SUBJECT: TEMPORARY USE PERMIT 2018-0005 – TORRE NISSAN
TEMPORARY PARKING
Dear Mr. Boyajian:
The Design and Development Department hereby approves your application
request to operate a temporary parking lot for Torre Nissan vehicles at the
southwest corner of Auto Center Drive and Auto Center Way in the City of La
Quinta. This decision may be appealed or called up to the Planning
Commission within 15 calendar days of the issuance of this letter (July
11, 2018). The temporary parking lot shall be installed in conformance with
the application and attached exhibits and subject to the following conditions:
1.The temporary parking lot (lot) can remain operational for a twenty
seven month period, from the date of this approval letter (September
26, 2020), which includes the estimated three (3) month time period
to establish the use. Use of the subject parcel for purposes of
temporary parking shall cease upon expiration of Temporary Use Permit
2018-0005, unless a new Temporary Use Permit has been approved.
2.Access to lot shall only occur during regular business hours for Torre
Nissan. If additional car dealership(s) are proposing to use the site,
applicant shall notify Planning Division staff and obtain Director
approval. This may require, at a minimum: a revised site plan,
operational information, and conditions of approval.
3.The entire lot shall be compacted with gravel or AB fill prior to any car
being parked.
4.No temporary signs are permitted unless separately approved by this
Department.

5. Prior to use of the lot, applicant shall apply for and construct driveway
approach through the Public Works department. Driveway approach
shall be located at access point identified on attached site plan. If
applicant proposes to change location of driveway approach, a revised
site plan shall be submitted and approved by the Planning department.

6. Applicant shall comply with the requirements for Fugitive Dust Control
per Chapter 6.16.040 of the La Quinta Municipal Code.
7. Surrounding streets and project site shall be kept clean. The streets
shall be cleaned at the end of each working day and more frequently, if
required. The applicant shall take measures to prevent rock,
vegetation, or dirt materials from the lot from entering into surrounding
streets or from becoming unruly on project site.
8. Should additional work, materials, or modifications of the work be
required in order to meet City standards, safety requirements, signage
requirements, or to fit actual field conditions, the work shall be
performed by the Permittee as directed by and to the satisfaction of the
City Engineer at no cost to the city of La Quinta.
9. Surrounding roadways and intersections shall remain readily accessible
for passage of emergency response vehicles and private vehicles. There
shall be no queuing of vehicles along all surrounding roads for the
purposes of entering the lot. Roadways to activities in and around the
lot shall be maintained accessible to emergency vehicles at all times.
10. Per the attached site plan, a protective barrier constructed of bollards
and rope shall be established around the perimeter of the lot. The
barrier shall meet the following conditions of approval:
a. The bollards shall be cylindrical, constructed of stone or concrete
and painted white. Bollards located adjacent to driveway
locations shall include a reflective hazard striping.
b. Bollards shall extend above the surface no less than 3’ in height.
c. Materials chosen for barrier and rope shall be matching in style
and color, with the exception of bollard(s) located within or
immediately adjacent to permitted driveways.
d. Bollards shall be spaced up to 10 feet apart from each other.
Bollards or rope shall not encroach into public right of way.
e. Driveways may either utilize a removable bollard or may be
secured with a locked rope. Ropes installed across driveways

shall utilize an appropriate reflective hazard tag painted orange,
yellow, or white in color.
f. No bollard or rope shall extend beyond the property line or into
sight visibility triangles.
g. In the event that an adjoining property utilizes a permanent wall,
fence, or other such restrictive feature along an adjacent
property line, protective barrier may be excluded from such
portions of a vacant lot. The southern property line of the project
site currently has a fence and no barrier is required along this
property line. In the event that the southern property line fence
was to be removed, the applicant shall be required to install
protective barrier along this southern property line.
h. Property owner(s) are responsible for the maintenance and
appearance of the protective barriers and bollards.
11. The use of the lot is subject to spot inspections by the Police
Department and/or City Staff to ensure compliance with the conditions
of this letter.
12. Any damage to public hardscape caused by this event shall be repaired
as directed by the City Engineer. This includes but is not limited to
sidewalks, curb and gutter, landscaping, and pavement especially
within the surrounding public streets.
13. The City of La Quinta reserves the right to revoke, suspend, or void this
permit at any time.
14. The permittee shall indemnify, hold harmless and assume the defense
of the City from all damages, delay costs, costs or expenses in law or
equity that may arise out of work under this permit.
15. The City may elect to add conditions to this application request to
mitigate any problems that may arise and are not addressed herein.
