NOW, THEREFORE, THE CONDITION OF THIS OBLIGATION is such that, if Contractor shall promptly and faithfully perform said Con-
tract, Men this obligation shall be null and void; otherwise it shall remain in full force and effect.
The Surety hereby waives notice of any alteration or extension of time made by the Owner.
Whenever Contractor shall be, and declared by Owner to be in default under the Contract, the Owner having performed Owner's obligations
thereunder, the Surety may promptly remedy the default, or shall promptly —
1. Complete the Contract in accordance with its terms and conditions, or
2. Obtain a bid or bids for completing the Contract in accordance with its terms and conditions, and upon determination by Surety of the
lowest responsible bidder, or, if the Owner elects, upon determination by the Owner and the Surety jointly of the lowest responsible bidder,
arrange for a contract between such bidder and Owner, and make available as Work progresses (even though there should be a default or a
succession of defaults under the contract or contracts of completion arranged under this

In addition to the standard permit conditions, the following shall
apply:
1. All wort, shall be •performed in accordance with the latest edition
of the "Standard Specifications For Public Works Construction"
and the plans approved by the City of La Quinta.
2. Permittee shall furnish the name(s) and phone number(s) of the
individual (s) responsible for maintaining the project site after
hours, weekends, holidays, etc.
3. Permittee shall notify the City Engineering Dept. at 564-2246 at
least 24 hours in advance of starting construction.
4. Park: Ave and.50th Avenue shall be kept clean of all trackage ur
spillage from vehicles using this site. The roads shall be
completely cleaned at the end of each wort:: day, if necessary, and
more frequently if required.
5. Operation and maintenance of equipment within one half mile of
human occupancy shall be performed only during the following time
periods:
October 1st to April 30: Monday -Friday
7:00 a.m.
to
5:30p.m.
Saturday
8:00 a.m.
to
5:00p.m.
May 1st to September 30: Monday -Friday
6:00 a.m.
to
7:00p.m.
Saturday

Equipment may not be operated or maintained on legal holidays
including Sundays.
6. Permittee is responsible for repair of any pavement damage or
other damage to access roads and other public facilities.
7. Should additional wort: or modifications to required in order to
meet established City Standards or in order to fit field
conditions, the wort:: shall be performed by the permittee as
directed by and to the satisfaction of the City Engineer at no
cost to the City of La Quinta.
8. Any on-site haul road shall be effectively destroyed at the
conclusion of the work: to prevent use by unauthorized vehicles.
9. Permittee/contractor shall install stop signs to stop
construction traffic prior- to entering Park: Ave.
104 A single access point off of Park: Ave shall be used for
construction ingress and egress, 50th Ave shall not be used as a
construction access unless otherwise approved by the City
Engineer.

11. A traffic control plan shall be submitted to the City Engineer
for approval prior to any work: in the travel way. Field
adjustments shall be 'accomplished as directed by the Engineer to
fit actual field conditions.
12. Streets shall be restored to normal traffic use at the end of
each work day by installing traffic plates over the trenches or
using temporary A.C.
13. When work is within 500' of a signalized intersection , the
permittee shall notify Riverside County Signal Dept. at (714)
275- -6894 or Caltrans Signal Dept at (619) 688-6845 as
appropriate.
14. All traffic signal detector loops shall be protected in place,
any damage shall be the contractor/permittee's responsibility.
15. 48 hrs prior to starting wort:: Underground Service Alert shall be
contacted at i(eoo)422-4133 and an "inquiry no." shall be
provided to the public words inspector.
16. In advance of excavation; contractor/permittee shall submit to
the city for acceptance a detailed plan , in accordance with
labor- code section 6705, showing the design of sharing, bracing, -
sloping, or other provisions to be made for worker protection
from the hazard of caving ground during the excavation of any
trench greater- than five feet in depth.
If such pian varies from the shoring system standards, the plan
shall be prepared by a registered civil engineer. As part of the
plan, a note shall be included stating that the registered civil
or structural engineer certifies that the plan complies with the
Cal OSHA- Construction Safety Orders or that the plan is not less
effective than the Cal OSHA Construction Safety Orders.
17. Prior- to occupation of the project site., the contractor shall
submit and receive approval of a fugitive dust control plan
prepared in accordance with City of La Quinta Ordinance No. 219
(Chapter 6.10, LQMC). In accordance with said ordinance, the
contractor shall provide, the city security in ars amount
sufficient to guarantee compliance with the provisions of this
permi-t.
18. All work: shall be coordinated with the City's contractor and
others working within the area as directed by and to the
satisfaction of the City Engineer.
19. All backfill and subgrade soil shall be compacted to 90% relative
dry density, all backfill soil within the tap 2' of finish
pavement surface shall be compacted to 95% relative dry density,
all base material shall be compacted to 95% relative dry density.
