PARAGRAPH B. Contractor shall furnish all labor, all materials, all services and all equipment, fully to
perform, construct and complete; in a good and workmanlike manner, the following job on the Project

and Architect, engineering, general and special conditions, general requirements, supplementary conditions, soils

incorporated herein as though set out in full at this time.
PARAGRAPH C. The Work shall be constructed and completed in strict compliance with the Contract
Doctunents, Contractor's responsibility shall commence immediately upon execution hereof, and shall continue for
a period through the completion of lite Improvements including, but not necessarily limited to building.

PARAGRAPH E. The Schedule of Payments (attached) of the Contract Price shall be as follows:

R H Industries, Inc. shall pay or administrate the payment of the Contract Price for the Work. subject to
approval as provided herein, and providing the application (invoice) for payment shall have been titnely made. and
further provided that such application shall have been accompanied by material and labor releases in form
satisfactory to R H Industries. Inc., and owner. In the event that a construction lender is providing the building
funds, then Contractor shall follow, the procedure as may be required by said construction lender.
PARAGRAPH E. Contractor agrees to secure, furnish proof of and to mai_,tain in effect at all times. at his
own expense, worker's eompeusation insurance and public liability insurance (including bodily injury and
property damage coverage) of a minimum of $1,000,000, and o.aming R H Industries, Harold Victor, and Victor
Partners as an additional insured, with forms, teat and with a carrier satisfactory to the owner of the Project. As a
condition of this agreement and prior to Commencing work the Contractor shall have on file in the offices of
R H Industries, Inc., current Copies of his worker's compensation and liability coverage.
PARAGRAPH G. Contractor shall be responsible to provide that the Work shall be completed and
constructed fully in accordance with a schedule for'construction as provided by R H Industries. Inc.
PARAGRAPH H. Contractor agrees to make available to R H Industries, Inc, for verification of actual
costs of the materials and labor, Contractor's books, records. invoices, and other documents relative to the actual
costs of materials, labor, transportation, overhead, profit, or any other cost of the construction.
PARAGRAPH L ALL ADDITIONAL 'TERMS AND CONDITIONS OF CONTRACT AGREEMENT

R1 SIGHT CLEARANCE: Sight clearance of 600 feet in either direction shall be assured and maintained.
R13 SOIL STERILIZER: The area to be surfaced shall be treated with soil sterilizer. Rate of application shall complywith the
manufacturer's Specifications.
14 COORDINATE WORK: The Proposed work shall be subordinated to any operation which the State of California or
City of La Quints may conduct in this area during the periodof this permit. Work shall be coordinated with the State or
City of La Quina forces to preclude delay or interference with State or City of La Quints projects.
R1 SURVEY MONUMENTS: Prior to excavation or beginning of construction. all survey monuments which exist on the

R17 PAVEMENT CUTTING: Pavement will be mecnanically cut to a straight edge prior to excavation. Method of pavement
cutting shall be aDaroveo throuqn the office of the City Engineer. (Under no circumstances shall excavating equipment
be used to excavate ortor to cutting of pavement(. Excavation material shall be olaced in such a OOsitlbn as to best
facilitate the general flow of traffic. Prior to final paving operations. any damage to pavement straight edge shall be
corrected.
R18 PAVEMENT CUTTING: Pavement shall be saw cut prior to removal. Prior to final paving operations. any damage to
pavement Straight edge shall be corrected.
UMIT OF EXCAVATIONS: Excavations shall be limited to 1.000 lineal feet of open trencn before backfill operations must
began. All excavations snail be properly barricaded with fights overnight, on weekends and holidays for the protection of
the traveling public. The Public Works inspector snail determine the suitability of excavation barricading in each case. No
i excavation shall remain open for a period exceeding five 15) days. No exeavanon snail be made unless the construction
material is actually on the work site.
R20 BACKFILL MATERIAL Backfill shall be free of brush. roots or other organic substance detrimenta.: , -s use for purposes
Of producing an adequately consolidated backfill. Any material which the City of La Quints deems unsuitable(spongyor

® COMPACTION TESTS: Ifso required bythe inspector. compaction tests shall be made at intervals of not More than 1,000
feet and a minimum of one (1) test On each road. One 11) COPY of each test shaft be forwarded to the City Engineer for
approval and filed prior to malung permanent repairs. Compaction tests shall be made as outlined in Section 6.3.01 of the
Standard Specifications, Division of Highways. State of California, dated January 1973.
R24 COMPACTION TESTS: If so required by the inspector, compaction tests shall be made for each crossing or service line.
One (1) copy of each test shall be forwarded to the City Engineer for approval and filed prior to making permanent repairs.
Compaction tests shall be made as outlined in Section 6.3.01 of the Standard Specifications, Division of Highwsye. State
of California. dated January 1973.
R25 TEMPORARY PAVEMENT REPAIRS: After completion of backfill and compaction operations, a temptxsry patch
consisting of 2 inches of SC -800 shall be placed on a prepared subgrade. The SC -800 temporary paving shall be placed
after a maximum of 3,000 lineal feet Of trench has been excavated and backfill operations completed. but in no case shall
the placement of the temporary pavement exceed a five 45) day limit.
R26 PERMANENT PAVEMENT REPAIR: Atter backfill and compaction operations have been completed, a temporary patch
consisting of two inches (2.1 of SC -800 shall be placed immediately. A permanent patch of inches A.C.
surfacing placed on a inch class base shall be placed no later thandays aft
temporary road repair. after Completion of
R27 PAVEMENT REPAIR: F.A_S.: Upon Completibn of backfill and compaction, a temporarypatch consisting of two inches (2")
of cold mix paving (SC -800) shall be placed immediately. A permanent patch of three inches (3-) of A.C. surfacing shall
be pieced On six inches 161 concrete base as directed, but not later than fifteen 115) days after Completion Of temporary
paving. Concrete base shall be of five•sedk mix and shall conform to the City of La Quints Road Improvement Standards
and Specifications, Ordinance 9481.
R2 FOG SEAL A fog seal coat consisting of an application of asphaltic emulsion shall be applied over all patch areas as
determined by the City Engineer.
R29 SEAL ARMOR COAT: A seal coat consisting of an application binder and screenings shall be applied on all patch areas
where such seal coats existed prior to issuanceof thispermrt. Seal or armor coats shall be applied as specified in Section
37, Standard Specifications. State of California. Division of Highways, dated January 1973. Work of pavement repair to
be accomplished by a licensed contractor engaged in the business of pavement repair.
�3QJ STREET RESTRIPING: Where street striping is still visible on streets to be excavated. such striping shall be replaced upon
completion of permanent repairs.
R31 TREE RELOCATION OR REMOVAL: Tree relocation within the City of La Quints road right of way shall be accomplished
by a licensed. bonded and insured tree service. and handled safelywithout interference or hazard to the traveling public.
It shall be the responsibility of the permittee to maintain the tree in a vigorous growing condition at its new location.
Trees to be removed shell be removed in sections which can be handled safelywdhout interference or hazard to highwav
traffic. The entire width of the tree stump Shall be removed and diSDOSed of so that no debris remains in view of the
highway. The stump hofeshall be backfilled and thoroughly compacted as specified in the following paragraph. Where it
becomes necessary to restrict traffic. the work shall be restricted to a maximum of 500 feet at any one time. Adequate
signs, flagmen and/or barricades shall be provided to protect the traveling public at all times.
Large holes resulting from tree removal shall be backfilled and compacted to not less than 90 percent or equivalent to the
surrounding ground. whichever is the greater compaction as determined by the impact or field method Compaction
tests shall comply with Section 6.3.01 of the Standard Specifications. Division of Highways, State of California. dated
January 1973.
R32 TREE TRIMMING:
a. Only the necessary trimming shall be accomplished to provide clearance of the facility for one calendar year.
_ All broken or weak sections within the trimming shall be removed.

In addition to the standard permit conditions, the following shall apply:
1. All work shall be performed in accordance with the latest edition of the "Standard Specifications
For Public Works Construction".
No fill shall be placed which will cover or obscure asphalt concrete, petroleum product spillage,
or other non-native materials.
2. Permittee shall furnish the name(s) and phone number(s) of the individual(s) responsible for
maintaining dust control after hours, weekends, holidays, etc.
3. All streets shall be kept clean of all trackage or spillage from vehicles using this site. The roads
shall be completely cleaned at the end of each work day, if necessary, and more frequently if
required.
4. Operation and maintenance of equipment within one half mile of human occupancy shall be
performed only during the following time periods:
October 1 st to April 30: Monday -Friday 7:00 a.m. to 5:30 p.m.
Saturday 8:00 a. m. to 5:00 p. m.
May 1st to September 30: Monday -Friday 6:00 a.m. to 7:00 p.m.
Saturday 8:00 a. m. to 5:00 p. m.
Equipment may not be operated or maintained on legal holidays including Sundays.
5. Permittee is responsible for repair of any pavement damage or other damage to access roads and
other public facilities:
7. Should additional work or modifications be required in order to meet established City Standards
or in order to fit field conditions, the work shall be performed by the permittee as directed by
and to the satisfaction of the City Engineer at no cost to the City of La Quinta.
8. It is the permittee's responsibility to comply with the California Regional Water Quality Control
Board's National Pollutant Discharge Elimination System (NPDES).
9. Any on-site haul road shall be effectively destroyed at the conclusion of the work to prevent use
by unauthorized vehicles.
10. Permittee/contractor shall install stop signs to stop construction traffic prior to entering any street
from the construction site.

11. If buried remains are encountered during development, a qualified archaeologist shall be
contacted immediately and appropriate measures shall be taken.

shall be maintained at all times with flagmen at all times per CALTRANS standards or the
WATCH (work area traffic control handbook).
14. All excavations at or near the travel way shall be backfilled at the end of each work day for the
protection of the traveling public. No trenches shall be allowed to remain open overnight.
15. All grading shall be performed per the approved grading plan for PP 92-498.

1. Applicant shall comply with all control measure provisions as set forth in the
approved FDCP, which shall include the following conditional measures and
requirements.
2. The full amount of security furnished with the approved dust control plan
shall be available to the City for measure(s) deemed necessary by the City to
achieve adequate dust control even though such measures may be other than
those listed by the applicant on this application.
3. Applicant shall submit copies of all records/invoices related to cost accounting
for the dust control measures assumed during grading construction. Said
records shall be submitted within 30 days after completion of all dust control
measures outlined in the plan, including any measures made part of the plan
as a condition to its approval. Security may be withheld pending submittal of
this information. All such invoices shall be provided along with the required
completion of the PM10 program report form, which can be obtained from the
Public Works or Planning Departments.
4. Paved roadways in areas to be graded shall be kept free of track -out and
flushed with water and/or wet -swept in sufficient frequencies and amounts so
as to prevent blowing dust due to traffic on pavement. Track -out of material
shall be prevented onto any pavement outside of the areas proposed for
grading. Any track -out into paved areas, either public or private, shall be
wet -swept or water -flushed by the end of the work day, and shall be kept
damp during hours of operation until such time as it is removed.
5. Any imported/exported materials shall be covered and/or wet down prior to
transport. If material is not covered, it shall be sufficiently stabilized
(watered down) so as not to spill or otherwise create dust during transport.
Minimum freeboard shall be as established by the Public Works Department.
6. Enforcement of these conditions shall be at the discretion of the assigned field
inspector, who shall verify in the field that the spirit and intent of the FDCP
and its attached conditions are being complied with. Adjustments to
application frequencies, quantities, and other aspects of this FDCP may be
made by the inspector, at his/her discretion, to insure such compliance.
7. All open earth areas shall be kept watered down or otherwise stabilized during
all phases of grading and building construction until such time as those areas
are actually built upon, landscaped, or otherwise permanently developed.
8. All employee vehicles shall be parked off-site in approved paved parking
stalls.
9. Applicant/ developer shall secure a building permit for security fencing if
deemed necessary by the Building and Safety Department.
