The following General and Special Provisions are attached to and made a part of Permit No.
GENERAL PROVISIONS
• The following shall always apply:
ENCROACHMENT ON PRIVATE PROPERTY: This permit authorizes work to be accomplished within City of La Quints right of way
ONLY. Whenever construction extends withinro rivate
D property. it shall be the responsibility of the Permittee (of his contractors) to
secure permission from abutting property owners. Such authorization must be secured by the perminee prior to starting work.
TRACKLAYING CONSTRUCTION EQUIPMENT: Cleated tracklaying construction equipment shall not be permitted to operate on any
paved surface unless fined with Smooth -faced street pads. All mechanical outriggers shall be fitted with rubber street shoes to protect
the paving during excavations. Rubber -tired equipment only shall be used in backfill operations in paved areas. If the existing
Pavement is scarred, spelled, or broken during the term of this contract or if the pavement is marred. City of La Quints shall request
that these portions of road be resurfaced over their entire width. Resurfacing shell consist of one coat of two Inches (2") of A.C.
surfepng plus appropriate $eal coat as specified above.
PROTECTION OF TRAFFIC: All excavations and work areas shell be property lighted and barricaded as deemed necessary by the City
Engineer dr La Quints City Public Works Inspectors. Suitable detours and detour signs shall be placed and maintained forthedura
of the project. The City Shall be notified 24 Hrs. in advance of any traffic detours or delineations, tion

R7 GRADES & STAKES: City of La Quints shall establish grades and stakes for the proposed concrete curb end gutter
construction.
GRADE CHECKING: City of La Quinta shall check grades upon receipt of plan and profile and/ grades eseatabti ' by
a licensed engineer.
R9 CURB REMOVAL FOR DRIVEWAYS: A portion of the existing concrete curb and/or curb and gutter ( feetbe
)shall
removed. Curb and/or curb and gutter shall be saw cut prior to removal. Depressed curb, matching concrete goner and
concrete driveway approach shall be constructed in conformance with City of La Quints Standard #207.
RIO DRIVEWAYS. A.C.: Driveways shall be constructed as not to alter existing drainage pattern. Surfacing between the
property line and the existing road paving shall be 2-1/2 inches of A.C. paving placed on (_) of class
aggregate base. Driveway construction shall conform to attached drawing.
.R11 CULVERTS: A inch diameter ( ) culvert shall be installed with the invert approximately 1.1 /2
inches below and in line with the existing flow line. Culvert Installation shall conform to the attached drawing.
R1 SIGHT CLEARANCE: Sight clearance of 600 feet in either direction shall be assured and maintained
R13 SOIL STERILIZER: The area to be surfaced shall W treated with soil sterilizer. Rate of application shall oorrtplywith the
manufacturer's specifications.
COORDINATE WORK: The proposed work shall be subordinated to any operation which the State of California or
City of La Quints may conduct in this area during the period of this permit. Work shall be coordinated with the State or
City of La Quints forces to preclude delay or interference with State or City of La Quints projects.
15 SURVEY MONUMENTS: Prior to excavation or beginning of construction, all survey monuments which exist on the
centerline of all streets or property lines when involved shall be completely tied out so they may be readily and correctly
be replaced by a licensed Civil engineer or surveyor at the expense of the permittee. A complete Set of notes showing the
ties to these, monuments shall be furnished to the City Engineer prior to the removal of any monuments. This office shall
be notified upon COmptation of replacement of all survey monuments for proper project clearance.

R17 PAVEMENT CUTTING: Pavement will be mechanically cin to astraight edge prior to excavation. Method a(pavement
cutting shell be approved through the office of the City Engines r. (Under no circumstances shall excavatrng'equkpmena
be used to excavate Prior to cutting of pavement). Excavation material shall be placed in such a position as to best
facilitate the general flow of traffic. Prior to final paving operations. any damage to pavement straight edge shall be
corrected.
R18 PAVEMENT CUTTING: Pavement shall be saw cut prior to removal. Prior to final paving operations. any damage to
Pavement straight edge shall be corrected.
Rt LIMIT OF EXCAVATIONS: Excavations shall be limited to 1 .000 lineal feet of open trench before backfill operations must
begin. All excavations shall be properly barricaded with lights overnight, on weekends and holidays forthe protection of
the traveling public. The Public Works inspector shall determine the suitability of excavation barricading in each case. No
excavation shall remain open for a period exceeding five (5) days. No excavation shall be made unless the construction
material is actually on the work site.
20 BACKFILL MATERIAL: Backfill shall be free of brush. roots or other organic substance detriments.::.;suse for purposes
of producing an adequately consolidated backfill. Any material which the City of La Quints deems unsuitable (spongyor
saturated material) which is encountered during excavation shall not be used for backfill, but shall be supplemented or
replaced by an approved sand or gravel.
R21 BACKFILL SAND: Baddill shall be approved transit -mix sand or equivalent and shall be placed in lifts of notgreater than
three feet (31 and vibrated using vibrotamper or equiva is nt equ ipmant. Alte mate methods maybe substitlned, but in any
case a relative compaction of 95 percent shall be attained within the q:ructural section of the roadway,
® BACKFILL PLACEMENT: Backfill shall be applied in layers of not more than 50 percent of the total depth of the trench
before flooding or a maximum of five-foot 151 lifts where trenches are of excessive depths. Care is to be exercised that the
baddill material is not subjected to extreme swell by flooding operations. Backfill material shall be placed so that the
resulting compaction shall be not less than 90 percent or equivalent to the surrounding ground. whichever is the greater
compaction. Where ponding or flooding is used for a maximum settlement, adequate dikes will be constructed to retain
the water. Where jetting is used. the jets shall be of sufficient length to reach the bottom of eacn :ager and the water
supply shall -be continuous.
COMPACTION TESTS: If so required bythe inspector. compaction tests shall be made at intervals of not more than 1.000
feet and a minimum of one (1) test on each road. One (1) copy of each test shall be forwarded to the City Engineer for
approval andf iled prior to making permanent repairs. Compaction tests shall be made as outlined in Section 6.3.01 of the
Standard Specifications. Division of Highways. State of California, dated January 1973.
R2 COMPACTION TESTS: If so required by the inspector, compaction tests shall be made for each vossing or service line.
One (1) copy of each test shall be forwarded to the City Engineer for approval and filed prior to making permanent repairs.

R25 TEMPORARY PAVEMENT REPAIRS: After completion of backfill and compaction operations. a temporary patch
consisting of 2 inches of SC -800 shall be placed on a prepared subgrade. The SC -800 temporary paving shall be placed
after a maximum of 3.000 lineal feet of trench has been excavated and backfill operations completed, but in no case shall
the placement of the temporary pavement exceed a five (5) day limit.
R26 PERMANENT PAVEMENT REPAIR: After backfill and compaction operations have been completed. a temporary patch
consisting of two inches (2") of SC -800 shall be placed immediately. A permanent patch of
surfacing placed on a inch class base shall be placed no later than inches A.C.

_ .... R27 PAVEMENT REPAIR: F.A.S.: Upon Completion of backfill and compaction. a temporarypatch consisting oftwo inches (2-)
of cold mix paving (SC -800) shall be placed immediately. A permanent patch of three inches (31 of A.C. surfacing shall
be placed on six inches (6 ) concrete base as directed, but not later than fifteen (15) days after completion of temporary
Paving. Concrete base shall be of five-ssdt mix and shall conform to the City of La Quinta Road Improvement Standards
and Specifications. Ordinance #461.
R28 FOG SEAL: A fog seal coat consisting of an application of asphaltic emulsion shall be applied over-all patch areas as
determined by the City Engineer.
R29 SEAL ARMOR COAT: A seal coat consisting of an application binder and screenings shall be applied on all patch areas
where such seal coats existed prior to issuance of this permit. Seal or armor coats shall be applied as specified in Section
37, Standard Specifications, State of California. Division of Highways, dated January 1973. Work of pavement repair to
be accomplished by a licensed contractor engaged in the business of pavement repair.
R30 STREET RESTRIPING: Where street striping is still visible on streets to be excavated. such striping shall be replaced upon
completion of permanent. repairs.
R31 TREE RELOCATION OR REMOVAL: Tree relocation within the Cityof La Quints road right of way shall be accomplished
by a licensed. bonded and insured tree service. and handled safely without mterference or hazard to the traveling public.
It shall be the responsibility of the permittee to maintain the tree in a vigorous growing condition at its new location.
Trees to be removed shall be removed in sections which can be handled safely without interference or hazard to highway
traffic. The entire width of the tree stump shall be removed and disposed of so that no debris remains in view of the
highway. The stump hole shall be backfilled and thoroughly compacted as specified in the following paragraph. Where it
becomes necessary to restrict traffic, the work shall be restricted to a maximum of 500 feet at any one time. Adequate
signs, flagmen and/or barricades shall be provided to protect the traveling public at all times.
Large holes resulting from tree removal shall be backfilled and compacted to not less than 90 percent or equivalent to the
surrounding ground, whichever is the greater compaction as determined by the impact or field method. Compaction
tests shall comply with Section 6.3.01 of the Standard Specifications. Division of Highways. State of California, dated
January 1973.
R32 TREE TRIMMING:
a. Only the necessary trimming shall be accomplished to provide clearance of the facility for one calendar year.
All broken or weak sections within the trimming shall be removed.
b. Where it becomes necessary to restrict traffic. the work shall be restricted to a maximum of 500 feet at anyone time.
Adequate signs, flagmen, and/or barricades shall be provided to protect the traveling public at all times.
C. If tree trunks are partially outside of the City of La Quints road right of way, permittee shall make his own
arrangements with adjoining property owners for consent to the trimming in addition to the authorization provided
by this permit.
d. All tree trimming on EVERGREEN TREES. PALM TREES• and other ORNAMENTAL TREES shall be accomplished to
the satisfaction of the City Public Works Inspector.
a. Abutting property owners shall be contacted, in all instances. prior to trimming or topping trees.
f. Pruning shall, in all instances. be at the shoulder of the crotch to insure even, fast healing in all cuts at two inches
(2") and above in size. Sealant shall be applied to all cut sections as directed by the City Public Works Inspector.

In addition to the standard per=mit conditions, the following
shall apply:
1. All work: shall be performed in accordance with the latest edition
of the Standard Specifications For Public Works Construction.
2. Permittee shall be responsible for providing continuous dust and
erosion control.
3. Streets shall be kept clean. They shall be completely cleaned at
the end of each working day and more frequently if required.
4. Contractor shall comply with the local noise ordinance.
Operation and maintenance of equipment within; one half mile of
human occupancy shall be performed only during the following time
periods.

5. Permittee shall assume responsibility for repair of any pavement
breakdown at the haul road access to any public or private street
and for any damage to other City streets or facilities.
6. Advance warning signs and traffic control shall be installed and
maintained in accordance with Cal Trans Standards. It shall be
the permittee's responsibility to detour and barricade this site.
7. Street closures shall not be permitted. A minimum of one travel
lame on paved surface shall be maintained with flagmen at ill
times.
e. If the wort:: is to be performed by forces other than that of the
utility company the contracting company shall apply for an
additional encroachment permit and pay the appropriate -fee.
9. Prior- to excavating; the permittee shall contact Underground
Service Alert at 1 (e6o) 422-4133.
10. Should additional work:, materials, or modifications of the work:
be required in order to meet city standards, safety requirements.

11. All landscaping, irrigation, decorative rock etc. shall be

13. When the work is within 500' of a signalized intersection, the
permittee shall notify Riverside County Signal Dept. at (714)
275-6894 or Caltrans Signal Dept. at (619) 688-6845 as
appropriate aminimum of 48 hrs prior to starting work.
14. All backfill and subgrade soil shall be compacted to 90% relative
dry densityl all backfill soil within the top 2' of finish
pavement surface shall be compacted to 95% relative dry density�
all base material shall be compacted to 95% relative dry density.
15. This permit is for the construction of the foundations for the
Golf Cart Tunnel only. A separate permit will be issued to
complete the entire Cart Tunnel Crossing' '

The footings for both the tunnel sections and the wing (retaining) walls were
designed to use standard material- strengths while at the same time not requiring special
inspection. Toward that end, in both cases, concrete with a 28 day compressive strength of .
2500 psi (f c) was selected.
Attached are copies of -the sheets from the respective calculation sets where the
concrete is specified.

I couldn't find anyone who knew about your request for information. Would you please fax
me another copy at 325-5130?
Attached are the relevant sections of the soils report with the information you requested.
Included is a letter from Earth Systems stating that the requirements haven't changed since
the original report was issued in 1989.
As far as the developed strength necessary in the footing prior to setting tunnel sections, it
is my understanding that arrangements have been made to pour high strength (about 3500
psi) concrete, to use an accelerating agent, and to take a number of cylinders during the
pour. If that is the case, sufficient strength should be developed in just a couple days. At
any rate, you will be supplied with test results to confirm the footing is ready for placement
of tunnel sections.
I don't know anything about the footing width controversy. To my knowledge, a 5'-8" wide
footing will be constructed. It is true that a smaller footing would probably suffice, as my
calculations are quite conservative, but the developer was in a hurry and we didn't want to
wait for the soils engineer to give us the effect of bridging on the soil prism outside the
tunnel face.

As requested we have reviewed the referenced report and visited the site to observe
the present conditions. Based upon this, it is our opinion that the recommendations
included in the referenced report remain valid for the design and construction of the
residential structures proposed for this project.
It is important to note that much of the site has been previously rough graded including
the overexcavation of building areas as recommended in the referenced report. When
grading beyond the previously graded building pads is performed, additional
overexcavation will be necessary. The bearing values and lateral coefficients
included in the referenced report remain valid.
Because there have been several project names since conception, different titles
appear on our project reports. The previous project names include; The Groves, The
Pyramids, and more recently The Orchard. Supplemental information is also
contained in additional Soil Reports prepared by our firm for the previously proposed
clubhouse and several golf cart tunnels. If there are any questions concerning this
letter, the referenced report or other previous project reports, please contact the

1 1. The Recommended Grading Specifications included in Appendix C
aregeneral guidelines only and should not be included
directly into project specifications without first incorporating
the site specific recommendations contained [n the soil:
engineering report. Chapter 70 of the Uniform Building Code
contains specific considerations for grading and is considered a
part of these recommendations.
12. It is recommended that Buena Engineers, Inc., be retained to
provide soil engineering services during construction of the
grading, excavation, and foundation phases of the work. This is to
observe compliance with the design concepts, specifications or
recommendations and to allow design changes in the event that
subsurface conditions differ from those anticipated prior to start
of construction.
C. Fxcavat ions
All excavations should be made in accordance with applicable
regulations. From our site exploration and knowledge of general
area, we feel there is a potential for construction problems
involving caving of relatively deep site excavations (i.e. utilities,
etc.). Where such situations are encountered, lateral bracing or
appropriate cut slopes should be provided.
2. No surcharge loads should be allowed within a horizontal distance
measured from the top of the excavation slope, equal to the depth
of the excavation.
D. Traffic Areas
Streets should be provided with one (1) foot of subgrade
compacted to ninety (90) percent of maximum density.
2. On-site parking should be provided with one (1) foot of subgrade
compacted to ninety (90) percent of maximum density.
3. Final preparation of subgrade will depend on paving. section
designs.

E. Utility Trenches
I. Backfill of;utilities within road right-of-way should be placed in
strict conformance with the requirements of the governing agency
(Water District, Road Department, etc.). .
2. Utility trench backfill within private property should be placed in
strict provisions of this report relating to minimum compaction
standards. In general, service lines extending .inside of property
may be backfilled with native soils compacted to a minimum of
ninety (90) percent of maximum density.
3. . Backfill operations should be observed and tested by Buena
Engineers, Inc., to monitor compliance with these
recommendations.
STRUCTURES
Based upon the results of. this evaluation, it is our opinion that the
structure foundation can be supported by compacted soils placed as
recommended above., .The recomendations that follow are based on "very
low" expansion category soils.
A. Foundations
It is anticipated that foundations will be placed on firm compacted
soils as recommended elsewhere in this report. The recommendations
that follow are.based on " very low" expansion category soils. if the
additional testing following grading indicates expansion
greater .than the 'very low" category, these recommendations
must be reevaluated.
Table 29-A gives specific recommendations for width, depth and
reinforcing. Other structural consideration may be more stringent
and would govern in any case. A minimum footing depth of twelve
(12) inches. below lowest adjacent f inish grade for one (1) story
structures and eighteen (18) inches for two (2) story structures
should be maintained.

2. Conventional Foundations:
Estimated bearing values are given below for foundations on
recompacted soils, assuming fill import Of required) to be equal
to or better than site soils:
a. Continuous foundations one (1) foot wide and twelve (12)
inches below grade:
1. 1300 psf for dead plus reasonable live loads.
11. 1700 psf for wind and seismic considerations.
b. Isolated pad foundations 2' x 2' and bottomed twelve (12)
inches below grade:
i. 1500 psf for dead plus reasonable live loads...
ii. 2000 psf -for wind and seismic considerations.
3. Allowable increases of 200 psf per one ( 1 ) foot of additional
footing width and 250 psf for each additional six ,(6) inches of
footing depth may be used. The maximum allowable bearing will
be 2500 pcf.
4. Although footing reinforcement may not be required per Table 29-
A)- one (1) number four (1r4) rebar at top and bottom of footings
should be considered in order to span surface imperfections. Other
requirements that are more stringent due to structural loads will
govern.
5. Soils beneath footings and slabs should be premoistened prior to
Placing concrete.
6. Lateral loads may be resisted by soil friction on floor slabs and
foundations and by' passive resistance of the soils acting on
foundation stem walls. Lateral capacity is based partially on the
assumption that any required backfill adjacent to foundations and
grade beams is properly compacted.
7. Foundation excavations should be visually observed by the soil
engineer during excavation and prior to placement of reinforcing
steel or concrete. Local variations in conditions may warrant
deepening of footings.

Concrete slabs -ori -grade should be supported by compacted
structural fill placed'in accordance with applicable sections of
this report.
2. ; . In areas of moisture sensitive floor coverings, an appropriate
vapor barrier should be installed in order to minimize vapor
transmission from the subgrade soil to the slab. The membrane
should be covered with two (2) inches of sand to help protect it
during construction. The sand should be lightly moistened just
prior to placing the concrete.
3. Reinforcement of slab -oh -grade is contingent upon the structural
engineers recommendations and the expansion index of the
supporting soil. Since the mixing or fill soil with native
soil could change the expansion index, additional tests
should be conducted during rough grading to determine the
expansion index of the subgrade soil. Also, due to the high
temperature differential endemic to desert areas, large concrete
slabs on grade are susceptible to tension cracks. Although
reinforcing slabs may not be required, consideration should be
given to reinforcing slabs with 6"x 6"/ -"'10 x -710 welded wire
fabric. Additional reinforcement due to the expansion index of the
site soil should be provided as recommended in section F below.
Additional reinforcement may also be required. by the structural
engineer.
4. It is recommended that the proposed perimeter slabs (sidewalks,
patios, etc.) be designed relatively independent of foundation
stems (free-floating) to help mitigate cracking due to foundation
settlement and/or expansion.
C. Settlement Considerations
Maximum estimated settlement, based on footings founded on firm
soils as recommended, should . be less than one (1) inch.
Differential settlement between exterior and interior bearing
members should be less than one-half (1 /2) inch.

D. Frictional and Lateral Coefficients
1. Resistance to lateral loading may be provided by friction acting on
the base of'foundations, a coefficient of friction of .49 may be
used for dead load forces.
2. Passive resistance acting on the sides of foundation stems (300
pcf, equivalent fluid weight), may be included for resistance to
lateral load.
3. A one-third (1 /3) increase in the quoted passive value may be used
for wind or seismic loads.
4. Passive resistance of soils against Grade beams and the frictional
resistance between the floor slabs and the supporting soils may be
combined in determining the total lateral resistance, however the
friction factor should be reduced to .33 of dead load forces.
S. For retaining walls backfilled with compacted native soil, it is
recommended that an equivalent fluid pressure of thirty-five (35)
pcf be used for well drained level backfill conditions.
E. Slope Stability
Slope stability. calculations were not performed due to the anticipated
minimal slope height (less than 10'). If slopes exceed ten (10) feet,
engineering calculations should be performed to substantiate the
stability of slopes steeper than 2 to 1. Fill slopes should be overfilled
and trimmed back to competent material.
F. EZD3 nin
The design of foundations should be based on the weighted expansion
index (UBC Standard No. 29-2) of the soil. As stated in the soil
properties section, the expansion index of the on-site soil as high as
the medium (51-90) classification. However, during site
preparation, if the soil is thoroughly mixed and additional
fill is added, the expansion index may change. Therefore, the
expansion index should be - evaluated after the site
preparation has been completed,. and the final foundation
design adjusted accordingly.

This report is based on the assumption that an adequate program of
client consultation, construction monitoring and testing will be
performed during the final design and construction phases to check
compliance with these recommendations. Maintaining Buena Engineers,
Inc., as the soi]'engineering firm from beginning to end of the project
will help assure continuity of services. .These tests would be
additional services provided by our firm. The costs of these services
are not included in our present fee arrangements. The recommended
tests and observations include, but are not necessarily limited to the
following:
Consultation during the final design stages of the project.
2. ' Review of the building plans to observe that recommendations of
our report have been properly Implemented Into the design.
3. Observation and testing during site preparation, grading and
placement of engineered f i H.
4. Consultation as required during construction.
The analysis and recommendations submitted in this report are based in part
upon the data obtained from the nine (9) borings performed on the site. The
nature and extent of variations between the borings may not
become evident until construction. If variations then appear
evident, it will be necessary to reevaluate the recommendations
of this report.
Findings of this report are valid as of this date. However, changes in
conditions of a property can occur with passage of time whether they be due
to natural processes or works of man on this or adjacent properties. In
addition, changes in applicable or appropriate standards occur whether :they
result from legislation or broadening of knowledge. Accordingly, findings of
this report may be invalidated wholly or partially by changes outside our
control. Therefore, this report is subject to review and should not
be relied upon after a period of one ( 1 ) year.
