Thank you for the recent telephone conversation. Perhaps the following will bring you up to speed on
this issue.
My original plan check correction: "Provide 44" required aisle width between seating in Dining Room as
shown in red on Sheet D1.0 (CBC §11336.6.2)"
Your response from CBC §11046.5, Item 4 says, "...Access to such seating spaces shall be provided
with main aisles not less than 36" clear width." My interpretation of this is that it stipulates a minimum
width of 36", but does not indicate, "...need not exceed 36"." See CBC §1003.3.3.5 for an example of
this type of Code limitation regarding landings not needing to exceed 44" in length. With this
interpretation, other provisions of the Code may impose a more restrictive requirement.
It is my opinion that CBC §11336.6.2 applies in this case because of the scope ("...in which are
installed seats, tables...') stated in CBC §11336.6.1. I believe that CBC §11336.6 also applies in light
of CBC §101.3, where §11048 is the general requirement for aisles at seating and §11336.6 is the
specific requirement due to the aisle serving both sides.
Finally, in using your book as a reference tool, I find the following two pages in support of my original
call. As I mentioned in our telephone conversation, I welcome your input to help me find a valid reason
to tell our client the news he wants to hear. I look forward to hearing back from you.

Chapter 1
ADMINISTRATION
SECTION 101 —TITLE, PURPOSE AND SCOPE
101.1 Title. These regulations shall be known as the Uniform
Building Code, may be cited as such and will be referred to herein
as "this code."
A For the State of California, these regulations shall be known as
A the California Building Code. The provisions contained in the
C California Building Code of the (compiled) California Building
C Standards Code as defined in Section 18910, Health and Safety
C Code, may be cited as such and are referred to hereafter as "these
C regulations" or "these building standards" or "this code. "
101.2 Purpose. The purpose of this code is to provide minimum
standards to safeguard life or limb, health, property and public
welfare by regulating and controlling the design, construction,
quality of materials, use and occupancy, location and maintenance
of all buildings and structures within this jurisdiction and certain
equipment specifically regulated herein.
The purpose of this code is not to create or otherwise establish or
designate any particular class or group of persons who will or
should be especially protected or benefited by the terms of this
code.

101.3 Scope. The provisions of this code shall apply to the
construction, alteration, moving, demolition, repair, maintenance
and use of any building or structure within this jurisdiction, except
work located primarily in a public way, public utility towers and
poles, mechanical equipment not specifically regulated in this
code, and hydraulic flood control structures.
For additions, alterations, moving and maintenance of build-
ings and structures, see Chapter 34. For temporary buildings and
structures see Section 3103 and Appendix Chapter 31.
Where, in any specific case, different sections of this code spec- r
ify different materials, methods of construction or other require
ments, the most restrictive shall govern. Where there is a conflict
between a general requirement and a specific requirement, the
specific requirement shall be applicable..
Wherever in this code reference is made to the appendix, the
provisions in the appendix shall not apply unless specifically
adopted.
A 101.3.1 The provisions of the model codes which are adopted by

101.4 Effective Date.
101.4.1 One hundred and eighty days after the date of publica-
tion, or as otherwise noted herein.
NOTE: For clarification purposes, the applicable subsection of the
Health and Safety Code section is repeated.
Sec. 18938. Application and Effective Date. The building stan-
dards contained in the Uniform Fire Code, published by the Inter-
national Conference of Building Officials and the Western Fire
Chiefs Association, the Uniform Building Code published by the
International Conference of Building Officials, the Uniform
Plumbing Code published by the International Association of
Plumbing and Mechanical Officials, the National Electrical Code
published by the National Fire Protection Association, the Uni-
form Mechanical Code published by the International Conference
of Building Officials, as referenced in the California Building
Standards Code, shall apply to all occupancies throughout the
state and shall become effective 180 days after publication in the
California Buildings Standards Code by the California Building
Standards Commission, or at a later date after publication estab-
lished by the commission.
101.5 Format. This part fundamentally adopts the UBC by ref-
erence on a chapter -by -chapter basis. Such adoption is reflected
in the adoption table of each chapter of this part. When the adop-
tion table of a chapter of this part makes no reference to a specific
chapter of the UBC, such chapter of the UBC is not adopted as a
portion of this code.
101.6 Validity. If any chapter section, subsection, sentence,
clause or phrase of this code is for any reason held to be unconsti-
tutional, contrary to statute, exceeding the authority of the state as
stipulated by statutes, or otherwise inoperative, such decision
shall not affect the validity of the remaining portion of this code.
101.7 Standard Reference Documents. The codes, standards
and publications adopted and set forth in this code, including
other codes, standards and publications referred to therein are, by
title and date of publication, hereby adopted as standard reference
documents of this code.
When this code does not specifically cover any subject relating
to building design and construction, recognized fire -prevention
engineering practices shall be employed. The National Fire
Codes and the Fire Protection Handbook of the National Fire Pro-
tection Association may be used as authoritative guides in deter-
mining recognized fire -prevention engineering practices.
101.8 Nonbuilding Regulations. Requirements contained in the
UBC, or in any other referenced standard, code or document,
which are not building standards as defined in Section 18909,
Health and Safety Code, shall not be construed as part of the pro-
visions of this code.
For the applicability of regulations relating to maintenance,
operation, use, limitations or prohibitions, and similar nonbuild-
ing regulations, see other titles of the California Code of Regula-
tions.
101.9 Order of Precedence.
101.9.1 General. In the event of any differences between these
building standards and the standard reference documents, the text
of these building standards shall govern. Where a specific provi-

the handrail shall be free of sharp or abrasive elements. Edges
shall have a minimum radius of 1/8 inch (3 mm).
EXCEPTIONS: 1. Handrails at ramps immediately adjacent to
fixed seating in assembly areas are not required.
2. Ramps that require handrails and that serve one individual
dwelling unit in Group R. Division I or 3 Occupancies may have one
handrail except that such ramps open on one or both sides shall have
handrails provided on the open side or sides.
3. Curb ramps do not require handrails.
1133B.5.6 Wheel guides. Where the ramp surface is not bounded
by a wall or fence and the ramp exceeds 10 feet (3048 mm) in
length, the ramp shall comply with one of the following require-
ments.
1133B.5.6.1 A guide curb a minimum of 2 inches (51 mm) in
height shall be provided at each side of the ramp; or
11338.5.6.2 A wheel guide rail shall be provided, centered
3 inches (76 mm) plus or nninus 1 inch (25 mm) above the surface
or the ramp.
1133B.5.7 Ramps more than 30 inches (762 mm) above the adja-
cent ground shall be provided with guardrails as required by Sec-
tion 509, and handrails as required in Section 1003.3.4.6. Such
guardrails shall be continuous from the top of the ramp to the bot-

1133B.6 Aisles. {
1133B.6.1 General. Every portion of every building in which are
installed seats, tables, merchandise, equipment or similar materi-
als shall be provided with aisles leading to an exit.
1133B.6.2 Width. Every aisle shall not be less than 36 inches
(914 min) wide if serving only one side, and not less than 44 inches
(1118 mm) wide if serving both sides.
1133B.7 Walks and Sidewalks.
1133B.7.1 Continuous surface. Walks and sidewalks subject to
these regulations shall have a continuous common surface, not in-
terrupted by steps or by abrupt changes in level exceeding1/2 inch
(12.7 mm) (see Section 1133B.7.3), and shall be a minimum of
48 inches (1219 mm) in width. Surfaces shall be slip -resistant as
follows:
11338.7.1.1 Slopes less than 6 percent. Surfaces with a slope of
less than 6 percent gradient shall be at least as slip -resistant as
that described as a medium salted finish.
1133B.7.1.2 Slopes 6 percent or greater. Surfaces with a slope of
6 percent gradient shall be slip -resistant.
1133B.7.1.3 Surface cross slopes. Surface cross slopes shall not
exceed 1/4 inch (6 mm) per foot except when the enforcing agency
finds that due to local conditions it creates an unreasonable hard-
ship, the cross slope shall be increased to a maximum of 1/2 inch
(12.7 mm) per foot for distances not to exceed 20 feet (6096 mm)
(2.5% gradient). ,
EXCEPTION. When, because of right-of-way restrictions, natural
barriers or other existing conditions, the enforcing agency determines
that compliance with the 48 -inch (1219 mm) clear sidewalk width
would create an unreasonable hardship, the clear width may be re-
duced to 36 inches (914 min).
1133B.7.2 Gratings. Walks, sidewalks and pedestrian ways shall
be free of gratings whenever possible. For gratings located in the
surface of any of these areas, grid openings in gratings shall be
limited to 1/2 inch (12.7 mm) in the direction of traffic flow.

1133B.7.3 Five percent gradient. When the slope in the direction
of travel of any walk exceeds I unit vertical to 20 units horizontal
(5%a gradient), it shall comply with the provisions of Section
1133B.5.
1133B.7.4 Changes in level. Abrupt changes in level along an)-
accessible
nyaccessible route shall not exceed 1/2 inch (12.7 nnn). When
changes in level do occur, they shall be beveled with a slope no
greater than 1 unit vertical to 2 units horizontal (50%), except that
level changes not exceeding 1/4 inch (6 mm) may be vertical.
When changes in levels greater than 1/2 inch (12.7 nun) are nec-
essary, they shall comply with the requirements for curb ramps.
NOTE: See Section 1127B.5.
1133B.7.5 Level areas. Walks shall be provided with a level area
not less than 60 inches by 60 inches (1524 mm by 1524 nnn) at a
door or gate that swings toward the walk, and not less than
48 inches wide by 44 inches (1219 iron by 1118 mm) deep at a door
or gate that swings away from the walk. Such walks shall extend
24 inches (610 mm) to the side of the strike edge of a door or gate
that swings toward the walk. (For example, see Figure JIB -26B.)
1133B.7.6 Walks with continuous gradients. All walks with con-
tinuous gradients shall have level areas at least 5 feet (1524 mm)
in length at intervals of at least even, 400 feet (121 920 nnn).
1133B.8 Hazards.
1133B.8.1 Warning curbs. Abrupt changes in level, except be-
tween a walk or sidewalk and an adjacent street or driveway, ex-
ceeding 4 inches (102 mm) in a vertical dimension, such as at
planters or fountains located in or adjacent to walks, sidewalks or
other pedestrian ways, shall be identified by curbs projecting at
least 6 inches (152 nim) in height above the walk or sidewalk sur-
face to warn the blind of a potential drop off.
When a guardrail or handrail is provided, no curb is required
when a guide rail is provided centered 3 inches (76 nim) plus or
minus 1 inch (25 nim) above the surface of the walk or sidewalk,
the walk is 5 percent or less gradient or no adjacent hazard exists.
1133B.8.2 Overhanging obstructions. Anv obstruction that
overhangs a pedestrian's way shall be a minimum of 80 inches
(2032 mm) above the walking surface as measured from the bot-
tom of the obstruction. Where a guv support is used parallel to a
path of travel, including, but not limited to, sidewalks, a guy brace,
sidewalk guy or similar device shall be used to prevent an over-
hanging obstruction as defined (see Figure 11B-28).
Hazards such as drop-offs adjacent to walk ways or overhang-
ing obstructions can be dangerous to persons with sight problems.
This section addresses these .situations.
1133B.8.3 Detectable warnings at transit boarding platforms.
Transit boarding platforms shall have a detectable warning tex-
ture extending the full length of the loading area. This detectable
warning texture shall have the following features:
Width 24 to 36 inches (610 nun to 914 mm) placed at the edge of
the drop-off or safe area.
Durable, slip -resistant material having a surface texture com-
posed of raised, truncated domes in a staggered pattern with a di-
ameter of nominal 0.9 inch (22.88 nim) at the base tapering to 0.45
inch (11.4 mm) at the top, a height of nonninal 0.2 inch (5.08 mm),

1104B.4.2 Ticket booth. The customer' side of a ticket booth
shall be, and the employee side may be, accessible.
1104B.4.3 Participation areas. Participation areas shall be ac-
cessible to persons with disabilities, including the following listed
and similar activity areas:
1. Tennis, racquetball and handball courts.
2. Gymnasium floor areas and general exercise rooms.
3. Basketball, volleyball and badminton courts, and bowling
lanes.
4. Swimming pool deck areas must be accessible and an assist-
ing device provided to assist persons with disabilities in gaining
entry into the pool.
5. Athletic team rooms and facilities, playing fields and run-
ning tracks.
1104B.4.4 Clubrooms. Clubrooms shall be made accessible to
persons with disabilities.
1104B.4.5 Sanitary and locker facilities. Where spectator and/
or participant sanitary and/or locker facilities are provided, they
shall conform with the requirements in Sections 11158 and 1116B.
EXCEPTIONS: 1. Where the enforcing agency determines that
compliance with these regulations would create an unreasonable hard-
ship, an exception may be granted when equivalent facilitation is pro-
vided through the use of other methods or materials.
2. In existing buildings, when the enforcing agency finds that com-
pliance with regulations would create an unreasonable hardship, an
exception may be granted when all of the following minimum condi-
tions are mer.
2.1 When the total seating does not exceed 5,000 at least I per-
cent of such seating shall be accessible to and usable by per-
sons with disabilities. When the total seating provided
exceeds 5,000, one additional seat for each 2,000 seats pro-
vided over 5,000 shall be accessible to and usable by per-
sons with disabilities.
2.2 Sanitary facilities, ticket booths, clubrooms, concessions
and refreshment facilities are accessible.
2.3 One of each type of participation area is usable and accessi-
ble.

1. General. Dining, banquet, and bar facilities shall be made
accessible to persons with disabilities as provided in this section.
EXCEPTIONS: 1. In existing buildings,' when the enforcing

granted when equivalent facilitation is provided.
2. In existing buildings, these regulations shall not apply when
legal or physical constraints would not allow compliance with these
regulations or equivalent facilitation without creating an unreason-
able hardship. See Section 101.17.11, item 4.
2. Entrance. Access to these facilities shall be provided at en-
trances and exits as required by Section 1133B.1.1.
3. Functional activity. Wheelchair access shall be provided
to all areas where each type of functional activity occurs.

wheelchair seating space for each 20 seats, with at least one mini-
mum wheelchair seating space per functional area. Such seating
shall be designed and arranged to permit use by wheelchair occu-

Seating, Tables, and Counters. ",-Access to such; seating spaces,,.
shall be provided with main aisles not less'than 36 inches (914
mni),clear width..Accessible seating spaces shall be integrated
With general seating to allow a reasonable selection of seating
area and to avoid having one.area specifically highlighted as the
area for persons with disabilities. The ratio of accessible seating
is based on the total number of seats provided.
5. Food service aisles. Food service aisles shall be a minimum
of 36 inches (914 mm) of clear width with a preferred width of
42 inches (1067 min) where passage of stopped wheelchairs by pe-
destrians is desired. Trav slides shall be mounted no higher than
34 inches (864 inn) above the floor. 1f self-service shelves are pro-
vided, a reasonable portion must be within the ranges shown in
Figure 11B-16.
6. Tableware areas. Tableware, dishware, condiments, food
and beverage display shelves, and dispensing devices shall com-
ply with Section 1122B.4. See Figure 11B-17.
7. Restrooms. Restroom and powder rooms shall conform to
requirements in Section 1115B.
8. Food preparation areas. Access to food preparation areas
shall comply with the provisions.for entrance doors and doorways
in Section 1004, and aisles in Sections 1004.3.2.1 and 1004.3.2.2.
1104B.6 Religious Facilities.
1104B.6.1 General. Religious facilities .shall be made accessi-
ble to persons with disabilities as provided in this section.
EXCEPTION: In existing buildings, when the enforcing agency
determines that compliance with any regulation under this section
would create an unreasonable hardship, an exception shall be granted
when equivalent facilitation is provided.
1104B.6.2 Sanctuary. Sanctuary areas shall be made accessible
to persons with disabilities.
11048.6.2.1 Wheelchair seating spaces in these areas shall con-
form to the requirements in Section 1104B.3.1.
1104B.6.2.2 Wheelchair access shall be provided to raised plat-
forms, choir rooms, choir lofts, performing areas and other simi-
lar areas.
EXCEPTION: In existing buildings, these regulations shall not ap-
ply to choir lofts when the enforcing agency determines that such com-
pliance would create an unreasonable hardship.
1104B.6.3 Assembly areas. Assembly areas shall be made ac-
cessible to persons with disabilities. Enclosed and unenclosed
platforms and stages in assembly areas shall conform to these re-
quirements.
1104B.6.4 Classrooms and offices. Classrooms and offices
shall have entre doors that conform to the requirements in Chap-
ter 10.
1104B.6.5 Sanitary facilities. Sanitary facilities shall conform
to the requirements in Section 1115B.

CONDITIONS OF APPROVAL
1. Upon approval by the Planning Commission, a memorandum noting that the City
Conditions of Approval for this application exist and are available for review at
City Hall shall be recorded against the property with Riverside County.
2. The Site Development Permit shall be used (beginning of construction) by
January 9, 2002, pursuant to Section 9.200.080 of the Municipal Zoning Code,
unless a one year time extension is granted, prior to expiration.
3. The proposed restaurant development shall comply with all applicable conditions
of Specific Plan 96-027.
4. Parking lot light standards shall match those used in the construction of Phase
1 of the Shopping Center and not exceed 25 -feet in overall height pursuant to
Condition 2 of .Specific Plan 96-027.
5. Prior to the issuance of a grading, improvement or building permit, the applicant
shall obtain permits and/or clearances from the following public agencies:
• , Fire Marshal
• Public Works Department (Grading Permit, Improvement Permit)
• Community Development Department
• Riverside County Environmental Health Department
• Desert Sands Unified School District (DSUSD)
• Coachella Valley Water District (CVWD)

The applicant is responsible for any requirements of the permits or .clearances
from those jurisdictions. If the requirements include approval of improvement
plans, applicant shall furnish proof of said approvals prior to obtaining City
approval of the plans.
The applicant shall. comply with applicable provisions of the City's NPDES
stormwater discharge permit. For projects requiring project -specific NPDES

acknowledgment of the applicant's Notice of Intent prior to issuance of a
grading or site construction permit. The applicant shall ensure that the required
Storm Water Pollution Protection Plan is available for inspection at the project
site.
6. Developer agrees to indemnify, defend and hold harmless the City of La Quinta
in the event of any legal claim or litigation arising out of the City's .approval of
this project. The City of La Quinta shall have the right to select its defense
counseHn its sole discretion.
7. The applicant shall vacate abutter's rights of access to public streets from all
frontage along the streets and properties except access drives described herein.
8. The applicant shall dedicate or grant public and private street right of way and
utility easements in conformance with the City's General Plan, Municipal Code,
applicable specific plans, and as required by the City Engineer.
9. The applicant shall dedicate ten -foot public utility easements contiguous with
and along both sides of all private streets. The easements may be reduced to
five feet with the express concurrence of IID.
10. The applicant shall dedicate easements necessary for placement of and access
to utility lines and structures, drainage basins, mailbox clusters, park lands, and
common areas.
11. The applicant shall furnish proof of easements or written permission, as
appropriate, from owners of any abutting properties on which grading, retaining
wall construction, permanent slopes, or other encroachments are to occur.
12. If the applicant proposes vacation or abandonment of any existing rights of way
or access easements which will diminish access rights to any properties owned
by others, the applicant shall provide approved alternate rights of way or access
easements to those properties or notarized letters of consent from the property
owners.
As used throughout these conditions of approval, professional titles such as
"engineer," "surveyor," and "architect" refer to persons currently certified or licensed
to practice their respective professions in the State of California.

13. Improvement plans shall be prepared by or under the direct supervision of
qualified engineers and landscape architects, as appropriate. Plans shall be
submitted on 24" x.36" media.
14. This development shall comply with Chapter 8.11 of the LQMC (Flood Hazard
Regulations). If any portion of any proposed building lot in the development is
or may be located within a flood hazard area as identified on the City's Flood
Insurance Rate Maps, the development shall be graded to ensure that all floors
and exterior fill (at the foundation) are above the level of the project 0 00 -year)
flood and building pads are compacted to 95% Proctor Density as required in
Title 44 of the Code of Federal Regulations, Section 65.5(a) (6). Prior to
issuance of building permits for lots which are so located, the applicant shall
furnish certifications as required by FEMA that the above conditions have been
met.
15. Prior to issuance of a grading permit, the applicant shall furnish a preliminary
geotechnical ("soils") report and an approved grading plan prepared by a
qualified engineer. The grading plan shall conform with the recommendations
of the soils report and be certified as adequate by a soils engineer or engineering
geologist.
A statement shall appear on final maps (if any are required of this development)
that a soils report has been prepared pursuant to Section 17953 of the Health
and Safety Code.
16. Slopes shall not exceed 5:1 within public rights of way and 3:1 in landscape
areas outside the right of way unless otherwise approved .by the City Engineer.
17. Prior to occupation of the project site for construction purposes, the applicant
shall submit and receive approval of a fugitive dust control plan prepared in
accordance with Chapter 6.16, LQMC. The Applicant shall furnish security, in
a form acceptable to the city, in an amount sufficient to guarantee compliance
with the provisions of the permit.
18. The applicant shall maintain graded, undeveloped land to prevent wind and
water erosion of soils. The land shall be planted with interim landscaping or
provided with other erosion control measures approved by the Community
Development and Public Works Departments.

19. Prior to issuance of building permits, the applicant shall provide building pad
certifications stamped and signed by qualified engineers or surveyors. For each
pad, the certification shall list the approved elevation, the actual elevation, the
difference between the two, if any, and pad compaction. The data s.hpll be
organized by lot number and listed cumulatively if submitted at differentes.
DRAINAGE
20. Stormwater drainage shall comply with the approved Hydrology Plan for the
Jefferson Plaza Shopping Center.
21. Nuisance water shall be retained and disposed of on-site in an approved facility.
The facility shall be designed to infiltrate five gallons per day per 1,000 square
feet ('of landscape area) and to accommodate a surge rate of three gallons per
hour per 1,000 square feet.
UTILITIES
22.. To ensure optimum placement for practical and aesthetic purposes, the
applicant shall obtain the approval of the City Engineer for the location of all
utility lines within the right of way and all above -ground utility structures
including, but not limited to, electrical vaults, water valves, and telephone
stands.
23. All proposed utilities within or adjacent to the proposed development shall be
installed underground.
24. Utilities shall be installed prior to overlying hardscape. For installation of utilities
in existing, improved streets, the applicant shall comply with trench restoration
requirements maintained or required by the City Engineer.. The applicant shall
provide certified reports of trench compaction for approval of the City Engineer. .

25. Parking lot design shall conform with the City's Off -Street parking Ordinance as
delineated in Chapter 9.150 of the LQMC.
26. The applicant may be required to extend improvements beyond development
boundaries to ensure they safely integrate with existing improvements (e.g.,
grading; traffic control devices and transitions in' alignment, elevation or
dimensions of streets. and sidewalks).

27. The applicant shall design street pavement sections using Caltrans' design
procedure (20 -year life) and site-specific data for soil strength and anticipated
traffic loading (including construction traffic). Minimum structural sections shall

28. The applicant shall provide landscaping in required setbacks, retention basins,
common lots, and park areas.
29. Landscape and irrigation plans shall be signed and stamped by a licensed
landscape architect. -
The applicant shall submit plans for approval by the Community Development
Department prior to plan checking by the Public Works Department. When plan
checking is complete, the applicant shall obtain the signatures of CVWD and the
Riverside County Agricultural Commissioner prior to submitting for signature by
the City Engineer. Plans are not approved for construction until signed by the
City Engineer.
30. Landscape areas shall have permanent irrigation improvements meeting the
requirements of the City Engineer. Use of lawn shall be minimized with no lawn
or spray irrigation within 18 inches of curbs along public streets.
31. Landscaping within the Jefferson Plaza Shopping Center shall be commonly
maintained under a single maintenance contract pursuant Condition 59 of
Specific Plan 96-027.
32. Prior to building permit issuance, the applicant shall submit to the Community
Development Department for review and approval a landscape and irrigation
plan showing the following:
A. African Sumac trees shall replace Olive trees to match the existing
parking lot trees at the Home Depot facility (24" box with 2.5" caliper).
B. A minimum of three California Fan Palms, averaging 20 feet high, shall
be installed at the southeast side of the parking lot to conform with the
City's Highway 1 1 1 Landscape Guidelines in lieu of installing new shade
trees at this location. These parkway palm trees shall be uplighted with

E. Parking lot trees shall be 24" box tree or larger with 2-1/2" to 3"
diameter (caliper) trunks pursuant to Condition 60 (D) of SP 96-027.
Newly planted trees shall be staked with lodge poles to prevent damage ,
from gusts of wind, etc.
F. The parking lot shall be screened by using a combination of berms, walls,
and landscaping so that the vehicles will not be visible from Highway
1 1 1, consistent with requirements identified in SP 96-027 (i.e., Condition
61) and Chapter 9.150 (Parking) of the Zoning Ordinance. The height
of, the screen wall for the drive-through lane shall be measured from the
curb height.
G. A low profile wall (two foot high) shall be constructed. along the west
property line to ensure blowing sand does not overrun and destroy the
landscaping improvements adjacent to the drive-through lane.
H. Replace the turf areas north of the building with less demanding water
use.materials (i.e., desertscape).

33. The applicant shall employ construction quality -assurance measures which meet
the approval of the City Engineer.
34. ' The applicant shall employ or retain qualified civil engineers, geotechnical
engineers, surveyors, or other appropriate professionals to provide sufficient
construction supervision to be able to furnish and sign accurate record
drawings'.

35. The applicant shall arrange and bear the .cost of measurement, sampling and
testing procedures not included in the City's inspection program but required by
the City as evidence that construction materials and methods comply with
plans, specifications and applicable regulations.
36. The applicant shall make provisions for continuous, perpetual maintenance of
all on-site improvements, perimeter landscaping, access drives, and sidewalks.
FEES AND DEPOSITS
37. The applicant shall pay the City's established fees for plan checking and
construction inspection. Fee amounts shall be those in effect when the
applicant makes application for plan checking and permits.
38. - Prior to on-site grading or building permit issuance, Fringe -toed Lizard mitigation
fees shall be paid to the City (i.e., 5600.00/acre) unless proof of payment can
.be provided to the Community Development Department.
39. A plan check fee must be paid to the Fire Department at the time building plans
are submitted.
40. Provisions shall be•made to comply with the terms and requirements of the
City's adopted Infrastructure Fee program in effect at the time of issuance of
building permits.
41. Prior to sign permit issuance, the following sign modifications shall be made,
subject to approval of the Community Development Director:
A: Directional signs for the drive-through lane shall be limited to three square
feet per Table 9-17 of the Sign Ordinance, and the sign copy shall read
"Drive-thru" with directional arrow. The logo shall be deleted.
B. One of the three building mounted signs shall be deleted.
C. Only one freestanding menu board sign is permitted, unless otherwise
determined by the Community Development Department based on a
survey of other existing fastfood restaurants on Highway 1 1 1. All menu
board signs shall have monument bases.

42. Complete building plans will be required for review and approval by the Fire
Department prior to issuance of building permits.
43. Fire hydrants in accordance with Coachella Valley Water .District (CVWD)
Standard W-33 shall be located at each street intersection spaced not more than
330 feet apart in any direction, with no portion of any lot frontage more than
165 feet from a fire hydrant. Minimum fire flow shall be 2,000 g.p.m. for a 2 -
hour duration at 20 psi. Blue dot reflectors shall be mounted in the middle of
the streets directly in line with the fire hydrants.
44. Prior to the issuance of a building permit, the applicant/developer shall furnish
one blue line copy of the water system plans to the Fire Department for review
and approval., Plans shall conform to the fire hydrant types, location and
spacing, and the system shall meet the fire flow requirements. Plans must be
signed by a registered Civil Engineer and the local water company with the
following certification: "I certify that the design of the water system is in
accordance with the requirements prescribed by. the Riverside County Fire
Department."
45. The required water system including fire hydrants will be installed and accepted
by the appropriate water agency prior to a.ny combustible building material being .
placed on an individual lot.
46. Final conditions will be addressed when building plans are reviewed. All
questions regarding the meaning of these conditions should be referred to the
Fire Department Planning and Engineering staff at (760) 863-8886.
MISCELLANEOUS
47. The developer shall provide a bicycle rack at the front of the building pursuant
to Section 9.150.060(D3b) of the Zoning Ordinance. The rack shall
accommodate a minimum of five bicycles and be shaded by building and/or
landscape features.
48. Landscape and irrigation improvements in the Highway 1 1 1 parkway and on-site
shall be repaired and/or replaced prior to a final inspection'.
