---THE QUARRY ---
In addition to the standard permit conditions, the following shall apply:
1. All work'shall be performed in accordance with the "ROUGH GRADING" plans approved
'by the City on 5-20-93.

No fill shall be placed which will cover or obscure asphalt concrete, petroleum
product spillage, or other non-native materials, except the placement of existing
asphalt concrete at the location shown on the plan.
2. Permittee shall submit a fugitive dust prevention plan in accordance with
Ordinance #219. The plan must meet the approval of the City Engineer prior to
issuance of the permit.
3. Permittee shall furnish the name(s) and phone number(s) of the individual(s)
responsible for maintaining dust control after hours, weekends, holidays, etc.
4. Permittee shall notify the City Engineering Dept. at.564-2246 at least 24 hours
in advance of starting construction.
5. Keller. Pit Road and Ave. 58 shall be kept clean of all trackage or spillage from
vehicles using this site. The roads shall be completely cleaned at the end of
each working day, if necessary, and more frequently if required.
6. Operation and maintenance of equipment within one half mile of human occupancy
shall be performed only during the following time periods:
October 1st to April 30: Monday -Friday 7:00 a.m. to 5:30 p.m.
Saturday, 8:00 a.m. to 5:00 p.m.
May 1st to September 30: Monday -Friday 6:00 a.m. to 7:00 p.m.
Saturday 8:00 a.m. to 5:00 p.m.
Equipment may not be operated or maintained on legal holidays including Sundays.
7. Permittee is responsible for repair of any pavement damage or other damage to
access roads and other public facilities.
8. Should additional work .or modifications be required in order to meet established
City Standards or in order to fit field conditions, the work shall be performed
by the permittee as directed by and to the satisfaction of the City Engineer at
no cost to the City of La Quinta.
9. It is the permittee's responsibility to comply with the California Regional Water
Quality Control Boards• National Pollutant Discharge Elimination System (NPDES).
10. Any on-site haul road shall be effectively destroyed at the conclusion of the
work to prevent use by unauthorized vehicles.
11. Permittee/contractor shall install stop signs to stop •ponstruction traffic prior
to entering Keller Pit Road.
This permit is for Rough Grading only as shown on the approved plan. The permittee
shall provide security for the work to be performed in the amount of $146,000. The
permit fee shall be $16,413 payable at the time of, or prior to permit issuance.

GRADING DEPOSIT AGREEMENT
La Quints Golf Properties, Inc. (LQGP), hereby submits to the City
of La Quinta, an additional Time Deposit Receipt in the amount of
one -hundred forty-six thousand dollars ($146,000). This amount,
when added to the Time Deposit Receipt on file per agreement signed
by Steve D Speer on April 23, 1993, will bring the total amount of
security to two -hundred ninety-six thousand dollars ($296,000), per
the attached memorandum dated May 18, 1993, in accordance with the
City of La Quinta's Application for Permit, Public Works Construc-
tion (Encroachment) form. These securities will allow the City of
La Quinta to complete grading or erosion procedures as depicted on
the approved rough grading plans, in the event they are left
uncompleted by the developer.
It is agreed that the Time Deposit Receipts shall be held by the
City until November 20, 1993, and shall only be used by the.City in
the event that LQGP has not satisfactorily completed necessary
erosion control measures consisting of, but not limited to; grass-
ing, planting, slope stabilizing and sealing of the surrounding
graded areas, or unless the project is not being properly con-
trolled for dust during operations.
On or shortly before November 20, 1993, a determination will be
made, to the agreement of all parties, as to the completeness of
the grading and erosion control measures. In the event additional
time is needed to complete any remaining grading or erosion
control, a six-month Time Deposit Receipt shall be provided in a
reduced amount, to provide security until completion is realized.
It is further agreed that proceeds from the Time Deposit Receipts
shall not be used by the City for dust or erosion control, without
thirty -days advance notice to LQGP in order that LQGP shall have
the opportunity to rectify uncompleted dust and erosion control
measures, not withstanding the right of LQGP to provide security at
a redu ed amount, satisfactory to the City, if additional time
