Daniel Valenzuela and I met Mark Moran at the site. Planning Commissioner Bob Wright showed up as he offered his services,to Mark Moran at the April 10, 2012 Planning Commission meeting. We walked the violations and identified the corrections. Attached is the Correction List Ed reviewed and recommended, a few :flanges regarding .PM-10 issues. It was sent via fax to both Ms. Clarke and Mr. Moran today.- I also mailed both of them a copy. Mark agreed to start immediately. We are providing 60 days to correct all code violations. The final day they have to appeal to the City Council is April 27, 2012. Hopefully, they will pass on appeal and will focus their attention on cleaning up the site. Provide a 30' fire -break by clearing all brush within thirty feet of the chain link fencing with green fabric and the southerly block wall including all brush in the rights -of -way. Overgrown vegetation: Trim a 7' canopy under the trees and trim two tamarisk shrubs to grade in the retention basin to eliminate areas for vagrants to camp out of view. 2. Provide one of the three Long -Term Stabilization techniques itemized on the attached Dust Control Plan. If you decide you want to farm the land, please contact the Planning Department regarding the permitting process. Fencing was the remedy discussed to mitigate air -borne dust from crossing the property line into the entry to Lake La Quinta. Please advise if you choose an alternate remedy. Replace all tattered PM-10 fabric and backfill the eroded area near sand filters, in the retention basin. Grade and compact stockpiled fill dirt onsite. 3. Remove all construction and miscellaneous debris from the entire site. 4. Remove any remaining vegetation growing between the chain link fencing and green fabric and the pedestrian sidewalk. 5. Graffiti: Blocking out graffiti on the green fabric with black spray paint is acceptable. Paint over any graffiti on 'site and maintain graffiti -free. Aventine Apartments abated the graffiti on the block wall and will. maintain in future. 6. Sign Maintenance: Thank you for restoring the PM-10 signs. Please advise if the phone number on the sign is still active and if someone will be able to respond in the event of a dust incident. 7. .Thank you for restoring the failed fence. Maintain the perimeter fencing to prevent vehicular access and to prevent vagrants from camping on the site. With regards to the time to start the work and complete all corrections, Mr. Moran proposed starting the work immediately and completing the work in 60-90-days. In an effort to remedy all adverse impact issues on adjacent properties, the time -frames are as follows: 1) thirty days to award the contract; 2) sixty days to complete all corrections to the Notice of Public Nuisance. Below is a reply to the two concerns raised by Mr: Mark Moran on April 18, 2012 at the site: Mr. Moran stated the block wall on the southerly perimeter of the site is not the property line. He suggested the property line may be approximately 8-10' north of the block wall. The enclosed Parcel Map No. 34855 Page 3 of 3 shows the referenced area under Note A at the top right of the plan as a sewer and water easement dedicated hereon to the Coachella Valley Water District. Easements provide access for utilitieshowever they do not change property lines or Maintenance requirements. Therefore, the maintenance of the area in question is to be maintained by the developer. • Mr.. Moran stated the paved street stub -out at the east end of the project tying into La Quinta Dr. is city property and should be city -maintained. Enclosed Parcel Map No. 34855 Pages 2 of 3 and 3 of 3 show it as a private street. There are no references of the private street being dedicated to the city.
