The following General and Special Provisions are attached to and made a part of permit No. GENERAL PROVISIONS The following shall always apply: ENROACEM NI' ON PRIVATE PROPERTY: This permit authorizes wort to be accomplished within City of La Quinta right way ONLY. Whenever construction extends within private property, it is the responsibility of the permittee for his contractors to secure permission from abutting property owners. Such authorization must be secured by the permittee prior to starting wort. TRACKLAYING CONSTRUCTION EQUD'MENT. Cleated tracklayiag construction equipment shall not be permitted to opers any paved surface unless fitted with smooth -faced street pads. PROTECTION OF TRAFFIC: All excavations and work areas shall be properly lighted and barricaded as deemed necessary by City Engineer or La Quints City Public Works inspectors. Suitable detours and detour signs shall be placed and maintained for the duration of the project. The City shall be notified 24 hours in advance of any traffic detours or delineations. CARE OF DRAINAGE STRUCTURES: Any drainage structure including corrugated metal pipe, concrete pipe, steel culvert an concrete structures encountered during excavation which necessitate removal shall be replaced in kind. In the event it becomes necessary to remove or cut existing drainage structures, City of La Quint& shall be notified prior to commencement of this work. Drainage structures and open drains shall be Rept free of debris at all limes for proper drainage. Damage to existing substructures resulting from operations conducted under this permit shall be thesole responsibility of the permittee. V UMJTY CLEARANCE: (Surface Structures) No work shall be done under this permit until all utilities are clear of the proposed work site. The permittee shall notify all concerned utility companies of the proposed work. Quinta forces to preclude delay or interference with State of City of La Quints projects. &12I SURVEY MONIA► WM: Prior to excavation or beginning of construction, all survey monuments which exist on the centerline of all streets or property fines when involved shall be completely tied out so they may readily and correctly be ' replaced by a lictnsed civil engineer or surveyor at the expense of the permittee. A complete set of notes showing the tier these monuments shall be furnished to the City Engineer prior to the removal of any monuments. This office shall be noti upon completion or replacement of all survey monuments for proper project clearance. 13 PAVEMENT CUTTING: Pavement will be mechanically saw cut to a straight to a straight edge prior to excavation. M, of pavement cutting shall be approved through the office of the City Engineer. (Under no circumstances shall excavating ! equipment be used to excavate prior to cutting of pavement) Excavation material shall be placed in such a position as to i facilitate the general now traffic. All excavations shall be properly barricaded with lights overnight, on weekends and holidays for the protection of traveling public. The Public Works Inspector shall determine the suitability of excavation barricading in each case. No excavation shall remain open for a period exceeding five (S) days. No excavation shall be made unless the construction material is actually on the work site. One (1) copy of each teat shall be forwarded to the City Engineer for approval and filed prior to making permanent repairs. Compaction tests shall be trade as outlined in Section 6.3.01 of the Standard Specifications, Division of Highways, State of California, dated January 1973. . R19 COMPACTION TESTS: If so required by the inspector, compaction tests shall be made for each crossing or service line. One (1) copy of each test shall be forwarded to the City Engineer for approval and filed prior to making permanent repairs. Compaction tests shall be made as outlined in Section 6.3.01 of the Standard Specifications, Division of Highways, State of California, dated January 1973. STREET RESTRIPING: Where street striping is still visible on streets to be excavated, such striping shall be replaced upo completion of permanent repairs. R24 TREE RELOCATION OR REMOVAL- Tree relocation within the City of La Quinta road right of way shall be accomplished by a licensed, bonded and insured tree service, and handled safely without interference or hazard to the traveli public. It shall be the responsibility of the permittee to maintain the tree in a vigorous growing condition at its new location. Trees to be removed shall be in sections which can be handled safely without interference or hazard to highway traffic. The entire width of the tree stump shall be removed and disposed of so that no debris remains in view of the highway. The stum hole shall be backfilled and thoroughly compacted as specified in the following paragraph. Where is becomes necessary to restrict traffic, the work shall be restricted to a maximum of 500 feet at any one time. Adequate signs, flagmen and or barricades shall be provided to protect the traveling public at all times. Large holes resulting from tree removal shall be backfilled and compacted to not less than 90 percent or equivalent to the surrounding ground, whichever is the greater compaction as determined by the impact or field method. At -this meeting, the representative from La Quinta demanded a "butt -joint" for the paving cap in their locality. We have planned ori Tuesday, January 28, 1997, to'lay a 10 -foot wide cap, r.. feathered out on.the sides, per the requirements of the County of Riverside. This method was proposed to the City of La Quinta when we applied for their encroachment permit, and it was accepted by them. Also, their encroachment permit did not specify any paving requirements, nor were we advised of any paving requirements while performing work in their locality under their in- spection. Also, since the installation of the paving cap is one continuous operation, it is not practical nor feasible to interrupt the operations to change the method of installation for only a few hundred feet of paved area.. Therefore, if we have any delays or changes in the method of installing the asphalt pavement cap in the City of La Quinta which is different from the method of operations for the County of Riverside, we will pass any additional cost to the Coachella valley Water District.for reimbursement. Any leakage in excess of this amoum shall be stopped in a manner satisfactory to the Engineer, and the test repeated until the total leakage does not exceed the amount specified. All obvious leaks shall be stopped in 3 manner satisfactory to the Engineer, whether or not the leakage from the line exceeds that permitted herein. 306-1.5 Trench Resurfacing. 306-1.5.1 Temporary Resurfacing. Unless permanent pavement is placed immediately, temporary bituminous resurfacing 50mm(2 inches) thick shall be placed and maintained at locations determined by the Engineer wherein excavation is made through pavement, sidewalk or driveways In sidewalk areas the temporary bituminous resurfacing shall be at least 25mm(1 inch) thick; in all other areas it shall be at least 50mm(2 inches) thick. At major intersections and other critical locations, a greater thickness may be ordered Temporary resurfacing shall be placed as soon as the condition of the backfill is suitable to receive it and shall remain in place until the condition of the backfill is suitable for permanent resurfacing. The bituminous mixture used for temporary trench resurfacing shall conform to Class D2 asphalt concrete mixture in 203-6.3.2; and bitumen conforming to grade SG 800 liquid asphalt in the Slow Curing Product table, 203-2.4 The mixture may be furnished from stockpiles or dircctl% from the plant and may be laid cold, at the option of the Contractor. Prior to placing temporary resurfacing, the Contractor shall level and compact the backfill on which the surfacing is to be placed. The grade of the backfill on which the resurfacing is to be placed shall be such as to provide the full thickness of temporary resurfacing specified. The temporary resurfacing shall be placed, rolled, maintained, and removed and disposed of by the Contractor. On improvements being constructed under contract with the Agency, the Proposal will contain a bid item for an estimated number of tonnes(tons) of temporary bituminous resurfacing materials. The price bid shall include full 543 compensation for furnishing, placing, maintaining, removing, ind disposing of such temporary resurfacing materials. Pa%ment will be limited to that quantity of material ordered placed by the Engineer and shall include material uscd to maintain the temporary resurfacing until the Ki-manent resurfacing is placed. Material which is placed by the Contractor for its convenience shall be at no cost to the Agency. 306-1.5.2 Permanent Resurfacing. Unless otherwise ft%%n on the Plans or in the Specifications, all surface tmproyements damaged or removed as a result of the Contractor's operations shall be reconstructed by the Contractor to the same dimensions, except for pavement thickness, and with the same type materials used in the original work. Trench resurfacing shall be 25mm(1 inch) greater in thickness than existing pavement. Subgrade for trench resurfacing shall conform to Section 101 and the pavement reconstruction shall comply with the applicable provisions of Section 302. 306-1.6 Basis of Payment for Open Trench Installations. Pipe and conduit shall be measured along the longitudinal a%is between the ends as laid and shall include the actual pipe in place and shall not include the inside dimensions of structures. House connection sewers shall be measured from the center of the main sewer to the upper end of the house connection sewer. Catch basin connections shall be measured from the inside face of the catch basin to the inside face of conduit or structure to which connection is being made. Chimney pipe shall be measured vertically from the upper cnd of the chimney to the invert of the sewer. The price per linear meter(foot) for pipe and conduit in rla:c shall be considered full compensation for all wyes, tees, finds. monolithic catch basin connections, and specials sho%%n on the Plans; the removal of interfering portions of casting sewers, storm drains, and improvements; the closing or removing of abandoned conduit and structures; the ex: n ations of the trench; the control of ground and surface %%atcrs: the preparation of subgrade; placing and joining pipe; tmckfilling the trench; permanent resurfacing; and all other DATE EVENT 4/8/96 Reviewed final plans for CVWD sewer main. No evidence of 10' asphalt overlay. 8/12/96 Issued encroachment permit to CVWD with first special condition stating all work shall be performed per "Greenbook." "Greenbook" states trench shall be resurfaced to the same dimensions. 9/30/96 Received encroachment permit application from Petar Artukovich Construction. No indication or evidence of 10' asphalt overlay. 10/4/96 Issued encroachment Permit to Petar Artukovich Construction with first special condition stating all work shall be performed per "Greenbook." "Greenbook" states trench shall be resurfaced to same dimensions. 12/13/96 Construction in progress 1/14/97 Hector Guzman questions contractor, Petar Artukovich, on how permanent resurfacing will be accomplished. Petar states he will cap the trench with 3/8" asphalt material. Hector informed Petar Artukovich 3/8" asphalt material not acceptable. Cap shall be 1/2" material. No indication or evidence of 10' asphalt overlay. 1/22/97 Petar Artukovich Construction informed Hector of 10' asphalt overlay and asked Hector to bring the 10' overlay to Public Works Managements attention and ask if they City would participate in the cost of paving the entire lane. Management elected not to participate in additional costs or paving and directed Hector to inform the Contractor to cap the trench only as originally intended. 1/24/97 Hector informed Contractor & CVWD"to cap only to trench and create a butt joint as originally intended. Hector was asked by CVWD inspector if this condition was in writing. Hector informed CVWD inspector Gregg Green that the City's position is that the permit which refers to the "Greenbook" indicates resurface only the trench area. CVWD Inspector Gregg Green asked Steve Robbins to call Steve Speer. Mr. Robbins spoke with Mr. Speer. Mr. Speer informed Mr: Robbins of tile, problems that may occur if a butt joint is not created and Mr. Robbins agreed with Mr. Spge . QRobbins also stated that he understood the City's positionla l 'he Contractor would be r spons'ble for his mistake. Field meeting with CVWD Inspector, Contrac r, and Hector. Contractor ��� and CVWD Inspector made aware that overlay. would not be acceptable to the City. 1/27/97 CVWD Inspector, Gregg Green asked Hector for paving requirements in writing so that the District would be able to justify extra work and make the City of La Quinta Financially responsible. Hector's. response was that the City's position was the -permit and greenbook was sufficient documentation, stating resurface only the trench area. 1/28/97 Washington Street paved with 10' overlay.
