As you know, the grading at the Desert Sands Unified School District project adjacent to our property has generated excess soil. At the present time, this soil is being stockpiled on the DSUSD site. Olah Engui ieering, the district's grading contractor, has been instructed to dispose of the soil. Since we will are planning the start of construction on our site as soon as hermits are obtained, it is . requested that we stockpile this soil on'our sitejust north of the DSUSD site. The total voluirie of soil is 8300 cubic yards, and it will be placed in the recessed area at the b4ck.of our property .adjacent to the DSUSD site. Olah Engineering will place the soil in flat layers, and will be watering the stockpiled soil every day, along with .watering the soil at the DSUSD�site. We anticipate the start of construction early next year, contingent on obtaining all ' of the required permits. Based on the information contained in that letter and in consideration of the Fugitive Dust Control provisions of the La Quinta Municipal Code, Chapter 6.16, the following measures shall be taken in order to allow the staging area to be established, provided that Public Works approves the encroachment permit to allow the request. The area to be used for stockpiling may be stabilized by water applications at the site, a minimum of twice per day, including non -work days. In the event that the DS.USD grading contractor is unable to or otherwise cannot maintain this schedule, or if it is determined by the City that more stringent measures need to be taken, the site shall be temporarily stabilized through hydroseeding application or with an approved chemical soil binder. Such a binder must be approved by the California Regional Water Quality Control Board (CRWQCB) prior to it's application and shall be maintained until such time as the soil is removed for use in on-site construction activities. It would be beneficial for the applicant to obtain quotes from vendors of these products and determine through CRWQCB, Region 7 in Palm Desert, which products can be approved for this site, in the event that use of a chemical binding agent is determined to be necessary. It would also be helpful in preparing the overall dust control plan which will be required in any future project approval. 2. No removal or other disturbance of soils on this staging area, or of the entire Lapis site in general, shall be permitted until an approved Fugitive Dust Control Plan (FDCP) is in place for the Lapis project; only initial spreading is permissible. 3. My understanding is that the applicant has determined, through consultation with other Planning staff and the project archaeologist, that this staging area is not in conflict with previously identified areas having potential for cultural artifacts, and that establishment of this staging area will not affect cultural resource mapping and recovery efforts in effect or which may be pending based on further investigations not yet completed. _ I 4. Borrow site(s) or any other areas from which soil is extracted for stockpile shall be. . stabilized in a similar manner as set forth in Item #1 above. 5. This approval to stockpile soil shall not be construed to mean that any grading activities may occur for the Lapis site or the DSUSD site beyond those activities for which a valid grading or other approved Public Works permit exists. This request will not require an FDCP application approval, as the.ordinance does not require a plan outright for establishment of soil staging or stockpiling, only for those existing at the.time of the ordinance effective date. Additionally, since the soil to be stockpiled will be used in and is tied to a pending project, a FDCP will be required,as part of the Lapis project conditions. I dont have a significant concern with this, given the DSUSD construction currently underway.
