The following is the information [provided over the phone: * My address is 50295 Via .Puente.and is located in the planned community of Palmilla (located at the corner of 50th Ave and Jefferson) * RJT Homes is building 2 homes next to my side wall. The home on the side of my property at the rear is the one where I believe a code violation is taking place. * I believe the issue may have 2 code violations. The following is a description of what RJT Homes is 3/28/2005 . . Page 4 of 5 constructing. They build a. side-wall. between my property and the one they are currently building a new home on. The side wall on my side measures approximately 9 ft high. On the other side of the wall, the wall height is 6 ft high. The reason for the difference is obviously a difference in grade, as they are higher up than my property. This wall has existed for approximately 6 months. Two weeks ago, RJT Homes has altered the grading and piled up another 3 feet of dirt up against the wall on the other side of my wall, as they are creating a raised patio for the new home they are building. So essentially, they are turning this wall into a retaining wall (since it must now hold back 6 feet of dirt instead of 3 ft). Holding back this much dirt would require a retaining wall, however, I do. not believe this wall was build as a retaining wall. I am concerned that at some point, the wall could topple over and crush someone on my side of the wall. I believe this is a .code violation. I also believe the fact that they are essentially altering.the height of their backyard against a property line must also be in violation of a building code. I would like to try to solve this issue without getting a lawyer involved, so that is why. Lam trying Building and Safety first. When RJT Homes sold the home to me, this wall .was approximately 9 feet high on my side and 6 feet high on the other side. At the request of the people who will be buying the home on the other side of this wall, RJT Homes has, within the past 2 weeks, backfilled an additional 3 fcct.of dirt and materials against this wall. So, now the wall will be approximately 3 feet high on their side. This will give them full access to view my backyard, which RJT I•Iomes advertised as a private backyard when the property was sold to me. This is my primary concern. I am also concerned about the integrity of this wall, since it was never intended to be a true retaining wall, holding back 6 feet of dirt and materials. I am concerned that it could fall down and crush someone on my side of the wall. `Since this additional material has been backfilled against the wall, the wall has shifted where the seam is. I would appreciate it if RJT IIomes would pull back the materials they added to the other side of my wall. If RJT Homes decides not to pull back this material before they close escrow with the new owners of the property, I will ask that RJT Homes disclose with the new owner of this property that there is a concern from us and that we are considering contacting an attorney.
