has been provided to us by David Weddle
which he indicated was sufficient for the Cityto provide the Permit, and i wanted to
have something on file with the City showing his work product and the points on the
property which he defined.
You all have been very helpful in the past, and I appreciate your reading through
this.

Rw CONCRETE WAL LICONVERSATION WITH GERALD OSBORNE
As to the concrete wall that we want to install on our southerly property line,
that we've been waiting for so long to do, because we have wanted to be
sure that we were following correctly our property line, and wanted to keep
Gerald Osborne happy, (310) 378-4842. I called Mr. Osbome and told him
that while we had his signature on a survey type document that was done by
David Weddle, saying that it was okay to go forward, I had not felt totally
secure, and decided that I wanted a more formal survey done on the
property.
Mr. Weddle is the surveyor that was selected by La Quinta Golf Estates to do
the surrey on the new Gate Entry/Guard House at the Coachella entrance
on Eisenhower, a difficult job since many of the original survey markers and
monuments had disappeared.
I explained to him that David Weddle had come out with his assistant and
spent a good pert of the day there with his instruments accomplishing this
survey, and in fact, had been. able to find the original metal survey marker at
the southeast comer of our property, which is now marked, as well as a
monument having been placed in the street, and along the curb line so that
we can easily`identify our points along which the wall will be built
I told 'Mr. Osborne that I wanted tD be absolutely sure that it was okay with
him to put one half of the wall on his property and one half on our property.
After some discussion on various issues, one being whether the wall would.
have a sound footing which was up to earthquake standards, and I told him.
that I couldn't answer that specifically in a technical sense, but that we were
using a very fine wall installation outfit, and that the City will demand when
they issue a Building Permit a proper installation that. satisfies all Code
Requirements for such a wall.

He asked which side of the line the palm tares were on. I told him that the
wall would go between the two sets of palm trees, the one set tieing on his
side, and the other set on our side, just like the prior old wooden Hence which
was there.
He said that it sounded okay with him, and that he would trust me, and he
specifically gave me his approval to go forward, without any qualification.
had previously suggested to him in a prior conversation that I would come
down to the desert to meet with him to walk the property at any time, and I
reiterated that l would be happy,to do that at this time and to view the survey
markers, but l guess he felt that thatwas not necessary.
Again, for the record, he gave his approval on September 13, 2006, to go
forward with the wall and pull a Building Permit.

If you agree with this, I will move this forward to obtain a Building Permit to
construct the wall. This will be accomplished at my cost, since I am aware that
you have indicated that you do not wish to participate financially, but it is
certainly something that will enhance your property and add value thereto.
I have enclosed two (2) copies of the survey presentation. If you agree with this,
please sign a copy of this Exhibit and Agreement where it says "Approved and
Accepted", and also print your name underneath, and keep one (1) copy for
yourself..
