Indemnify, defend and save the City, its authorized agents, officers, representatives and employees, harmless from and against any and all
penalties, liabilities or loss resulting from claims or court action and arising oui-of any accident, loss or damage to persons or property
happening or occurring as a proximate result of any work undertaken under the permit granted pursuant to this application.
Notify the Administrative Authority at least twenty-four (24) hours in advance of the time when work will be started.
Comply with all applicable City Ordinances, the terms and conditions of the permit and all applicable rules and regulations of the City of
La Quinta and to pay for any additional replacement necessary as the result of t�work.

Hold Harmless Clause
The undersigned, as President of La Quinta Polo Estates Association, formerly
known as Green Valley Ranches Association, hereby holds harmless and releases
the City of La Quinta, its departmental subdivisions, employees, contractors and
assigns from any and all claims, causes of action, suits, litigation, liabilities or
assertions of . rights of any kind or nature, by reason of the City of La Quinta
exercising its rights of removing any or all of any stamped concrete which is
constructed by La Quinta Polo Estates Association within the City of La Quin&s
rights of way at the following entries and access areas to and from La Quinta
Polo Estates Association properties:
1. Vista Montana entry West of Madison on 50th Avenue;
2, Vista Del Mar entry on Madison between 50th and 52nd Avenues;

SPECIAL CONDITIONS --PERMIT NO. 1706

In addition to the standard permit conditions, the following shall apply:
1. All work shall be performed in accordance with the latest edition of the Standard
Specifications For Public Works Construction .
2. This permit is only for work within the City of La Quinta and it's right-of-way.
Permittee/contractor shall acquire a permit from any other abutting agency and/or
-jurisdiction, ie, Caltrans, CVWD etc.
3. Permittee shall be responsible for providing continuous dust and erosion control.
4. Streets shall be kept clean. They shall be .completely cleaned at the end of each
working day and more frequently if required.
5. Contractor shall comply with the local noise ordinance. Operation and
maintenance of equipment within one half mile of human occupancy shall be
performed only during the following time periods:
October 1st to April 30: Monday -Friday 7:00 a.m. to 5:30 p.m.
Saturday 8:00 a.m. to 5:00 p.m.
May 1st to September 30: Monday -Friday 6:00 a.m. to 7:00 p.m.
Saturday 8:00 a.m. to 5:00 p.m.
Work shall be prohibited on legal holidays including Sundays.
6. Permittee shall assume responsibility for repair of any pavement breakdown at the
haul road access to any public or private street and for any damage to other City
streets or facilities.
7. Advance warning signs and traffic control shall be installed and maintained in
accordance with Cal Trans Standards. It shall be the permittee's responsibility
to detour and barricade this site.
8. All backfill and subgrade soil shall be compacted to 90% relative dry density.
(using an assumed max density).
9. All excavation at or near the travel way shall be backfilled at the end of the
work day for the protection of the traveling public.
10. Ingress and egress for all local properties shall be maintained at all times.
11. Street closures shall not be allowed at any time, a minimum of one travel lane
on paved surface shall be maintained at all times with'flagmen present.
12. Owner shall supply a "Hold Harmless" statement in case of future removals deemed
necessary by the City of La Quinta, inclusive of all improvements constructed
within the right-of-way. .
13. The city shall not be responsible for re -constructing or matching, in kind, any
non standard improvements constructed in the right-of-way: If the City sponsors
an improvement project that impacts the permittee's improvements installed under
this permit, the city will pay for standard improvement construction•only. Any
costs that exceed the cost for standard improvement construction shall be borne
by the permittee if standard improvements are considered to be unacceptable by
the permittee.
