EXECUTIVE SUMMARY
• The applicant proposes a site development permit (SDP) for a 1,053 square foot
expansion of the existing Casa Mendoza restaurant.
• The expansion would include expanded dining area, bar expansion, new restroom,
and storage.
• The building expansion would be compatible with existing Spanish style
architecture of the restaurant and the approved outdoor patio currently under
construction.
BACKGROUND
The project site is the location of an existing 1,520 square foot restaurant with indoor
dining and outdoor patio dining. The applicant proposes restaurant expansion to
accommodate the large and growing customer base. A Modification by Applicant (MBA
2018-0002) was approved on March 8, 2018 by staff for construction of a rear walled

patio area for outdoor dining and a trash enclosure. The MBA 2018-0002 also permits
the removal of five parking stalls at the rear of the building to accommodate the walled
patio area. The removal of the rear parking has occurred and the rear walled patio area
and trash enclosure are under construction.
PROPOSAL & ANALYSIS
Overview:
The proposal includes the construction of 1,053 square feet of additional restaurant
building area (Attachment 3) on an improved property of approximately .11 acres with an
existing 1,520 square foot restaurant and is bounded by an existing alleyway and Fortun’s
restaurant to the north, Calle Estado to the south, and two-story office buildings to the
east and west.
Site Design:
The proposed restaurant expansion would occur toward the rear of the existing building.
The project site is currently accessed by Calle Estado to the South with available public
parking and the alleyway to the rear of the restaurant for deliveries and trash service.
The restaurant expansion includes 486 square feet for new dining area, a 514 square
foot storage area, and a single user restroom. The expanded bar area would allow for
seven additional bar seats. The expanded building area would include a large sliding
door that provides access to the new rear outdoor patio of 996 square feet. There are
two points of ingress/egress from the outdoor patio area into the alleyway. A second
doorway at the rear of the building is proposed from the storage area and would provide
access to a vehicle space for deliveries.
Architectural Design:
The proposed building expansion has been designed with a Spanish style architectural
theme compatible with the existing restaurant building. The building will consist of a
smooth stucco system, wood corbels, wood frame doors and windows, stone veneer
accents, and clay tile roof. The maximum height of the building addition is 16 feet six
inches.
The architecture and layout of building expansion is compatible with the existing
surrounding commercial land uses and is consistent with the development standards in
the Municipal Code. The building expansion is appropriate at the proposed location, and
supplemental design elements appropriately enhance the architecture of the building.
The proposed expansion facilitates a dining area environment oriented towards the
existing alleyway compatible with City efforts to transform the alleyway into a year
rounds destination for commissioned art in public places installations curated on the
rear of existing buildings.
Landscape Design:
The applicant submitted conceptual landscape plans for renovation of existing landscape
areas to include Bougainvillea and Star Jasmine plants along the existing exterior rear
patio walls.

June 4, 2018. All written comments received are on file and available for review with the
Design and Development Department. All applicable comments have been adequately

The City of La Quinta Design and Development Department has determined that this
project is Categorically Exempt from the provisions of the California Environmental

4. THE CONTRACTOR SHALL NOTIFY THE CITY OF LA QUINTA PUBLIC WORKS DEPARTMENT FORTY-EIGHT
(48) HOURS PRIOR TO ANY GRADING, BRUSHING, OR CLEARING AND EACH PHASE OF CONSTRUCTION AT
(760) 777-7048.
5. THE LOCATIONS OF EXISTING UNDERGROUND UTILITIES ARE SHOWN IN AN APPROXIMATE WAY ONLY.
THE CONTRACTOR SHALL DETERMINE THE EXACT LOCATION OF ALL EXISTING UTILITIES BEFORE
COMMENCING WORK. THE CONTRACTOR AGREES TO BE FULLY RESPONSIBLE FOR ANY AND ALL

8. THE CONTRACTOR SHALL NOT DISTURB EXISTING SURVEY MONUMENTS OR BENCH MARKS NOTED ON
THE PLANS, OR FOUND DURING CONSTRUCTION. REMOVAL AND REPLACEMENT SHALL BE DONE BY A
REGISTERED CIVIL ENGINEER WITH AN R.C.E. NUMBER BELOW 33,966, OR A LICENSED

10. ALL TRAVELED WAYS MUST BE CLEANED DAILY OF ALL DIRT, MUD AND DEBRIS DEPOSITED ON THEM

CITY ENGINEER.
11. ALL CONSTRUCTION AREAS SHALL BE PROPERLY POSTED AND LIGHTED IN CONFORMANCE WITH THE
CALIFORNIA STATE MANUAL OF WARNING SIGNS, LIGHTS, AND DEVICES FOR USE IN THE
PERFORMANCE OF WORK UPON HIGHWAYS IN ORDER TO ELIMINATE ANY HAZARDS.
12. CONSTRUCTION PROJECTS DISTURBING MORE THAN 1-ACRE MUST OBTAIN A NATIONAL POLLUTANT
DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT. OWNERS/DEVELOPERS ARE REQUITED TO:
A) FILE A NOTICE OF INTENT (NOI) WITH THE STATE WATER RESOURCES CONTROL BOARD
(SWRCB); B) PREPARE A STORM WATER POLLUTION PREVENTION PLAN (SWPPP); AND C)

2.ORDINANCES AND REGULATIONS
ALL WORK UNDER THIS DIVISION SHALL COMPLY WITH THE MOST RIGID
REQUIREMENTS OF THE LATEST EDITIONS OF THE NATIONAL ELECTRICAL CODE, THE
CALIFORNIA ADMINISTRATIVE CODES- TITLE 24, STATE BUILDING STANDARDS PART 3-
BASIC ELECTRICAL REGULATIONS AND ALL LOCAL CODES.
3.PERMITS AND INSPECTIONS
THE CONTRACTOR SHALL OBTAIN AND PAY FOR ALL PERMITS, INSPECTIONS,
INSURANCE AND LICENSES REQUIRED FOR THE WORK BY ALL LEGALLY CONSTITUTED
AUTHORITIES HAVING JURISDICTION. CERTIFICATES OF ALL SUCH PERMITS AND
INSPECTIONS SHALL BE DELIVERED TO THE OWNER'S REPRESENTATIVE.
4.VERIFICATIONS OF DIMENSIONS.
THE CONTRACTOR SHALL CAREFULLY CHECK THE DRAWINGS TO SEE THAT THE
EQUIPMENT BE CONTEMPLATES INSTALLING WILL FIT INTO THE SPACES PROVIDED. HE
SHALL ALSO CONDUCT A SITE INVESTIGATION PRIOR TO BIDDING ESTABLISH EXISTING
CONDITIONS.
5.SITE VISITATIONS
PRIOR TO THE SUBMISSION OF THE BID, THE CONTRACTOR SHALL VISIT THE SITE AND
MAKE A THOROUGH EXAMINATION OF THE EXISTING CONDITIONS AND THEREBY
INCLUDE ALL ALLOWANCES FOR THIS WORK IN HIS BID.
6.RECORD DRAWINGS
THE CONTRACTOR SHALL KEEP AN ACCURATE DIMENSIONED RECORD OF THE “AS BUILT”
LOCATIONS OF THE BURIED CONDUITS AND DUCTS. IN ADDITION, THE ACTUAL
INSTALLATION SHALL BE ACCURATELY RECORDED.
7.MATERIALS AND WORKMANSHIP
ALL MATERIALS, APPLIANCES AND EQUIPMENT SHALL BE NEW, OF THE BEST GRADE OF
THE RESPECTIVE KIND, FREE FROM ALL DEFECTS AND OF THE MAKE AND QUALITY
SPECIFIED. MATERIALS SHALL BE U.L. APPROVED AND IN COMPLIANCE WITH THE
NATIONAL ELECTRICAL CODE AND ALL LOCAL CODES.
8.COORDINATION
THE CONTRACTOR SHALL COORDINATE THE ELECTRICAL WORK WITH ALL OTHER
TRADES, TO ASSURE THAT THERE ARE NO INTERFERENCES. i.e. REVIEW ARCHITECTURAL,
STRUCTURAL, MECHANICAL, ETC. DRAWINGS AND SPECIFICATIONS OF ALL EQUIPMENT

(EMT), FLEXIBLE METAL CONDUIT, AND SCHEDULE 80 PVC CONDUIT.
1.1 CONDUITS SUBJECT TO MECHANICAL INJURY SHALL BE RIGID HEAVY WALL
GALVANIZED STEEL OR ALUMINUM. ALUMINUM CONDUIT MAY NOT BE USED BELOW
GRADE OR IMBEDDED IN CONCRETE.

1.3 CONDUITS RUN BELOW GRADE, EXTERIOR TO THE BUILDING, SHALL BE SCHEDULE

1.4 CONDUITS FOR LIGHTING CIRCUITS AND 120 VOLT OUTLET CIRCUITS SHALL BE EMT
WHERE NOT SUBJECT TO MECHANICAL INJURY.
1.5 FLEXIBLE CONDUIT SHALL BE INSTALLED TO ALL ROTATING AND VIBRATING
EQUIPMENT.
1.6 NO RUNNING THREADS SHALL BE PERMITTED.
1.7 ALL CONDUIT BODIES INSTALLED IN ANY LOCATION WHERE PRESENCE OF MOISTURE
IS APPARENT SHALL BE EQUIPPED WITH RUBBER GASKETS.
2 OUTLET BOXES
OUTLET BOXES AND COVERS SHALL BE GALVANIZED, ONE PIECE, PRESSED STEEL,
KNOCKOUT TYPE. BOXES FOR MULTIPLE DEVICES SHALL BE GANG BOXES.
OUTLET BOXES SHALL BE EQUIPPED WITH PLASTER RINGS, EXTENSION RINGS, OR
FIXTURE STUDS AS MANY AS REQUIRED.

FINDINGS
1. Consistency with General Plan. The project is consistent with the general plan land use
designation of Village Commercial.
2. Consistency with Zoning Code. The project is consistent with the provisions of this
zoning code and the nonresidential development standards for the Village Commercial
District.
3. Compliance with CEQA. Processing and approval of the permit application are in
compliance with the requirements of the California Environmental Quality Act. The
project was determined to be exempt from CEQA pursuant to 15301(e)(1) as the
addition is less than 2,500 square feet.
4. Architectural Design. The architectural design of the project, including, but not limited
to, the architectural style, scale, building mass, materials, colors, architectural details,
roof style and other architectural elements are compatible with surrounding
development and with the quality of design prevalent in the city. The proposed
expansion is compatible with the architectural style of the existing building.
5. Site Design. The site design of the project, including, but not limited to, project entries,
interior circulation, screening of equipment and trash enclosures, exterior lighting, and
other site design elements are compatible with surrounding development and with the
quality of design prevalent in the city.
6. Landscape Design. Project landscaping, including, but not limited to, the location, type,
size, color, texture and coverage of plant materials, has been designed so as to provide
visual relief, complement buildings, visually emphasize prominent design elements and
vistas, screen undesirable views, provide a harmonious transition between adjacent
land uses and between development and open space, and provide an overall unifying
influence to enhance the visual continuity of the project.
CONDITIONS OF APPROVAL
GENERAL
1. The applicant agrees to defend, indemnify and hold harmless the City of La Quinta
(“City”), its agents, officers and employees from any claim, action or proceeding to
attack, set aside, void, or annul the approval of this Site Development Permit. The City
shall have sole discretion in selecting its defense counsel.

The City shall promptly notify the applicant of any claim, action or proceeding and shall
cooperate fully in the defense.
2. The applicant shall comply with the conditions of approval and approved plans for MBA
2018-0002.
3. Prior to the issuance of any grading, construction, or building permit by the City, the
applicant shall obtain any necessary clearances and/or permits from the following
agencies, if required:
• Riverside County Fire Marshal
• Riverside Co. Environmental Health Department
• Desert Sands Unified School District (DSUSD)
• Coachella Valley Water District (CVWD)
• Imperial Irrigation District (IID)
The applicant is responsible for all requirements of the permits and/or clearances from
the above listed agencies. When these requirements include approval of improvement
plans, the applicant shall furnish proof of such approvals when submitting those
improvement plans for City approval.
MAINTENANCE
4. The applicant shall comply with the provisions of LQMC Section 13.24.160
(Maintenance).
5. The applicant shall make provisions for the continuous and perpetual maintenance of
perimeter landscaping up to the curb and access drives.
