DETERMINATION FOR PERMISSIBLE FENCE MATERIALS
Dear Mr. Pitts:
This is to formally notify you that on July 10, 2012, the La Quinta. Planning
Commission, by a 5-0 decision, did uphold the determination that the Planning
Director provided regarding permissible fence materials in the front and sideyards
by adoption of Minute Motion 2012-005. This action was taken subject to staff's
analysis that the La Quinta Municipal Code prohibits wood fencing in the front and
side yards when visible from surrounding streets in the City of La Quinta.
This action is final unless .appealed to the City Council (per La Quinta Municipal
Code Section 9.200.120) within 15 days of the action. Please contact our
department should you wish to appeal.

Dear Mr. Pitts:
The Code Compliance Division was advised of the Planning Commission's decision to uphold staff
recommendations to prohibit wood fence materials in the front yard visible from the street in
compliance with La Quinta Municipal Code 9.60.030 (E) (1) (a). As the fencing was constructed in
seventy-two (72) hours, we are providing until July 30, 2012 to remove the unpermitted wood fencing.
This provides through three weekends to remedy the violation.
We are aware you intend to obtain a Building Permit to replace the existing wood fencing with approved
materials such as wrought iron with block columns. This is entirely separate from correcting the code
violation and you can take as much time as you desire to submit plans for these improvements or can
choose not to do these improvements at all.
We will schedule an inspection for July 30, 2012, to confirm the prohibited wood fencing has been
removed. A failure to remove the unpermitted fencing may result in administrative citation or other
legal remedy. If you have any questions regarding this correspondence, please contact me directly at

A. Appealable, Decisions. Any development review action by the director may be appealed to the planning • .

TEN (10) DAYS from the date of this notice. Your property will be re -inspected to verify
compliance after the ten (10) day time frame has lapsed. If you need additional time to correct

I have received and reviewed your request for a Director's Determination regarding the
construction of a wooden fence along a side yard at 51-411 Avenida Villa in the La Quinta
Cove. Your residence is located at the corner of Avenida Villa, a public street, and an un-
named' alley which has been'identified is a 20' wide dedicated public right-of-way-.
Sebtitiri 9-:60:030 of the La Quinta Municipal Code states that "wood and vinyl or similar
i.a06feeffeticing materials are permitted in rear or interior side yards only, and only if not
visible from the street."
Based upon my review of your property, existing public rights -of -way, and site photos, it is
my determination that your wooden fence' has been constructed along an exterior side
setback, is currently visible from the street, and is therefore not in compliance with Section
9.60.030 of the La Quinta Municipal Code.
Thisdecision: may be appealed to the La Quinta Planning Commission, provided a formal
application for appeal and filing lee of $175.00 are submitted in person to the Planning
Department within 15 calendar days Of this letter. Please contact our office should you

"L" shaped 1937 ranch house is Spanish Colonial Revival in style with Pueblo Revival details. Stucco clad
house features multi -level shed roof of red clay tile. Long part of "L" is higher and runs from street front to
back of house. Front facade features 3 vigas under slanting shed roof. A large wooden lintel caps a pair of
original wooden double doors. These doors feature the "Z" timbers and rectangular slat vents. A front porch
with secondary shed roof runs parallel to long wing and is connected perpendicularly by foot of "L" which has
its own narrow porch created by an extension of shed roof. Roof is not original and replacement tiles are much
flatter and weaker in pattern than original roof tiles. Original wooden porch supports have been encased in
stucco and enlarged. Front fenestration relationship exists (single window on long wing; double window set on
short wing) but original windows have been replaced. Tapered stucco clad chimney with original chimney port
is located on end wall of short wing.

I was 'in the area and observed that new wooden fence went up 4/02/12
over the weekend. I"made contact with new owner and issued 4/02/12
10 Day Courtesy warning notice and asked him to go in to 4/02/12
city hall and talk to building department about permit for 4/02/12
approved fence with approved material. Pictures were taken 4/02/12

speak to Officer Rodarte, he was off. Kay and myself did not 4/16/12
