Box 2442 Palm Springs, CA 92263 SUBJECT: MINOR USE PERMIT 2010-1020 TEMPORARY TRASH CONTAINER FOR REMODEL PROJECT 51-340 EISENHOWER DRIVE Dear Mr. Ramage: The Planning Department has reviewed' your request to place a temporary trash container at 51-340 Eisenhower Drive, in La Quinta, California. Our Department hereby approves your request subject to the exhibits on file and the following Conditions: 1. The applicant/property owner agrees to defend, indemnify, and hold harmless the City 'of La Quinta (the "City"), it's agents, officers and employees from any claim, or litigation arising out of the City's approval of this project. This indemnification shall include: any award toward attorney's fees. The City of La Quinta shall have the right to select its .defense counsel in its sole discretion. The City of La Quinta shall promptly notify the applicant of any claim, action, or proceeding and shall cooperate fully in the defense. _. 2.. The applicant shall comply with all provisions of the La Quinta Municipal Code (LQMC). 3. The trash container can remain on-site for a three month period (August — November). Unless there is evidence of an extreme extenuating circumstance, the Planning Department may or may not grant an extension for this application. The trash container shall be removed from the site prior to November 20, 2010. w 4. Use of the trash. container is limited to the residential unit under construction as listed in the La Quinta Municipal Code (Chapter 6.08 Nuisances). 5. The trash container shall` be placed on the subject property's driveway, and not in any part of the public right-of-way. The storage container may not be located on the street or on the front lawn. 6. The storage container shall comply with Code Section 9.60.050 Storage and Other Accessory Buildings, and shall comply with Code Section 9.60.210 Construction and Guard Offices. 7. The storage container shall be immediately removed by the authorized disposal service at the applicant's expense if any noxious or nuisance odors are found to emanate from the container. 8. It is the responsibility of the. applicant to ensure that refuse stays within the container by use of a tarp or netting under windy or other adverse weather conditions. 9. The dumpster may not be used to remove hazardous waste. It is the . responsibility of the applicant to' properly dispose of any and all waste. 10. Approval of this Minor Use Permit application will not result in conditions detrimental to public health, safety and general welfare, nor injurious to or incompatible with other properties and uses in the vicinity. The City may elect to add Conditions to this application request to mitigate any problems that: arise not previously addressed herein. This decision may be appealed to the Planning Commission by anyone provided they submit the necessary paperwork and filing fee of $175.00 to this office within 15 days of approval of this permit.
