At'their meeting of December 21, 1987,. the .City Council accepted
the decision notice of the Planning Commission for your requested
parking variance.
The conditions of approval are attached. A draft agreement will
be prepared ,and sent to the City Attorney for review and
approval. Upon execution of this agreement, per condition #1, a
building permit will be issued for the internal remodel/tenant
improvements.

Subject: Time Extension for (V_ar'iance #87-005)and Plot Plan

Dear Mr. Johnson:
On December 13, 1988, the Planning Commission considered your
request for time extensions for the above noted cases. After
lengthy discussion, the Planning Commission found your remodel
proposal, approved by the Commission prior to the adoption of the
Village at La Quinta Specific Plan, to be inconsistent with the
design guidelines of that Plan. The Commission, therefore, voted to
continue consideration of your extension request, to permit you the
opportunity, to reevaluate the building remodel in light, the Village
Specific Plan. A copy of the adopted Specific Plan is available at
City Hall, should you need a copy. Please consider the design
guidelines contained within the Specific Plan when redesigning your
proposed remodel.
In order for the City Council to consider the time extension on your
Variance, the Planning Commission must first grant the Plot Plan
extension. Therefore the parking variance extension request being
held pending the resolve of the Plot Plan time extension request.
Shouldyou have any questions concerning the above, please contact
the undersigned. Also, please feel free to review any revised
remodeling sketches with this office before yob finalize a new
submittal.

Commission approved the above -referenced matter subject to the
attached conditions.
The decision of the Planning Commission is final unless a
written appeal, accompanied by a filing fee of $175.00, is filed
with the Planning and Development Department prior to 5:00 p.m.
on December 28, 1987. Further information regarding appeal
procedure may be obtained from this office.
The matter is being listed for the December 21, 1987, meeting of
the City Council, as a Notice of Decision on the Consent
Calendar, at which time a report of the Commission action will
be received. The meeting will start at 2:00 p.m. or 2:30 p.m.

1• Plot Plan #87-383 was approved subject to conditions
(attached). A building permit cannot be issued until
these conditions of approval are. satisfied.
2. Variance #87-005 was approved subject to conditions.
Enclosed is a copy of.. an agreement prepared per City
Attorney's format. Prior to the issuance of a building
permit this agreement must be executed.
3• Plot Plan #87-383 expired October 11, 1988, and the
Variance #87-005 expires December 8, 1988. However, your
letter will be considered as an extension request should
you wish to pursue same.
4• The building permit plan check was completed with
corrections noted, including compliance with Plot Plan
and Variance conditions.
5• Once the conditions, are satisfied, and the Plot Plan and
the Variance are still valid, a building permit can be
issued.

The La Quinta Planning and Development Department has completed an
environmental assessment on the Variance request. Based upon this
assessment, the Variance will not have a significant adverse effect
on the environment; therefore, a Negative Declaration has been
prepared. The La Quinta City Council will consider the adoption of
the Negative Declaration along with the Variance at the Hearing.
Any person may submit written comments on the Variance to the
Planning and Development Department prior to the hearing and/or may
appear and be heard in support of or opposition to the adoption of
the Negative Declaration and/or the Variance the.. time of the
hearing. If you challenge the decision of this Variance in court,
you may be limited to raising only those issues that you or someone
else raised either at the Public Hearing or in written correspondence
delivered to the Planning and Development Department at, or prior to,
the Public Hearing. The proposed Variance may viewed by the
public Monday through Friday from 8:00 a.m. until 5:00 p.m. at the
