Streets shall be kept clean. They shall be completely cleaned at the end of each street fair and more.
frequently if required.
2. Permittee shall assume responsibility for repair of any pavement damage to any public or private'
street and for any damage to other City streets or facilities as a result of work performed under this
permit.
3. Advance warning signs and traffic control shall be installed, and maintained in accordance with Cal
Trans Standards or the Work Area Traffic Control, Handbook (WATCH Manual). It shall be the
perniittee's responsibility,'to detour and barricade this site. ' Refer to traffic control plans provided by
the City of La Quinta, Drawings A, 1, 2, and. 3.
4.. Should additional work, materials, or modifications of the work be required in order to meet city
standards, safety requirements, signage requirements, or to fit actual field conditions, the work shall .
be performed by the permittee as directed by and to ;the satisfaction of the City Engineer at no cost
to the City of La Quinta.
5. It shall be the permittee's responsibility to maintain a clear and accessible fire access route across
the library's driveway. This area shall be kept clear of any.parked vehicles and be accessible at
anytime to emergency vehicles. -
Special Conditions - Permit No. 2661
The following General and Special Provisions are attached, to and made a part of Permit No.
GENERAL PROVISIONS
The following shall,always apply:
ENROACH1v1ENT ON PRIVATE PROPERTY: This permit authorizes work to be accomplished within City of La Quinta right of
way ONLY. Whenever construction extends within private property, it is the responsibility of the permittee for his contractors to
secure permission from abutting property owners. Such authorization must be secured by the permittee prior to starting work.
TRACKLAYING CONSTRUCTION EQUIPMENT: Cleated tracklaying. construction equipment shall not be permitted to operate on
any paved surface unless fitted with 'smooth -faced street pads.' All mechanical outriggers shall be fitted with rubber street shoes. to
protect the paving during excavations. Rubber -tired equipment only shall be used in backfill operations in paved areas. If the existing
pavement is scarred, spalled, or broken during the term of this contract, or if the pavement is marred, City of La Quinta shall request
that these portions of road be resurfaced over their entire width. Resurfacing shall consist of one coat of two inches (2") of A.C.
surfacing plus appropriate seal cost as specified, above.
PROTECTION. OF TRAFFIC: All ezcavations'and work areas shall be properly lighted and barricaded.as deemed necessary by the
City Engineer or La Quinta City Public Works inspectors. Suitable detours and detour• -signs -shall be placed and maintained for the
duration of the project. The City'shall be notified. 24 hours in'advance of any traffic detour's or delineations.
CARE OF DRAINAGE STRUCTURES: Any drainage structure including corrugated metal pipe, concrete pipe, steel culvert and '
concrete structures encountered during excavation which necessitate removal shall be replaced in kind. In the event it becomes
necessary to remove or cut existing drainage structures, City of La'Quinta shall be notified prior to commencement of this work.
Drainage structures and open drains shall be kept free,of debris at all times for proper drainage.
RIGHT OF WAY CLEANUP: Any surplus material resulting from excavation and backfill operations shall be removed from the right
of way. All paved surfaces shall be broomed' clean•of earth and other objectionable materials immediately after backfill and compaction:
Existing gutter line and drainage ditches'shall be replaced' to their original .standard or better. All excess material shall be removed
prior to paving. Water tanker shall be used,. as required, to sprinkle the job site to k_eep'down dust conditions and shall be used -
immediately after backfill.
DE -WATER OPERATIONS: If de -watering operations are required and pumps are forcing water on City of La Quints roads, it shall
be the responsibility of the permittee (contractor) to"control" this water and to provide off-street barricades when necessary..
CLOSING STREETS: No street'shall be closed. A minimum of one lane of traffic shall be maintained at all times to provide limited ,
access. for the adjoining property owners and emergency vehicles. In the event it is' felt by the permittee that he must close a' street for
any length of time, permittee shall contact this office to obtain the necessary' permission.
SPECIAL PROVISIONS
The following shall apply when indicated:
R1 NOTIFICATION: Permittee shall: notify the -,City at (619)777-7075 at least 48 hours in advance of starting construction.
R2 'UTH= CLEARANCE: (Substructures) Prior to making any excavation within the City of La Quinta right of way
authorized by permit, the permittee shall contact all concerned utility companies relative to the location of existing
substructures. Damage to existing substructures resulting from operations conducted under this permit shall be the sole
responsibility of the permittee.
R3 UTILITY CLEARANCE: (Surface Structures) No'work shall be done under this permit until all utilities are clear, of the
proposed work site. The permittee shall notify 'all'concerned utility companies of the -proposed work. ,
R4 PAVEMENT WIDENING: Area between the proposed concretegutter line and the existing road pavement shall be surfaced
with inches of A.C. paving placed on . inches of class aggregate subbase course having an "R"
value of not less than : and in conformance with City of La `Quints Road Improvement Standards and
Specifications, Ordinance #461.
R5 PARKWAY GRADING: Area between the property line and top of the proposed concrete curb shall'be graded to a slope of -
1/4 inch to one foot (1').
R6 GRADE CHECKING: City of La Quinta shall check grades upon receipt of plan and profile and/or grades as established by
a ficensed'engineer.
R7 CURB' REMOVAL FOR DRIVEWAYS: A portion of the existing concrete curb and/or curb and gutter (_feet) shall be
removed:' Curb and/or curb'and gutter shall be 'saw cut prior to removal. Depressed curb,,matching concrete gutter and
concrete driveway I approach' shall be constructed in conformance with City of La Quinta Standard #207.
R8 DRIVEWAYS:" A.C. driveways shall be constructed' as not to alter existing drainage pattern. Surfacing between the property
line and the existing road paving shall be 2 1%2 inches of A.C. paving placed on of class aggregate base.
Driveway construction shall conform to attached drawing.
R9 SIGHT CLEARANCE: Sight clearance of 600 feet in all directions shall be assured and maintained at all times...
R10 SOIL STEREMER: The area to be surfaced shall be treated with soil sterilizer. Rate of application shall commply with the
manufacturer's specifications,
R11 COORDINATE WORK: The proposed work shall be subordinated to any operation which the State of California or City of
La Quints may conduct in this area during the period of this perroit. Work shall be coordinated with the State or City of La
Quinta forces to preclude delay or interference with State of City of La Quinta projects.
R12 SURVEY MONUMENTS: Prior to excavation or beginning of construction, all survey monuments which exist on the
centerline of all streets or property lines when involved shall be completely tied out so they may readily and correctly be
replaced by a licensed civil engineer or surveyor at the expense of the permittee. A complete set of notes showing the ties to
these monuments shall be furnished to the City Engineer prior to the removal of any monuments. This office shall be notified
upon completion or replacement of all survey monuments for proper project clearance.
R13 PAVEMENT CUTTING: Pavement will be mechanically saw cut to a straight to a straight edge prior to excavation. Method
of pavement cutting shall be approved through the office of the City Engineer. (Under no circumstances shall excavating
equipment be used to excavate prior to cutting of pavement.) Excavation material shall be placed in such a position as to best
facilitate the general flow traffic. Prior to final paving operations, any damage to pavement straight edges shall be corrected.
R14 LIMIT' OF EXCAVATIONS: Excavations shall be limited to 1000 linear feet of open trench before backfill operations must
begin. All excavations shall be properly barricaded with lights overnight, on weekends and holidays for the protection of the
traveling public. The Public Works Inspector shall determine the suitability of excavation barricading in each case. No
excavation shall remain open for a period exceeding five (5) days. No excavation shall be made unless the construction
material is actually on the work site.
R15 BACKFILL MATERIAL: Backfill shall be free of brush, roots or other organic substance detrimental to its use for purposes
of producing an adequately consolidated backfill. Any material which the City of La Quinta deems unsuitable (spongy or
saturated material) which is encountered during excavation shall not be used for backfill, but shall be supplemented or replaced
by an approved sand or gravel.
R16 BACKFILL SAND: Backfill shall be approved transit -mix sand or equivalent and shall be placed in lifts of not greater than
three feet (3') and vibrated using vibrotamper or equivalent equipment. Alternate methods may be substituted, but in any case,
a relative compaction of 95 percent shall be attained with the structural section of the roadway.
R17 BACKFILL PLACEMENT: Backfill shall be applied in layers of not more than 50 percent of the total depth of the trench
before flooding or a maximum of five-foot (5') lifts where trenches are of excessive depths. Care is to be exercised that the
backfill material is not subjected to extreme swell by flooding operations. Backfill material shall be placed so that the resulting
compaction shall be not less than 90 percent or equivalent to the surrounding ground, whichever is the greater compaction.
Where ponding or flooding is used for a mikimum settlement, adequate dikes will be constructed to retain the water. Where
jetting is used, the jets shall be of sufficient length to reach the bottom of each layer and the water supply shall be continuous.
R18 COMPACTION TESTS: If so required by the inspector, compaction tests shall be made at intervals of not more than 1000
feet and a minimum of one (1) test on each road. One (1) copy of each test shall be forwarded to the City Engineer for
approval and filed prior to making permanent repairs. Compaction tests shall be made as outlined in Section 6.3.01 of the
Standard Specifications, Division of Highways, State of California, dated January 1973.
R19 COMPACTION TESTS: If so required by the inspector, compaction tests shall be made for each crossing or service line.
One (1) copy of each test shall be forwarded to the City Engineer for approval and filed prior to making permanent repairs.
Compaction tests shall be made as outlined in Section 6.3.01 of the Standard Specifications, Division of Highways, State of
California, dated January 1973.
R20 TEMPORARY PAVEMENT REPAIRS: After completion of backfill and compaction operations, a temporary patch
consisting of 2 inches of SC -800 shall be placed on a prepared subgrade. The SC -800 temporary paving shall be placed after a
maximum of 3000 linear feet of trench has been excavated and backfill operations completed, but in no case shall the
placement of the temporary pavement exceed a five (5) day limit.
R21 PERMANENT PAVEMENT REPAIR: After backfill and compaction have been completed, a temporary patch consisting of
two inches (2") of SC -800 shall be placed immediately. A permanent patch of inches A.C. surfacing placed on a
inch class base shall be placed no later than days after completion of temporary road repair.
R22 FOG SEAL: A fog seal coat consisting of an application of asphaltic emulsion shall be applied over all patch areas as
determined by the City Engineer.
R23 STREET RESTRIPING: Where street striping is still visible on streets to be excavated, such striping shall be replaced upon
completion of permanent repairs.
R24 TREE RELOCATION OR REMOVAL: Tree relocation within the City of La Quinta road right of way shall be
accomplished by a licensed, bonded and insured tree service, and handled safely without interference or hazard to the traveling
public. It shall be the responsibility of the permittee to maintain the tree in a vigorous growing condition at its new location.
Trees to be removed shall be in sections which can be handled safely without interference or hazard to highway traffic. The
entire width of the tree stump shall be removed and disposed of so that no debris remains in view of the highway. The stump
hole shall be backfilled and thoroughly compacted as specified in the following paragraph. Where is becomes necessary to
restrict traffic, the work shall be restricted to a maximum of 500 feet at any one time. Adequate signs, flagmen and or
barricades shall be provided to protect the traveling public at all times.
Large holes resulting from tree removal shall be backfilled and compacted to not less than 90 percent or equivalent to the
surrounding ground, whichever is the greater compaction as determined by the impact or field method. Compaction tests shall
comply with Section 6.3.01 of the Standard Specifications, Division of Highways, State of California, dated January 1973.

On September 16, 1997, the City Council, on a 5-0 vote, approved Resolution 97780 allowing the
temporary closure of Calle Estado on November 7, 1997, and -December 5, 1997, between the hours
of 5:00 P.M. and 11:00 P.M. for the Mainstreet Marketplace events. A copy of the final Resolution
may be obtained by contacting the City Clerk's Office.
Please contact the Public Works Department to obtain an Encroachment Permit to comply with the
required Conditions of Approval for TUP 97-144 (i.e., Condition #18).

I have enclosed. a copy of the "traffic' control plan" from last year changing the 96 date to '
a 97 -date. The entire layout of the event will be the same and the,tiaffic,pattern will not
change. i
Calle Estado business owners have been notified in writing of Mainstreet's 97/98 schedule
and of the traffic requests for the events. I per delivered the letters to each'business.
A notification letter given them is attached.
At5:00 p.m. all vehicles should be off the street, vendors will then be allowed to. begin
their "set up. ;
Calle Estado is officially closed off to through traffic at 5:30 p:m. and -I will.have:people'
stationed at the entrance and exits allowing in vendor, and set up traffic only.
At 6:00 p.m. Calle Estado is closed off to all traffic until the.event is over at'10:00 P.M.
and it is safe to allow vendors automobiles in for break down of booths. • ;

The following Conditions shall be completed by October 15, 1997:
A'Certificate of Insurance, in the minimum amount of $1,000,000.00, shall be
posted naming the City and its employees as being coinsured for liabilities arising
from these special events.
2. Vendors who sell or serve alcoholic beverages shall obtain a license from the State
of California Alcoholic Beverage Control Department.. A copy of the special permit
shall be given to the Community` Development Department. Alcoholic beverages
shall be served in paper or plastic cups:
3. Permits for temporary use structures. or any open flame devices shall be obtained
prior to .installation. If you have any questions, please contact Fire Safety
personnel by calling 863-8886.
4. A notice shall be sent to affected commercial businesses and property owners
explaining the upcoming event and/or any parking restrictions. A copy of the notice
shall be submitted to the Community Development Department..
'S 5: The applicant shall submit a traffic control plan for -the City's review. A permit for
the proposed event will not be issued until the traffic plan has been .approved by the
City Engineer. ,

CONDITIONS OF APPROVAL
TEMPORARY USE PERMIT 97-144
MAINSTREET MARKETPLACE
FINDINGS:
1. The event will not be detrimental to the health, safety, and general welfare.of the
community in the area of the proposed event.
A. Various public agency permits are required prior to the events) occurring to
insure that the event will be. conducted in an acceptable manner. Health
Department permits are required for all food and beverage vendors serving
the event, and police and fire personnel will be on hand to assist the
organizers in providing a safe environment for vehicles and patrons coming
to the event. The public roadways surrounding the project are capable of
handling the local patrons. No problems are anticipated which would be
detrimental to the community based on the recommended Conditions.
B. This project is categorically exempt under Section 15311 (Class 11(c)) of the
California Environmental Quality Act (CEQA) because the outdoor event is
being conducted on an existing public street. The City Council shall review
and approve the street closure permit request for Calle Estado prior to the
event occurring insuring proper traffic control measures are taken to protect
the citizens of La Quinta during the event hours.
C. Temporary signs directing patrons to the event will be displayed along
various public streets in the community. The. signs will be placed so that
they do not interfere with traffic safety signs or other facilities (i.e., traffic
signals, etc.). Sign removal will occur immediately after the event is over to
guard against the signs becoming roadside debris or litter.
2. There is adequate area to conduct the event and to accommodate the anticipated
attendance.
A. This temporary outdoor fair is held on Calle Estado, which when closed to
through traffic, can accommodate daily patrons because various on- and off-
site facilities will be provided such as restrooms, food and beverages,
parking, and other facilities which provide services to those paying to attend
the daily, activities. The surrounding commercial businesses are active
participants in this annual venue thus making it -a success special City -
sponsored event. The' information is on file with the Community
Development Department.

9. All on-site food and beverage vendors shall obtain a City Business License.
Community Development Department
10. The maximum number of off-site directional signs is 30 for each date. The signs
may be installed on one week prior to each event, but must be removed within 72
hours. Any other temporary signs for the event shall be approved by this
Department.
11. A cash bond (or check) in the amount of $200.00 shall be posted to insure that all
off-site signs are removed. The security deposit is refundable provided the signs .
are removed after the event. The Community Development Department shall
receive the deposit.
12. Calle Estado shall not be blocked or barricaded unless -prior approval has been
obtained from the City Council and Public Works Department.
Sheriff Department .
13. Riverside County Sheriffs Deputies shall be employed during the event to provide
security and traffic control supervision 'as determined by their agency through prior
contractual arrangements.
14. Any vehicles that block traffic will be towed at the owner's expense.
15. All designated security personnel must possess a. current private security guard
license issued by the State of California.
16. Lighting must be adequate to ensure customer safety.
Public Works Department
17. Placement of temporary directional signs shall comply with Chapter 9.160 (Signs)
of the Municipal Code. Temporary signs on public right-of-way shall not be placed
closer than 100 -feet from any intersection unless specifically approved by. the City
Engineer.
18. The applicant shall obtain an encroachment permit before closure or obstruction of
any roadway or placement of any signs, barricades or other advertising or traffic
control devices in the right-of-way._
19. The applicant shall be responsible for the installation, maintenance "and/or removal
of all traffic control devices required for each special event. ,

Fire Department -
20' Fire lanes shall be established and/or maintained during the special events.
G neral Conditions
21 i If ground excavation, is required, please contact Underground Service Alert (USA)
at 1-800422-4133. The service is free of charge provided USA is -given at least'
two days' notice.
22: Before any cranes, forklifts, or other aerial equipment is raised, please check for
existing overhead wires. -
23. All food and beverage vendors'shall have a permit to operate from the Riverside
County Health Department.
24. Permits from other public agencies shall be obtained as needed to comply with the
above-mentioned conditions. ' +
25.1 The City may elect to add Conditions to this application request to mitigate any
problems that arise not previously addressed herein.

Attached, please find our application for a "temporary" outdoor permit for our 1997A,"13'
Mainstreet Marketplace street fair series on Calle Estado.
We respectfully request that the City waive any permit fees associated with this series of,
special events as we are a non-profit organization and the city is a sponsor.
The hours of operation will be 6:00 to 10: 00 p.m. on the following dates:

(If theseries, is reduced to four events, the months of October and May will be
eliminated.) u
We will request in writing from the Building and Safety Dept. that the street be closed
down, as it has in the .past, to vehicular traffic at 5:00 p.m. with the exception of vendor
vehicles unloading. All vehicles will be off the street by 6:00 p.m. We will have 2
uniformed officers from the Riverside County Sheriff s. Department there at 5:00, to assist
with the street closure and to have any cars removed that are in violation of the
"Temporary No Parking" signs.
We anticipate approximately 50+ booths on both sides of the street and in the center.
Additionally there will be a live band, a beer and wine garden, food court and an
amusement area for the kids.' The beer and wine garden will either be staffed by a La
Quinta service organization or volunteers of the Chamber.
All vendors will be required to submit an application to operate through our office and pay
a specified space fee.
