2014-1004 (MUP)P* I March 18, 2015 RcAft t;E' V Justin Davis JAN U 6 2017 Crown Castle Communications 38 Technology Drive, Suite 250 CO,MMU OF QUINT Irvine, Ca, 92618 NITyDEVELOpMENT SUBJECT: Minor Use Permit 2014-1004 Wireless Facility Modification at 78136 Frances Hack Lane Dear Mr. Davis: The Community Development Department has reviewed and approved your request to install three (3) additional 4.725 -foot high panel antennas, three (3) new radio remote units (RRU) and one (1) new fiber cable on an existing tower, and install associated equipment in existing cabinets, at a telecommunication facility located at 78136 Frances Hack Lane (within the La Quinta Corporate Yard area). Approval of this application is subject to the exhibits on file for the Minor Use Permit and the following Findings and Conditions of Approval: FINDINGS A. Consistency with the General Plan: The proposed equipment additions at the existing telecommunication facility are consistent with the goals, objectives and policies of the General Plan, in that the proposed equipment is intended to enhance community access to quality wireless communication services. B.: Public Welfare: Approval of new equipment for an existing telecommunication facility will not create conditions materially detrimental to the public health, safety and general welfare. C... The proposed new equipment at the existing telecommunication facility will minimize adverse visual impacts as the proposed replacement antennas will be placed on an existing lattice tower and not add any additional number of antennas beyond existing. The associated equipment will also be placed entirely within existing equipment shelters. D.. The proposed new equipment is designed to facilitate continued function of the existing antenna array, without modifying the height or other pre-existing conditions to maintain the service provider's objectives for coverage within this portion of the community. E;.;, The proposed new equipment is necessary to improve community access to wireless services. CONDITIONS 1,. The applicant/property owner agrees to defend, indemnify, and hold harmless the City of La Quinta (the "City"), its agents, officers and employees from any claim, or litigation arising out of the City's approval of this project. This indemnification shall include any award toward attorney's fees. The City of La Quinta shall promptly notify the applicant of any claim, action, or proceeding and shall cooperate fully in the defense. 2: The applicant shall comply with all provisions of La Quinta Municipal Code Section 9.170 "Wireless Telecommunication Facilities". 3,: The applicant shall comply with all provisions contained in Conditions of Approval for Conditional Use Permit 2009-127 (CUP 2009-127). Applicant shall replace any deteriorated faux palm fronds with new faux palm fronds. Under the CUP approval, the applicant is to maintain a minimum of sixty (60) faux palm fronds. Fronds shall extend to the lowest point of the any panel antennas. All faux fronds are to resemble live palm fronds in both color and appearance, to be approved by the Planning Division. 4.. The applicant is permitted to install the following on the existing tower and antenna array: three (3) new 56.7" x 12.6" x 6.3" panel antennas on the existing antenna array (total of two panels per sector); three (3) new radio remote units (total of two RRU's per sector); and, one (1) new fiber cable. All new and replacement equipment shall be painted to match the -color in context of its location. Applicant is also permitted to install all related equipment, as identified on the approved plans for MUP 2014-1004, within the existing equipment cabinets located in the lease area. 5:; New cables running from the equipment shelter to the new antennas shall be contained within the existing cable bridge between the tower and the equipment enclosure. All cables shall be interior of the tower and shall not be visible from surrounding properties. 6. The applicant shall obtain all necessary building permits from the City's Building Division, and is responsible for meeting all applicable plan check submittal requirements. 7. The City may elect to add Conditions to this application request to mitigate any problems that arise not previously addressed herein. This decision may be appealed to the Planning Commission by any party who submits the necessary paperwork and filing fee of $1,595.00 to this office within 15 days of the date of approval of this permit.
