This permit authorizes pre -watering, clearing, grubbing, and stockpiling of fill material associated with Site Development Plan 97-605 "Eagle Hardware". This permit is not for rough grading. 2. All work shall be performed in accordance with the latest edition of the Standard Specifications For Public Works Construction. 3. Eagle Hardware & Garden, "Permittee", shall be responsible for providing continuous dust and erosion control. The Permittee shall comply with"the provisions. and conditions of Fugitive Dust Control Plan (FDCP) 9743. The Permittee shall stabilize any soil that is' left disturbed as a result- of esult-of work performed under this permit with an approved dust control treatment. The City shall have the right to stop work in progress in the event dust control standards are not met. The Permittee shall not proceed with work until dust levels are reduced and clearance is given by the City. Inspector. 4. Streets shall be kept clean. They shall be completely cleaned at the end of each working day and more frequently if required. 5. The Permittee shall comply with the local noise ordinance. Operation and maintenance of equipment within one half mile of human occupancy shall be performed only during the following time periods: October 1st to April 30: Monday -Friday 7:00 a.m. to.5:30 p.m.. Saturday 8:00 a.m. to 5:00 p.m. May 1 st to September 30: Monday -Friday 6:00 a.m to 7:00 p.m. Saturday 8:00 a.m. to 5:00 p.m. 6. Work hours at signalized intersections or within 500 feet.of a signalized intersection are typically from 9 a.m. - 3 p.m. to avoid peak traffic periods but may vary depending on the location of the intersection. The Permittee will be notified by the City of specific work hours (if different) during the 48 hour notice period. 7. 1 Work shall be prohibited on legal holidays including Sundays. Work is allowed on Saturdays only if special arrangements, including payment of overtime inspection fees, have been made two (2) working days prior to the desired Saturday. 8. The Permittee shall assume responsibility for repair of any pavement damage to any public or private street and for any damage to other City streets or facilities as a result of work performed under this permit. Upon notification, the Permittee shall respond immediately to correct said damage at its own expense. 9. Advance warning signs and traffic control shall be installed and maintained in accordance with Cal Trans Standards or the Work Area Traffic Control Handbook (WATCH Manual). The Permittee Special Conditions - Permit No. 2618 Page 1 of 3 SPECIAL CONDITIONS --PERMIT NO. 2618 --- Eagle Hardware & Garden --- shall submit -a traffic control plan that shall provide for a minimum of one travel lane on paved surface with a flagman as necessary. Access and egress to all local properties shall be maintained at all times. It shall be the Permittee's responsibility to detour and barricade the work site. 10. Prior to excavating, the Permittee shall contact Underground Service Alert at 1-800-422-4133. 11. Should additional work, materials, or modifications of the work be required in order to meet city standards, safety requirements, signage requirements, or to fit actual field conditions, the work shall be performed by the Permittee as directed by and to the satisfaction of the City Engineer at no cost to the City of La Quinta. 12. All excavations at or near the travel way shall be backfilled -and paved at the end of every workday as directed by and to the satisfaction of the City Engineer for the protection of the traveling public. 13. Backfill compaction within improved street rights -of way shall conform with Section 306-1.3 of the Standard Specifications For Public Works Construction (SSPWC). All trench backfill shall be compacted to a minimum relative density of 90% using native material with a minimum frequency of one test per every 300 linear feet per lift: All backfill shall be mechanically compacted in lifts of eight (8) inches or less. Jetting or flooding of backfill material will not be allowed unless otherwise approved by the City. All test data shall be submitted to the City, including failing tests and retests. 14. Where trenching is performed in any P.C.C. or A.C. improved area the trench shall be saw cut an4 additional Fon each side of the excavation area and a buttjoint created. The edges shall be saw cut to straight, stable, and unyielding edges. Feather joints are not acceptable. The finished pavement surface shall be smooth and consistent,'and shall conform to the surrounding grades. Trenches in the street section shall be permanently paved within seven (7) days after completion of the work unless otherwise approved by the City. 15. Permanent pavement replacement structural section shall be one inch greater thanexisting, or 4" minimum, which ever is greater. A.C. mix design shall be approved by the city prior to placement. 16. All landscaping, irrigation, decorative rock, decorative concrete, lighting, etc., shall be replaced to its original condition.- 17. ondition: 17. The city has designated by ordinance certain city streets as Truck Routes. The weight limit for restricted streets (i.e. streets not part of the Truck Route network) is three (3) tons; trucks exceeding the weight limit may use the restricted street if making a delivery or pickup on the subject street, or if this permit specifically grants permission to use the street to deliver street construction materials and/or equipment. INC. SDP 97-605; 13.4 ACRES GENERAL: 1. Applicant shall comply with all control measures as set forth in the approved . application for, FDCP 97-13, and the following conditional measures. 2. The full amount of security furnished for the approved FDCP (to be determined by Public Works) shall be available to the City for any measure(s) deemed necessary by the City to achieve adequate dust control, whether or not such additional measures are included by the applicant for this'application. All track -out shall be removed as per Condition #5. 7. Any on-site employee and equipment parking areas shall be properly stabilized, compacted and./or paved to accommodate such traffic activity. If on-site roadways or parking areas are constructed to ultimate design or otherwise paved prior to any construction activities commencing, then construction traffic and parking shall be limited to those paved areas. 8: No vehicular parking or traffic of any kind is permitted on or over any previously stabilized or other inactive soil areas.- 9. All temporary office facilities (sales, construction, etc.) shall be provided with paved, compacted or otherwise stabilized parking and access during their operation, with those improvements to be constructed as required by Public Works Department standards. This requirement shall be in effect whether or not included' in any approval for such facilities under a minor use'or other permit process. 10. Disturbed but inactive development areas, where construction activity ceases for more than 30 days, shall be watered daily in conjunction with watering of access roads and developing areas until an appropriate .dust suppressant,' as defined in Chapter 6.16 and approved by the California Water Quality Control Board, Region 7, has been 'applied. 11. All disturbed.areas where further grading, construction or'other land disturbance will not occur within 30 days shall be -.stabilized no later than four days after completion of the activity, and staked, posted or otherwise restricted in order to prevent any vehicular access onto or over those areas. 12. The contractor/vendor responsible for provision of all soil stabilizing agents shall submit the appropriate Material Safety Data Sheet(s), along with approval from the Water Quality Control Board, to the Public Works Department prior to any site application. Application of stabilizing agents.must be in compliance with NPDES and the state Water Quality Control Board. requirements. 13. Enforcement of these conditions shall be at the discretion of the assigned grading inspector, who shall monitor and field verify that the spirit and intent of the FDCP and its attached conditions are being complied, with: Adjustments to application frequencies, quantities and other aspects of this FDCP may be made by the inspector, at his/her discretion, in order to assure compliance. 14. The approval provisions and conditions for this dust control plan shall remain in effect for the -duration of all construction undertaken as part of the approval. for Site Development Permit 97-605. Transfer of any real property or other interests with respect to this project will have no effect on the validity of this plan approval or conditions. Implementation of all measures as proposed and conditioned shall be carried out for. the duration of .all construction activities, to the extent they are applicable to specific activities. 15. Approval of this dust control plan does not in and of itself constitute orotherwise authorize any site disturbance, preparation or construction. The developer is required to obtain all necessary permits and clearances as set forth. in any development approvals issued and currently in effect pertaining to this site. This includes any type of testing, monitoring or.' r sampling required as a condition of development approval, such as. that conducted for archaeologic, hydrologic and geologic reporting purposes, as well as payment of any outstanding fees associated with the site, such as for CVFTL or other pre -construction fees. SITE-SPECIFIC REQUIREMENTS: 16. The conditions applied to this dust control plan are anticipated to cover the full. range of construction operations associated with, the Eagle hardware site;. the provisions of this plan shall be in effect for the duration of all construction work on' the project, and dust control efforts as necessary shall be continued until the project reaches completion.. 17. FDCP 97-13 indicates approximately 51,000 CY of fill and 43,000 CY .will be imported for the site. All transported soils shall be sufficiently stabilized (watered down and/or covered) so as not to create dust during loading, transport and . spreading. Minimum freeboard, shall be established by the Public Works Department. Any on and.off-site'storage piles shall be covered or suitably stabilized at all times. All,borrow'areas shall be chemically stabilized to mitigate airborne dust. These requirements shall be applicable to any haul/encroachment permit(s) issued by Public Works. 18. As required by the air quality mitigation measures for construction related impacts (Ultrasystems Environmental, Inc.; Air Quality Analysis: Eagle Hardware and Garden Center; June 4, 1997), no more than 60% of the total 13.39 acre site area .may be disturbed on a daily basis.
