Desert, CA 9226.0 SUBJECT: MINOR ADJUSTMENT 2017-0001 APR 3 2011 49415 RANCHO SAN FRANCISQUITO CITY of LA OUINTA COMMUNITY DEVELOPMENT Dear Mr: Vuksic: The Design and Development Department has reviewed your Minor Adjustment application (MA 2017-0001), pursuant to Section 9.210.040 of the City of La Quinta Zoning Code. REQUEST: Allow a 10% increase in the maximum allowable size of a guest house. The maximum allowable size would increase from 976 square feet to 1,073 square feet. DECISION: Approval is granted for the requested adjustment based on the following findings and subject to the conditions of approval listed below: 1. Minor Adjustment 2017-0001 is consistent with the La Quinta General Plan, in that the proposed guest house is consistent with the Low Density Residential land use designation. 2. Minor Adjustment 2017-0001 is consistent with the intent of the La Quinta Zoning Code, in that the requested adjustment is within the allowable adjustments under Section 9.210.040 of the Municipal Code, and the project will comply with all other development standards of the Low Density Residential zone. 3.. Processing and approval of Minor Adjustment 2017-0001 is in compliance with the California Environmental Quality Act. The adjustment requested falls under CEQA Guidelines Section 15305(a) as a "Minor Alterations to Land" - Class 5 Categorical Exemption. 4. Approval of Minor Adjustment 2017-0001 is . not detrimental to the public health, safety and general welfare, nor injurious or incompatible with other properties and land use in the vicinity. A building permit shall be obtained prior to construction. 2. The proposedconstructionshall comply with all other development standards as required under the La Quinta Zoning Code. 3. The guest house shall be used only by the occupants of the main residence, their non-paying guests, or domestic employees. The guesthouse shall, not be rented or otherwise occupied separately from the main residence. 4. Prior to the issuance of a building permit, the applicant shall provide the City with, a recorded deed restriction prohibiting the use or conversion of thE.guesthouse to a rental unit or to a unit for sale. This approval, relates only to allowance of the increased total square footage of the guest house: as stated above,: and does not imply any entitlement or approval of a building permit for any structures shown on the plans on file. Dear Mr. Bilodeau, The Talante Architectural Committee and the Board of Directors met to review your plans submitted on 12/15/16 for a new Casita addition at your existing residence. After review, the proposed project and design is approved contingent on receipt of the clarification as outlined below and attached: Site plan 1. There is a slightly pitched/almost flat roof section over the bathroom at the south elevation. A parapet wall is shown to conceal mechanical equipment. There is no dimension shown from FG to the by of the parapet, but it looks like it could be 12'? This is setback from the p/15'. It is the neighboring property's side yard, so maybe this isn't as much of a concern? 2. There is no elevation provided for the new arched wall and gate that connects the exiging home to the casita, so could not tell what this detail looks like. Construction 3. Owner must obtain all permits through City of La Quinta. 4. Owner agrees to ensure that the contractor keeps the streets, gutters and adjacent prop-,rties.clean and free of dirt, trash, debris or other material related to or caused by the work and clean up of all street spills on a daily basis. Sweeping the streets'every day, prior to washing down the street every night. Do :got let any'debris travel down the streets toward any neighbors. 5. Construction hours are Monday through Saturday from 8:00 AM — 5:00 PM. 6. Owner will be held responsible for any road damaged caused by contractors work or vehicles. We strongly recommend .use of plywood sheets under roof materials of stockpiles on the road as needed to protect the road surface. This is especially important during this period 'ofextreme heat. 7.
