Dear Mr. & Mrs. Marks,
The Architectural Committee has reviewed your Architectural Variance Application for the
addition of the above listed variances per the plan submittal prepared by Rembrandt Pools &
Spas, Inc., received by the Association office on August 15, 2017. The proposed scope of work
is to be in accordance with the Architectural Guidelines, Homeowner's Association CC&R's and
Maintenance and Indemnity Agreement. This acceptance letter is not a Notice to Proceed. A
Notice to Proceed Letter will be provided upon completion of any pending items.
The following conditions and/or requirements are pertinent and subject to the acceptance.
1. The Spool Equipment is to be located within the Utility area adjacent to the condo
garage and arranged next to the gas meter along the extended privacy wall at the
entry. All in accordance with and subject to the City of La `Quinta Building
Department As was previously discussed, this configuration is consistent with
another installation.
2. Contractor Insurance — To date the HOA has not received proof of insurance for
auto coverage for your contractor Rembrandt Pools. Rembrandt Pools has informed
the HOA that there will be three subcontractors working on this project.
Rembrandt Pools is exempt from carrying Workers Compensation because they
claim to have no employees, therefore each sub -contractor must provide the HOA
with proof of Workers Compensation coverage. Gary Houck at Rembrandt Pools is
aware of this. Please notify your contractor. With regard to Rembrandt Pools not
carrying workers compensation, the HOA requires a written statement from
Rembrandt Pools to that effect.
3. Provide a landscape and irrigation and yard lighting plan for areas being disturbed
and renovated by the spool and decking for review and acceptance by the
Landscape Manager. New lighting for bocce court and pool area to be provided for
review.
4. The Bocce Ball perimeter structure cannot be attached or in contact with the
adjacent building wall and foundation. Required elevation clearances next to the
adjacent unit are required and provide proper surface drainage. The installation is
acceptable based on not causing or impacting the adjoining condo.
5. Locate and stake the rear property line based on legal docs and maintain clearance
to main irrigation and wiring. Staked corners are to remain during construction
and for final inspection. The rear boundary line of the RBB and new decking to be
the existing concrete decking edge.
6. The homeowner and the contractor to schedule a meeting with the Landscape/Irrigation
Manager, Bill Bobbitt, and the Maintenance/Lighting Manager, William Aceves,np 'or to
the start of any work. The purpose is to confirm the pre-constniction condition,
establishing the responsibility for existing HOA property as documented by photographs.
7. The homeowner and contractor are required to provide code compliant drainage flow and
Water drain system to prevent damage to the structure and adjacent areas`
8. The contractor is to verify and locate any easements and underground utilities. Any
damage or disruption is to be repaired immediately. Note: there are likely existing
irrigation main lines and control wires in this area to be verified and the HOA notified. If
it is found that any of the Association infrastructures need to be moved, it is the
homeowner's responsibility to have his contractor perform the work.
9. The contractor is responsible for all protection, rerouting and modifications of existing
utility services belonging to HOA or utility companies.
10. Any electrical wiring exposed during construction must be reported to the Association.
11. The contractor to repair and/or replace any damaged irrigation, landscape, hardscape,
lights, drainage devices or street surface damage to the satisfaction of the HOA.
12. All landscape and irrigation modifications are the responsibility of the homeowner and
their contractor. Only Toro brand sprinkler heads are to be used. Any lawn repair must
be done with 328 -hybrid Bermuda sod.
13. All modifications to the existing sprinkler systems are to be made by the contractor to the
satisfaction of the HOA.
14. The HOA is not responsible for demolition or removal of existing hard3cape, landscape,
sprinklers and lighting.
15. The homeowner and contractor are advised to comply with the contractor's working
guidelines and vehicle rules.
16. The contractor must provide traffic control devices and personnel during the work period,
if required for safety. All contractor vehicles are to be parked on one side of street only.
17. The contractor is not allowed to stockpile any material, equipment or ccnstruction debris
in the street. All debris must be cleaned up daily.
18. The street gutters cannot be used for concrete wash out and the contrac-or is responsible
for keeping the gutter clear and free of debris. Streets are to be cleaned Gaily.
19. Upon completion, the homeowner is required to provide a signed copy of the city
inspection card and the Notice of Completion Certification letter (enclosed).
20. The homeowner and the contractor to schedule a meeting with the landscape/irrigation
manager and the maintenance manager prior to submitting a Notice o Ccmpletion form.
21. The project should be completed within 60 days of starting.
22. The Committee's review is only for the architectural implications of the project. All
codes, legal and engineering are the responsibility of the homeowner and contractor. The
review does not include verification of proposed dimensions.
23. All new BBQ island fixtures to be permitted by the city.
24. A Maintenance and Indemnit� Agreement shall be signed prior to the start of work and
reviewed at the completion of the project. Same shall delineate all applicable work,
which current and future owners shall be compelled to solely maintain and/or replace as
needed, and, the document shall be recorded with the County of Riverside and runs with
the land.
We reserve the right to make a final inspection of this change to make sure fiat it matches the
original request. An approval is based only on the aesthetics of your proposed plan and should
not be taken as any certification as to the construction worthiness or structural integrity of the
proposed change.
