In January 1992, Public Works issued a dirt stock pile 'permit (#1352) to Amcor Realty III
authorizing Tarmac to stock pile dirt on the subject property. The City received a$7,000 check
as security for installation of soil erosion measures. The soil erosion measures were never
implemented and according to Geniene in Finance, the City has not refunded the $7,000.
I spoke to Fred Behrens (398-9520) with Amcor today regarding the unfulfilled soil erosion
control requirement and the related $7,000 in cash security that we currently are holding. I
mentioned we have two options: 1) they install the erosion control measures at there expense and
obtain a full refund from the City, or 2) have the City administer implementation of the erosion
control measures and draw down on the $7,000 that we have on hand.
Mr. Behrens expressed an interest in having Amcor administer implementation of the control
measures instead of the City. He indicated he will have his partner, Bob Wright, call. you
tomorrow or early. next week to discuss what is needed.

ENCROACHMENT PERMIT CONDITIONS

In addition to the other, conditions for the subject grading permit, the following requirements shall apply:
1. Permit is issued for the sole purpose of placing import fill material in a stockpile.
2. The location and configuration of the stockpile shall be as approved by the City Engineer. The
stockpile shall be located so it will not interfere with any natural or existing drainage course.
3. Prior to beginning construction, permittee shall submit a permanent erosion control plan for
approval by the City Engineer. Erosion.control shall be provided for all areas disturbed and may
include, but not be limited to, seeding, irrigating and plant establishment. Plant establishment and
growth shall be adequate to provide permanent protection against wind and water erosion.
4. Prior to placing material, the area to receive the stockpile shall be cleared and grubbed, removing
vegetation and other material unsuitable for fill.
5. Permittee shall provide continuous dust control including, but not necessarily limited to, enclosure
of disturbed areas and the stockpile with drift fencing and provision of a water truck or irrigation
system to effect thorough watering of all areas disturbed and of the stockpile itself. The water
source is subject to approval of CVWD.
6. Haul traffic shall be restricted to the street sections, access and egress points as follows:

7. Permittee shall furnish, install and maintain stop signs to control construction traffic entering 50th
Ave at the egress point(s).
8. If the City Engineer determines that permittee's operations are obstructing or endangering traffic
or pedestrians, Permittee may be required to submit a traffic control plan for review and approval
and to abide by the conditions of the approved plan.
7. Permittee shall take any necessary steps to avoid depositing material on streets along the haul route.
Spilled and tracked material shall be cleaned, at a minimum, at the end of each work day. If
necessary to control airborne dust or avert traffic hazards, spillage and trackage shall be cleaned
immediately and/or continuously.

8. Permittee shall be responsible for repair of any damage or deterioration of pavement, shoulders or
other improvements to city streets or other city, facilities which, in the opinion of the City Engineer,
is caused -by permittee's operations.
9. Upon completion of the permitted work, permittee shall obliterate and render unpassable any on-site
haul roads established to facilitate the permitted work.
10. The stockpile shall be completed within nine months from the date of the permit. Plant
establishment (erosion control) shall be completed not more than 90 days thereafter.
11. The permit/inspection fee shall be $420.
12. The developer shall provide security in the amount of $7,000 to assure full compliance with erosion
control and street cleaning requirements. Acceptable forms of security are performance bond, letter
of credit, and certificate of deposit in favor of the city.

Amcor Realty Fund III hereby submits to the City of La Quinta
Check No. _/.3 7- in the amount 'of $7,000.00 to provide
security in accordance with requirement No. 10 of the attached
Encroachment Permit Conditions regarding Washington Street and
Avenue 50, APN 617-020-.003.
It is agreed that proceeds from said check shall be held by the
City until January 28, 1993 and shall only be used by the City in
the event that Amcor Realty Fund III has not completed erosion
control by January 28, 1993.
It is further agreed that in any event said proceeds shall not be
used by the City without 30 days advance notice to Amcor Realty
Fund III in order that Amcor has the opportunity to remedy, if
any, uncompleted erosion control.
Lastly, it is agreed that if by January 28, 1993 said erosion
control is complete, the, entire proceeds shall be returned to
Amcor. Further, if the erosion control is not complete by January
28, 1993 and the City has to use but a portion of the proceeds
that any unused proceeds remaining shall be returned to Amcor.

ATTACHMENT A - REASONABLY AVAILABLE CONTROL MEASURES
The left column contains the sources of fugitive dust which are intended for emission control
under the City's dust control ordinance. The two right columns contain an inventory and
description of reasonably available fugitive dust control measures for each of the sources.
Please use this information as a guide when preparing a Fugitive Dust (PM10) Mitigation Plan.
