'spa/water feature, barbecue island and fire pit. The existing patio is to .be removed, extended and replaced with broom -finished concrete in*Mesa Buff color. The proposed project, as shown on the revised plan submittal date stamped July 16, 2013, prepared by Competitive West Pools, is acceptable'in accordance with the Architectural Guidelines, Association's CC&R's, and Maintenance and IndemnityAgreement Please note this acceptance is subject to conditions as noted elsewhere in this letter. The following conditions and/or requirements are pertinent and subject to the acceptance. 1. All landscaping repairs and new landscaping are to be approved by the landscape manager and must be based on a contractor prepared landscape plan. Please submit a plan for review. 2. The HOA has advised the adjacent homeowner at 54-648 Inverness that this project will not disturb the existing landscape between the units. The intent is to maintain the existing landscape used for visual privacy and maintain the existing views. The existing trees and shrubbery will be tagged to assure their protection. 3. There is a large California Pepper tree on the east side of the patio that will have to be removed. No replacement is necessary. It is understood that the adjacent homeowner is aware of the Pepper tree removal. 4. The homeowner is to minimize the step down condition at the patio slab edge to the existing sloping lawn surface. The HOA is not responsible for reviewing this condition or any resulting actions. 5. The contractor is responsible for providing proper patio drainage for all new concrete hardscape. 6. Prior to the start of any work, provide a signed set of plans, stamped by the City of La Quinta, and the. city issued permit. 7. Proof of the contractor's current auto insurance to be submitted directly to the HOA from the insurance carrier prior to the start of any work. 8. The homeowner and the contractor to schedule a meeting with the Landscape/Irrigation Manager, Bill Bobbitt, and the Maintenance/Lighting Manager, William Aceves, prior to the start of any work. Any electrical wiring exposed during construction must be reported to the Association. 13. All modifications to the existing sprinkler system, landscaping and drain work are to be made by the contractor, to the satisfaction of the HOA. - 14. The contractor is not allowed to stockpile any material, equipment or construction debris in the street. All debris must be cleaned up daily. 20. The street gutters cannot be used for concrete wash out and the contractor is responsible for keeping the gutter clear and free of debris. Streets are to be cleaned daily. 21. Upon completion, the homeowner is required to provide a signed copy of the city inspection card and the Contractor Certification letter (enclosed). 22. The homeowner and the contractor to schedule a meeting with the landscape/irrigation manager and the maintenance manager prior to submitting a Notice o Completion form 23. The project should be completed within 45 days of starting. 24. The Committee's review is only for the architectural implications of the project. All codes, legal and engineering are the responsibility of the homeowner and contractor. 25. A Maintenance and Indemnity Agreement shall be signed prior to the start of work and reviewed at the completion of the project. Same shall delineate all applicable work, which current and future owners shall be compelled to solely maintain and/or replace as needed and the document shall be recorded with the County of Riverside and runs with the land.
