Builder/property owner agrees to indemnify, defend and hold harmless the City of La Quinta in the event of any legal claim or litigation arising out of the City's approval of this request. The City of La Quinta shall have the right to select its defense counsel in its sole discretion. 2. Building and Safety Department shall verify that a nine foot exterior sideyard setback is provided. This decision may be appealed to the Planning Commission provided the necessary paperwork and filing fee of $175.00 are filed with this office within 15 days.
