AGREEMENT FOR FINANCING.PUBLIC SCHOOL FACILITIES
WITHIN THE COACHELLA VALLEY UNIFIED SCHOOL DISTRICT
1. PARTIES AND DATE.
This Agreement i,s entered into this 19th day of December
19 8-6 , between the COACHELLA.VALLEY .UNIFIED SCHOOL DISTRICT of RIVERSIDE
COUNTY, CALIFORNIA, a political.subdivision of the State of California
(,hereinafter "District"), and Ronald W. Russell and Linda F.. - Russel I ,
x Husba.nd.and Wife, as Joint Tenants
partnership, corporation or other form of business entity
(hereinafter "Developer")'.
2. RECITALS.
2.1 Developer plans to build residential dwellings within
District, whose educational facilities will be inadequate to serve the pupils
so generated if this Agreement is not executed and performed.
2.2 Developer is presently seeking approval from the
City of La.Quinta of Tentative .Lot 27, Tract No. 20717-2
Parcel or Tract
Map No.Bk.153,pgs in order to proceed with such residential development.

2.3 The location of public schools with adequate capacity
near Developer's proposed residential development would substantially enhance
the possibilities of selling the dwellings in such residential development.
2.4 District is wil-ling to cooperate with Developer in locating
interim or permanent,public school buildings and facilities to serve Developer's
proposed residential development for the benefit of the children assigned by
District to use such buildings and facilities.
2.5 Developer desires to assist District in mitigating the
impaction its residential construction would cause by paying to District a
sum of money to be used for such purposes.

3. TERMS.
•
3.1 Developer shall pay to District, prior to issuance of
any building permits for lots in Lot 27, Tract No. 20717-2
Parcel or Tract
Map No Bk 1531-.pgs the sum of $62x8.00 for each residential unit

to be constructed. The parties agree that this amount is necessary to
provide educational facilities for any and all school-age children anticipated
to live in Developer's residential development.
Funds paid to District will be deposited by District in a
separate, exclusive account, and -disbursements therefrom shall be solely for
the procurement of public school facilities at District's discretion.
3.2 Developer shall,"concurrent with requesting any necessary
written assurances from District, inform the City of La.Quinta
of this.arrangement for mitigating the impacts'of its project, and shall request
in writing that the City of La Quinta include in any approval
-of Developer's -subdivision map a condition that Developer and its successors
or assigns provide.evidence of compliance with the terms of this Agreement
prior to issuance of any building permits by the City.of La Qu.inta ,
or its successor, for lots in the approved subdivision.
..3.3 Developer shall notify any successor or assign that this
Agreement has been executed and is in effect.
3.4 Insofar as is legally.possible, District shall provide
suitable public school•buildings and facilities which, in the discretion of
the District, are deemed adequate to serve the needs of the residents of
Developer's residentialdevelopment on a site determined by District.
3.5 District shall staff an educational program in these buildings
and facilities.
3.6 District shall maintain the buildings and facilities in a
serviceable condition for the District's use and shall carry its usual fire,

property damage, and public liability insurance .to cover such buildings and
facilities and -District's activities at the site.
3.7 District shall not interpose any objection to Developer's
residential development on the ground that District public school buildings
and facilities are not adequate to serve the residents of such residential
development, and, upon request of Developer, will provide written assurances
of same to any public agency.
3.8 District shall make available to the general public and to
Developer, upon request, an annual record of funds received and disbursements
made.under the terms of this and similar agreements.
3.9 Good, valuable, and adequate consideration exists in the mutual
benefit which Developer and District hereby agree results from entering into
and fulfilling this Agreement.
3:10 Legal title to all buildings and.facilities constructed or
erected as a resul.t of this Agreement shall remain in the District, its
successors or assigns.
3.11 The law of the State -of California governs the interpretation
of the Agreement, and any litigation brought because of or involving this
Agreement shall be initiated.exclusively in the courts of the State of California.
3.1.2 In the event that, subsequent to execution of this Agreement,
State or local law is amended .to require developers to donate land or pay fees
for construction of schools, the obligations of_Developer and District herein
shall be offset to the extent of any amounts paid by Developer to District or
the value of land donated to District, -insofar as permitted by law.
3.13 In the event that Developer's subdivision map set forth above
is not approved by the City of La Quinta all
obligations of Developer and District herein shall cease.

3.14 All terms, conditions, and provisions hereof shall insure
to and shall bind the parties hereto, their respective successors -in -interest
and assigns.
3.15 Should any legal action be brought for the purpose of protecting
or enforcing its rights under this Agreement, the prevailing party shall recover,
in addition to all other relief, its attorney's fees and court costs as set by
the Court.

at PGA WEST has an Architectural Committee that will
be reviewing both the preliminary plans and working

this letter as our formal request that the City.not. .
accept an application for plot plan review without the
approval of the preliminary plan by the Architectural
Committee; said approval to the evidenced by a stamped
approval by the Committee. Similarly, we request that
the City not accept the building plans for plan check
until the Committee has approved the building plans,
also evidenced by a stamped approval by the Committee.
