Instructions to Applicant
Filing Procedure
The applicant shall submit the following items:
1. A completed application form.
2. Six (6) copies of sealed plans illustrating the specifics
of the request.
3. Three (3) sets of mailing labels indicating the names and
mailing addresses of property owners within 300 feet of
the exterior limits of the property involved in this pro-
posed project, one (1) photocopy of the above list, and
one (1) set of assessor's maps indicating the above
property.
4. The planning fee as established by the Municipal Ordinance.
Procedure By City
Upon receiving a complete application package, the City will
process and review the case as follows:
1. The application will be reviewed for adequacy and a determination
is made whether an Environmental Impact Report (SIR) is required.
2. If an EIR is required, the applicant vill be so notified and a
Draft Environmental Impact Report must be submitted by the applicant.
Additional fees are required for SIR's.
3. If an SIR is not necessary, or if one is filed when required, a date
for Planning Commission review will be set. The Planning Commission
holds Public Hearings on the second Tuesday of each month, beginning
at 7:00 p.m. in the Council Chambers, 78-105 Calle Estado.
4. When processing the application, the Planning Commission will consider
such factors as:
a. Purpose of a Variance.
°The purpose of the variance is to allow variation from the
strict application of the terms of this chapter whereby
reason of topography, extraordinary situation or condition
of such piece of property, the literal enforcement of this
chapter would involve practical difficulties or would cause
undue hardship unnecessary to carry out the spirit and purpose
of this chapter.:
b. Provisions for Granting a Variance.
°The Planning Commission may grant a variance providing that
it finds:
(1) No special privilege is extended to one individual
property owner, i.e., the circumstances must be such
that the same variance would be appropriate for any
property owner facing similar circumstance; and,
(2) The granting of the variance will not be injurious to
public welfare, nor to property in the vicinity of the
application; and,
The variance ahall be in harmony with the general '
purpose and intent of the zoning ordinance and general
plan; and,
(4) A variance, if approved, shall be made subject to such
conditions as are necessary to accomplish the purpose
of these regulations; and,
In no event shall a variance be issued to allow a use
not otherwise permitted in a alone."

GOLF ESTATES)
Dear Mr. & Mrs. Jack Eldridge:
We are in receipt of your request to convert an existing two and a half car garage
into an attached guest house pursuant to our R-1 Zoning Code standards, as well as
your request to exceed the City's 300 square foot size limitation.
In our past discussions, we have stated that, per the City's Municipal Code, your
request to have a guest unit three times the allowable size permitted cannot be
approved even though you have stated that there are some pre-existing guest or
accessory units in your neighborhood. The City's new code requirements for this
type of request went into effect in October, 1992. All new units must abide by these
requirements.
We have had discussions with Mr. Juan Carlos Ochoa, your project architect, about
changing your application request from a guest house application which requires a
variance application because of its size to a second unit (i.e. granny unit)
application because the provisions are different for each type of accessory unit.
The second unit provisions allow a larger unit pursuant to Ordinance 213 because the
code was established to permit independent living arrangements for those persons
who are 62 years of age or more. It is my understanding that you wish to convert
the garage to a living quarter for your wife's father. Therefore, you meet the intent
of the current code requirements. We have enclosed a copy of the ordinance for
your review. The additional filing fees for the conditional use permit are $1,145.00
should you desire to change your application request.
Your variance application is currently incomplete because we have not received your
colored presentation exhibits or your materials board as outlined in the application.
Please submit this material to our office as soon as it is available. Once received, we
will establish a meeting date for your variance case or conditional use permit
application if you decide to modify your existing request.
