Any person may initiate a street name change for any reason consistent with law, by complying with the provisions of this chapter. (Ord. 10 § 1 (part), 1982) 14.08.020 Initiation of petition. A proposed change of street name may be initiated by filing with the planning commission an application in the form prescribed by the city manager and signed by the owners of at least sixty percent of the lineal frontage abutting the street to be affected. (Ord. 10 § 1 (part), 1982) 14.08.030 Application fee. The application shall be accompanied by a fee in an amount established by resolution of the city council, in order to defray the costs of publishing, post ing and processing, as hereinafter prescribed. (Ord. 10 § 1 (part), 1982) 14.08.040 Manager's examination. The city manager shall examine the application and determine the sufficiency of same as to the percentage requirement of Section 14.08.020. (Ord. 10 § 1 (part), 1982) 14.08.050 Adoption of resolution of intention. Upon determination of the sufficiency of the petition, the commission shall adopt a resolution of intention to change name and set a date for public hearing not less than thirty days from the date of adoption of the resolution. The city manager shall provide for at least one publication of the resolution of intention in a newspaper of general circulation within the city at least fifteen days prior to the hearing date. (Ord. 10 § 1 (part), 1982) 14.08.070 Posting. The city manager shall provide for posting copies of the resolution of intention in at least three public places along the street proposed to be affected. The posting shall be completed at least ten days prior to the hearing date. (Ord. 10 § 1 (part), 1982) 14.08.080 Commission hearing. At the time set for hearing, or at any time to which the hearing may be continued, the commission 536 M 14.08.080 shall hear and consider proposals to adjust, alter or change the name(s) of the street(s) mentioned in the resolution, and objections to the proposals. (Ord. 10 § 1 (part), 1982) 14.08.090 Commission recommendation. At or after the conclusion of the hearing, the commission may make any recommendation to the city, council which the commission deems appropriate. In its deliberations the commission shall consider any applicable specific plans in effect. (Ord. 10 § 1 (part), 1982) 14.08.100 Council action. The city council may, pursuant to California Government Code Section 34091.1, take such action as it deems appropriate upon the recommendation of the commission, and failure to take action within sixty days after submission of the commission's recommendation shall be deemed denial of the application. Notwithstanding any other parts of this code, the commission may, for any reason it deems in the public interest and necessity, recommend to the city council that a street name be changed. The recommendation may be made without complying with the requirements of Sections 14.08.020 through 14.08.080. PUBLIC NOTICE The Planning Commission at their meeting of June 8, 2004 adopted Resolution 2004- 036 setting this date for consideration of this street name change. As required by Code, the Resolution was published in the Desert Sun and posted. REQUEST The applicant had submitted a request to change the existing name of Simon Drive to Deputy Lee. Drive. The applicant is proposing to change the street to honor Deputy Bruce Lee, a police officer killed in the line of duty in the City of La Quinta last year. DISCUSSION A search of the City records as well as the United States Postal Service database indicated there are no addresses on Simon Drive. Further, the property owners along Simon Drive have given consent to the proposed street name change. Lastly, this matter was circulated to the United States Postal Service, Fire and Sheriff Departments and no concerns have been expressed regarding the proposed street name. Since Bruce's death in May of 2003, we have all discussed the appropriate manner in which to memorialize Bruce. Many ideas have come forward and I have supported all of them. Bruce will always be remembered in our hearts and minds and on Peace Officer Memorials in Riverside, Sacramento, and Washington D.C. as well as "The Hall of Heroes" at my headquarters office. Deputy Sheriff Bruce Lee served the City of La Quinta with great pride and distinction for many years and council recognition of the sacrifice that Bruce made is more than warranted. It has come to my attention that there are those who have expressed dismay over the renaming of Simon Drive. As a former La Quinta resident, I am well aware of the Simon family's record of service and philanthropy in this city and understand some people's concern. Assistant Sheriff Lingle informed the Planning Commissioners that I had contacted our state assembly member and requested that Highway 111, in the City of La Quinta, be dedicated in Bruce's honor. The display of the signs on Highway 111 will in no way impact the name of the highway. To preserve the memory of Mr. Simon and honor the tremendous sacrifice of Bruce Lee, I would like the Council to consider support of an alternative that should be acceptable to all concerned. I ask that you join me in recommending that Highway 111 be dedicated in Bruce Lee's honor.
