The Community Development Department cannot process the attached plans for a detached guest
house at Lake La Quinta for the Weston's because under the R-1 Zoning District provisions all guest
houses with a kitchen require Commission review and approval through a CUP application (Chapter
9.32, LQMC). A copy of the Code is attached. Detached guest houses that propose kitchens shall
be for residents 62=years and older only (i.e., Granny Unit). Please have the applicant or architect
contact our office and we will explain the procedure.
If the stove is removed, the applicant/architect can process through -our staff a Plot Plan application
and pay the filing fee of $75.00 for a detached guest house. The separation between the house and
the detached guest house shall be increased to six -feet in accordance with Chapter 9.32.030. A
setback adjustment application can be processed if the Municipal Code provisions are not being
reduced by more than 20% provided required findings can be made. A copy of the Code is attached.
The developers shall provide a copy of the Grant Deed for the property to verify ownership and so
that we can prepare a deed restriction for this development application as required. Recordation of
this covenant is required to comply with the terms of this section.
Lastly, we need more information from the applicant regarding detached unit architectural
compatibility with the existing house and whether the size of the detached unit is consistent with the
Zoning Code provisions (i.e., site coverage, maximum square footage, etc.). HOA approval is also
required.

This letter is to report approval of the setback adjustment application pursuant to Chapter 9.188 of
the City of La Quinta Planning and Zoning regulations, subject to Conditions and according to -the
attached exhibits.
SETBACK ADJUSTMENT REQUEST: To reduce the building separation between the main
residence and the guest house from 6 -feet to. 5'-411

CONDITIONS: Before building permit issuance for the guest house, the property owner shall file
a Plot Plan application with our Department. The filing fee is $75.00. Besides the application, the
property owner shall provide a copy of the existing Grant Deed so that a covenant agreement can'be
prepared that restricts the use of the guest house according to Chapter 9.32 of the Zoning Code.
Once the covenant is prepared, we require that the owner have the agreement notarized and returned
to staff for recordation with the County of Riverside Recorder's Office. When mailed for
recordation, a building permit can be obtained.
After review it was determined that:
1. This adjustment is consistent with the intent and purpose of the Zoning Ordinance to
allow development of single family houses with guest houses in an R4 District.
There are special circumstances applicable to this property, such as its irregular shape,
that justifies approval of the adjustment. Development of irregular shaped properties
with a house and guest house is more difficult than rectangular shaped lots. The
orientation of the house has been situated on the lot to take advantage of the views
of the Santa Rosa Mountains and existing lake in the gated development. The
architectural design of the guest house is consistent with the main dwelling. A

Dear Mr. Weston
The purpose of this letter is to inform you that your Additon Permit #9605-048, for the project
at 47-325 Via Ravenna, has expired. In accordance with 1994 UBC section 106.4.4, no further
work may be performed until a new permit has been issued.
Please contact Daniel P. Crawford Jr., Building Inspector I, at (760) 777-7012 to obtain any 1
information you need regarding a new permit and/or any required inspections. Should you
choose not to complete the project, we would then have to pursue any or all of the following
actions:
1) Abatement of the project through the City Attorney's Office and Code Compliance Division.
2) Notice of non -conforming structure placed upon property profile.
3) Action filed with Contractor State License Board. Optional if Owner/Builder.
Please contact us at your earliest convenience prior to 10 working days to resolve this issue, and
for any questions you may have.
